INSTRUCTIONS TO OFFERORS
Instructions to Offerors
Read the solicitation in its entirety and all amendments and complete the checklist before submitting documents. Payments will be made after receipt of a proper invoice and receipt of acceptable supplies/service. Regular office hours: Monday to Friday, 8:00 a.m. to 4:30 p.m. CST.
Emailed quotes must be in a file format readable by Adobe or Microsoft Office; this is the only acceptable method of submitting a quote. All documents must be attached in one file. Reference the solicitation in the subject line. Send quotes to jeff.w.morris@usace.army.mil. Ensure your quote is received before the due date and time. In order for your quote to be considered responsive, all required materials must be received before the due date and time. If all required materials are not received, your quote may not be considered.
This procurement is being conducted in accordance with Simplified Acquisition Procedures (SAP) of FAR Parts 12 and 13. Any reference to offers or bids or offerors or bidders should be substituted with quotations or quoters. All reference to discussions shall not be interpreted under FAR Part 15, but rather indicate that the Government may communicate with offerors/quoters as allowed under simplified acquisition procedures.

SITE PREPARATION AND INSTALLATION OF
PRE-CAST CONCRETE DOUBLE VAULT TOILET

PART 1 - GENERAL
1.1 SCOPE OF WORK
The Contractor shall provide all labor, materials and equipment necessary to remove existing Gunnison CXT from Elm Point PUA and reinstall at Hwy 9 North PUA; and install new pre-cast concrete double vault toilet (CXT Double Rocky Mountain or equal) at Elm Point PUA. Work consists of the construction of compacted base, installation of building and performing the final placement of the building in Elm Point Park, Lake Eufaula, Pittsburg County, Oklahoma.
Contractor will transport removed vault to Hwy 9 N. PUA and reinstall. The work will consist of the construction of compacted base, installation of building and final placement of the building.
1.1.2 Locations and associated work requirements.
1.1.2.1 Pre-cast concrete double vault toilet shall be procured and installed in Elm Point Park.
Specifications/requirements will be per manufacturer’s recommendations. New vault shall be CXT Double Rocky Mountain or equal. If proposing an “or equal” product, ensure specifications are attached for evaluation purposes.
1.1.2.2 CXT Gunnison Single Vault removed from Elm Point, transported and reinstalled at Hwy 9 North PUA using specifications/requirements per manufacturer’s recommendations.
1.1.3 Utilities
None provided.
1.2 REFERENCES
Manufacturer’s criteria for the installation of pre-cast concrete vault toilet buildings. All work shall be accomplished in accordance with all State of Oklahoma and National Standard work practices.
1.3 PAYMENT
Payment will be made in a lump sum upon completion and acceptance of work. Acceptance will be based on inspection and approval by the US Government.
1.4 WORK HOURS
Regular work hours will be from 8:00 am – 7:00 pm Monday through Friday, excluding Federal holidays. Any requests to work outside of the regular hours will be made in writing to the Contracting Officer.
1.5 COMPLETION TIME
Work shall be completed in 90 calendar days after award of contract.
1.6 SAFETY REQUIREMENTS
The contractor shall comply with the Corps of Engineers Safety Health Requirements Manual, EM 385-1-1 dated 3 November 2003, and all applicable Federal, State, and local safety codes and practices. It is the contractor’s responsibility to ensure public safety during the entire duration of the contract. Necessary signs, barriers, warning devices, etc. shall be operated and maintained by the contractor at contractor expense. Contractor employees shall comply with the minimum dress requirements as stated in Chapter 7 of EM 385-1-1. The contractor shall submit a safety hazard analysis for approval before commencing work.
1.7 EQUIPMENT
All equipment used to perform work under this contract shall be in good operating mechanical condition and shall comply with Chapter 7 of EM 385-1-1. Equipment shall be inspected by the contractor, and the inspection reports shall be submitted to the Contracting Officer prior to utilization of such equipment to accomplish work on this contract.
1.8 SUBMITTIALS
1.8.1 Work Plan. The Contractor’s work plan shall be submitted to the Contracting Officer or contracting officer’s representative (COR) for approval. The work plan shall provide detailed procedures defining the contractor’s provisions for utility and equipment installation activities.
1.8.2 A Safety plan for work procedures and safety and health protection shall be approved prior to beginning work. This plan shall include the procedures for equipment operation and public safety precautions.
1.9 PREWORK CONFERENCE
A pre-work conference will be held with the Contracting Officer or COR and contractor prior to the commencement of any work. The contractor’s responsible person and necessary administrative staff will be required to attend this meeting. Procedures for proper invoicing and payment, schedule, etc., will be covered at this time.
1.10 ENVIRONMENTAL CLEANUP
The contractor shall maintain a clean work area at all times. The contractor shall be responsible for the protection of the environment and will be required to restore all damages subject to the approval of the contracting officer. The contractor shall remove and dispose of all debris off Government property in a state approved disposal site unless specified otherwise. The contractor will be required to comply with all Federal and State environmental requirements. The contractor shall remove all excess materials and clean the entire area. The cleanup shall be completed in a timely manner.
1.11 COORDINATION OF WORK
The Contractor will be required to complete the work without impacting the day to day operations in the park. Critical utility connections or interruptions to park utilities shall be coordinated with the Lake Manager and completed within the recommended time frame.
PART 2 - PRODUCTS
2.1 MATERIALS
The Contractor shall furnish all materials and supplies required to complete this task including, but not limited to, the following:
2.1.1 Pre-cast concrete double vault toilet.
2.1.2 3/4 minus gravel aggregate for base pad construction and sand for bedding material around buried vault.
2.2 DELIVERY AND STORAGE
Materials shall be delivered to the site undamaged and stored out of contact with the ground.
Materials that are damaged during delivery or due to improper storage shall be replaced at no cost to the Government.
2.3 GOVERNMENT FURNISHED MATERIALS
Other than the single vault to be moved, the Government will not furnish any materials.
PART 3 - EXECUTION
3.1 ACCOMPLISHMENT OF WORK
3.1.1 Some sod removal, site grading and fill placement will be required. Fill will be placed to the same elevation as that of the top of the toilet location. Fill shall be sloped from this level to existing terrain. The bottom of the excavated area shall be compacted prior to placement of aggregate material. The aggregate base pad shall meet the soil analysis recommendation and shall consist of ¾ inch minus gravel material leveled and compacted in six inch lifts to support the building. The bearing weight of the soil and base shall meet a minimum of 1,500 pounds per square foot. Compaction test on both sites shall be performed by a certified company and results furnished to COR. Upon final compaction of the base area, a final 1 inch lift of sand materials shall be placed and leveled over the entire area to cushion the placement of the building. Site preparation shall follow the manufacturer’s suggested installation procedures and as outlined in these specifications.
3.1.2. Upon completion of the building set-up, building manufacture personnel will be required to make final building inspection to ensure the facility is operational. The prime contractor will be responsible for ensuring full satisfaction of the contract before payment will be made.
3.2 SAFETY AND HEALTH REQUIREMENTS
The contractor shall comply with the safety requirements in the Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1 in order to protect the health and safety of workers and the public. The following sections of the manual are particularly applicable to the work under these specifications. Section 5 – Personal Protective and Safety Equipment; Section 16 – Machinery and Mechanized Equipment; Section 25 – Excavations. A copy of this manual is available from the Contracting Officer. Workers shall be required to comply with the minimum clothing requirements for field work which includes short sleeve shirt, long pants, leather or protective work boots, and proper head, ear, hand, and eye protection as necessary. The work plan shall include procedures to follow in case of injury accidents. The Contractor shall review the safety requirements with all workers prior to any work under this Contract.

