MICC 2015 ____ _ MICC-FORT BUCHANAN CONTROL NO. 15-0012
JUSTIFICATION DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
Fire Truck Refurbishment
1. CONTRACTING AGENCY: Mission Installation Contracting Command (MICC), MICC-Fort Buchanan Puerto Rico
2. DESCRIPTION OF ACTION: This procurement is for the remanufacture, upgrading, and modification of E-One Cyclone II Fire Engine Rescue Pumper for Fire & Emergency Services, Directorate of Emergency Services (DES), Fort Buchanan, Puerto Rico.
Estimated dollar value is $267 ,000.00
3. DESCRIPTION OF SUPPLIES/SERVICES: The requirement is for remanufacturing, upgrading, and modification of one (1) E-One Cyclone II Fire Engine Rescue Pumper for Fire & Emergency Services, Directorate of Emergency Services (DES), Fort Buchanan, Puerto Rico.
All work requested is to bring the truck to current operational and NFPA 1901 standards.
4. AUTHORITY CITED: This action is authorized under provisions of the test program for commercial items, IA W FAR 13.50l(a)(1 )(ii), pursuant to the authority of Section 4202 of the Clinger Cohen Act of 1996 as codified at 10 USC 2304 (g)(l )(b) and 41 USC Sec 427([)(2,. as implemented by FAR 13.501 (a)(l ), Sole Source (including brand name) acquisitions.
5. REASON FOR AUTHORITY CITED:
a. Background: This requirement is for the remanufacturing of one (1) E-One Cyclone II Fire Engine Rescue Pumper. The truck has become obsolete and is in need of refurbishment. The refurbishment will bring the truck to a "like new" condition and into compliance with NFPA 1901, Standard for Automotive Fire Apparatus and NFPA 1912, Standard for Fire Apparatus Refurbishing (Chapter 6 - Level II Refurbishing).
b. Alternatives: An alternative to completing the remanufacturing process is the procurement of a new truck. Due to existing funding constraints, this option is not feasible.
c. Justification: E-One is the original manufacturer of the E-One Cyclone II Fire Engine Rescue Pumper Fire truck. E-One maintains authorized dealers that are able to get the parts required for this upgrade, but due to the scope and complexity of the remanufacturing, upgrading, and modification, the authorized E-One dealers do not have the capabilities to complete the task to current NFPA 1901, Standards for Automotive Fire Apparatus. The frame was designed by E One for this apparatus and has a life time warranty. The remanufacturing will completely disassemble the apparatus to the frame. The chassis frame and cross members will then be evaluated and modified. The remanufacturing must be accomplished by E-One to avert voiding the warranty. The remanufacturing will bring the E-One Cyclone II Fire Engine Rescue Pumper Fire Truck into applicable standards to meet applicable motor vehicle regulations and NFPA 190 I, Standard for Automotive Fire Apparatus and NFPA 1912, Standard for Fire Apparatus Refurbishing (Chapter 6 - Level II Refurbishing).
d. Prior Acquisitions:
• W9 I 249-13-P-0088, refurbishment of E-One truck with similar scope procured on a sole source basis to E-One, total contract value, $464,694.00.
• W9 I 249-14-P-0043, refurbishment of E-One truck with similar scope procured on a sole source basis to E-One, total contract value, $ 417 ,436.00.
e. Impact: Failure to remanufacture the E-One Cyclone II Fire Engine Rescue Pumper Fire Truck will severely impact the Fire Department's mission by decreasing their ability to provide fire protection. This loss of ability also affects the Fire Department's abilty to respond to emergencies that could result in loss of life.
6. EFFORTS TO OBTAIN COMPETITION: E-One is the only contractor with the capabilities and access to patented parts to remanufacture this pumper and meet the minimum needs of the Government. E-One frames have a life time warranty; therefore, the remanufacturing must be accomplished by E-One.
7. ACTIONS TO INCREASE COMPETITION: E-One maintains that Repair and replacement must be approved by E-ONE Customer Service Department. E-One is the only contractor with the capabilities and access to patented parts to remanufacture this pumper and meet the minimum needs of the Government. E-One frames have a life time warranty; therefore, the remanufacturing must be accomplished by E-One to avert voiding the warranty.
8. MARKET RESEARCH: The manufacturer, E-One, indicated that the authorized dealers are able to get the parts required for the remanufacturing, but due to the scope and complexity of the remanufacturing only the manufacturer is able to bring the apparatus up to OEM standards.
9. INTERESTED SOURCES: The only known capable source for this requirement is E-One, Inc. No other source identified has expressed interested in providing the services stated above.
