SUMMARY OF CHANGES

SECTION SF 1449 - CONTINUATION SHEET

SOLICITATION/CONTRACT FORM

The required response date/time has changed from 10-Jan-2013 11:00 AM to 26-Feb-2013 04:00 PM.

The following have been modified:

52.212-2 EVALUATION--COMMERCIAL ITEMS (JAN 1999)

(a) Basis for Award: The Government will award at least one and up to two contracts resulting from this solicitation to the lowest priced, technically acceptable responsible Offeror(s) whose offers conform to the solicitation.

The Government will evaluate offers for technical acceptability. For a proposal to be “technically acceptable”, a rating of “Acceptable” must be achieved for both the “Technical Factor” and the “Past Performance Factor”. A rating of “Unacceptable” in technical or past performance will result in an overall “Technically Unacceptable” rating of the proposal. A finding which causes a rating of “Unacceptable” for Past Performance Factor may require clarification or discussions. From among the technically acceptable proposals whose Offerors are eligible for award, price will become the determining factor for making the award(s).

Technical Ratings

RATING DESCRIPTION

Acceptable Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.

I. Technical Factor: Below are the criteria that will be evaluated for technical acceptability. To be determined technically acceptable, Offerors shall meet or exceed the following, submitted and provided under Attachment #1:

A. Grounds Maintenance General: The Offeror has sufficient resources and structure to perform required services as demonstrated by:

(1) Sufficient quantities and types of equipment that meet or exceed industry standards and are suitable to the terrain and paved areas to be maintained as described in the Performance Work Statement.

(2) An organizational diagram showing sufficient management and staffing to provide services at two different locations at the same time.

B. Grounds Maintenance Certificates and training. The Offeror provide adequate and qualified personnel as demonstrated by:

(1) Technical Project Manager for Grounds Maintenance: certified Gaertnergehilfe plus 5 years of vocational experience or a Certified Gaertnermeister.

C. Tree Maintenance Certificates and training. The contractor can provide adequate and qualified personnel as demonstrated by:

(1) Personnel for basic registration and monitoring of trees:

• Trained and certified as FLL zertifizierter Baumkontrolleur or equal.

• Training and proof of experience with tree inventories, within the last 3 years, with references.

(2) Personnel performing tree work:

• Certificates as Certified Arborist, European Tree Worker, Agronomist for Tree Maintenance or similar qualifications.

• References for experience of 3 years with tree maintenance.

(3) Personnel providing rope supporting tree work:

• Certificate of training IAW UVV VSG 4.2 para.2. with certification SKT A and B “Accident Prevention Regulation”.

(4) Technical Project Manager for Tree Maintenance:

• Certificate for Engineering/graduate degree in the field of Forestry, Horticulture, Agriculture or equal (e.g. Landespflege).

• References demonstrating at least 3 years of experience in managing tree maintenance in accordance with environmental laws, tree protection, ZTV Baumpflege and work safety.

II. Past Performance: The Government will evaluate past performance submitted and provided under Attachment #1 as follows.

RATING DESCRIPTION

Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.

Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.

The Government will evaluate the Offeror’s record of relevant and recent past performance information pertaining to grounds and tree maintenance services. The Government will evaluate the past performance information submitted by the Offeror, and past performance information obtained from sources other than those identified by the Offeror, which may include, but not be limited to, CPARS, PPIRS, Federal, State and local Government agencies, better business bureaus, published media, electronic data bases and personal knowledge. In evaluating past performance, the Government will consider the Contractor’s conformance to contract terms, standards of good workmanship (quality), timeliness and adherence to schedules, history of reasonable and cooperative behavior and overall businesslike concern for the interests of the customer.

A. Past Performance Information requirements:

(a) Maximum Number of Contracts: 5

(b) Recency – Performed within the last 3 years.

(c) Relevancy – Services are for grounds maintenance services and/or tree maintenance services similar in size and scope of subject solicitation.

B. Offerors are cautioned that in conducting the past performance assessment, the Government may use data provided in the Offeror's proposal and data obtained from other sources. The Government may not necessarily interview all of the sources provided by the Offeror; therefore, it is incumbent upon the Offerors to explain the relevance of the data provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of demonstrating “acceptable” past performance rests with the Offeror.

C. In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the Offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, "unknown" shall be considered "acceptable."

D. The Government may reject a proposal if it is found that any information that has a negative impact on the Offeror’s past performance record has been deleted, misrepresented, or withheld.

III. Price: Offers submitted in response to this solicitation shall be priced in Euros. Offers received in a currency other than Euro shall be rejected.

A. The Government will evaluate price as follows:

1. Grounds Maintenance: Evaluated price will be the sum of prices for CLINs 0001, 0002, 1001, 1002, 2001, 2002, 7500, 7501, 7502, and the price for the potential option under FAR 52.217-8.

2. Tree Maintenance: Evaluated price will be the sum of prices for CLINs 0003, 1003, 2003, 7500, 7501, 7502, and the price for the potential option under FAR 52.217-8.

B. Basis for Single or Multiple Award(s).

1. Single award: An Offeror has submitted for all CLINS AND has been rated technically acceptable for both Grounds Maintenance and Tree Maintenance AND offers the lowest evaluated prices for Grounds Maintenance and Tree Maintenance.

2. Multiple Awards: No single Offeror has offered for all CLINs OR no single Offeror meets the criteria in B.1. above. One award will be made to the lowest priced technically acceptable Offeror for Grounds Maintenance and one award will be made to the lowest priced technically acceptable Offeror for Tree Maintenance.

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement (see above for methodology). To account for the option period(s) possible under Clause 52.217-8 (maximum six months), Option to Extend Services, the Government will take the price for all ELINs of the final option period, prorate it to a six-month value, and add it to the sum of all CLINs (base plus all option periods). This amount plus the CMR CLINs will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