Within 90 days after date of award, all CLINS are to be completed/delivered.
The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

(b) Attention is directed to the Contract Award provision of the solicitation that provides that a written award or acceptance of offer mailed, or otherwise furnished to the successful offeror, results in a binding contract. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate
(weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or
"UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph
(d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. 252.204-7004 ALTERNATE A, SYSTEM FOR AWARD MANAGEMENT (FEB 2014)
(a) Definitions. As used in this provision—
“System for Award Management (SAM) database” means the primary Government repository for contractor information required for the conduct of business with the Government.
“Commercial and Government Entity (CAGE) code” means—
(1) A code assigned by the Defense Logistics Information Service (DLIS) to identify a commercial or Government entity; or
(2) A code assigned by a member of the North Atlantic Treaty Organization that DLIS records and maintains in the CAGE master file. This type of code is known as an “NCAGE code.”
“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.
“Data Universal Numbering System +4 (DUNS+4) number” means the DUNS number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR 32.11) for the same parent concern.
“Registered in the System for Award Management (SAM) database” means that—
(1) The contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, and Contractor and Government Entity (CAGE) code into the SAM database; and
(2) The contractor has completed the Core Data, Assertions, Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as part of the SAM registration process; and
(4) The Government has marked the record “Active.”
(b) (1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.
(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the offeror’s name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the SAM database.
(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.
(1) An offeror may obtain a DUNS number—
(i) Via the internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or
(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.
(2) The offeror should be prepared to provide the following information:
(i) Company legal business name.
(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.
(iii) Company physical street address, city, state and Zip Code.
(iv) Company mailing address, city, state and Zip Code (if separate from physical).
(v) Company telephone number.
(vi) Date the company was started.
(vii) Number of employees at your location.
(viii) Chief executive officer/key manager.
(ix) Line of business (industry).
(x) Company Headquarters name and address (reporting relationship within your entity).
(d) If the Offeror does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.
(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.
(f) Offerors may obtain information on registration at https://www.acquisition.gov.
