This solicitation is being advertise as a best value procurement. See FAR 52.212-2 Addendum; Evaluation— Commercial Items for specific information to be submitted with your quote.
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits a quotation in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of quotations. Submit quotations to the office specified in this solicitation at or before the exact time specified in this solicitation. Quotations may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation.
Quotations are due by the date and time listed in Block 8 of the SF 1449. Send your completed quotation package to the attention of Rachael Hammond at Rachael.m.hammond@usace.army.mil. Electronic quotations are preferred over paper responses, unless other arrangements have been made with the individual identified above.
As a minimum, quotations must show-(1) The solicitation number;
(2) The time specified in the solicitation for receipt of quotations;
(3) The name, address, and telephone number of the quoter;
(4) A technical description of the items being quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) “Remit to” address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3( b ) for those representations and certifications that the quoter shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the quotation is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Quotations that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Reserved.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of quotations. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender’s request and expense, unless they are destroyed during testing.
(e) Multiple quotations. Quoters are encouraged to submit multiple quotations presenting alternative terms and conditions or commercial items for satisfying the requirements of this solicitation. Each quotation submitted will be evaluated separately.
(f) Late submissions.
(1) Quoters are responsible for submitting quotations so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that quotations are due.
(2) Any quotation received at the Government office designated in the solicitation after the exact time specified for receipt of quotations is late and will not be considered unless it is received before purchase order issuance and the Contracting Officer determines that accepting the late quotation would not unduly delay the acquisition.
(3) If an emergency or unanticipated event interrupts normal Government processes so that quotations cannot be received at the Government office designated for receipt of quotations by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of quotations will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(g) Issuance of purchase order. Quotations should contain the quoter’s best technical and price terms. The Contracting Officer may reject any or all quotations. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quotation. After the evaluation of quotations, the Contracting Officer may negotiate final terms with one or more quoters of the Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR part 15.
(h) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quotation, unless the quoter qualifies the quotation by specific limitations. Unless otherwise provided in the Schedule, quotations may not be submitted for quantities less than those specified. The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quotation.
(i) Availability of requirements documents cited in the solicitation.
(1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to-

(j) Data Universal Numbering System (DUNS) Number. (Applies to all quotations exceeding $3,000, and quotations of $3,000 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM) database.) The quoter shall enter, in the block with its name and address on the cover page of its quotation, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the quoter’s name and address. The DUNS+4 is the DUNS number plus a 4-character suffix that may be assigned at the discretion of the quoter to establish additional SAM records for identifying alternative Electronic Funds Transfer (EFT) accounts (see FAR Subpart 32.11) for the same concern. If the quoter does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one. A quoter within the United States may contact Dun and Bradstreet by calling 1-866-705-5711 or via the internet at http://fedgov.dnb.com/webform. A quoter located outside the United States must contact the local Dun and Bradstreet office for a DUNS number. The quoter should indicate that it is a quoter for a Government contract when contacting the local Dun and Bradstreet office.
(k) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of a quotation, the quoter acknowledges the requirement that a prospective contractor shall be registered in the SAM database prior to purchase order issuance, during performance and through final payment of any contract resulting from this solicitation. If the quoter does not become registered in the SAM database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to issue the purchase order to the next otherwise successful registered quoter. Quoters may obtain information on registration and annual confirmation requirements via the SAM database accessed through https://www.acquisition.gov.
(l) Requests for information. The contracting officer will not notify unsuccessful quoters that responded to this solicitation. Quoters may request information on purchase order(s) resulting from this solicitation from the contracting officer.
(m) Insurance Required (FAR 52.228-5):
In accordance with FAR 28.307-2, “Liability,” the contractor shall procure the following minimum insurance:

And, when automobiles are used in connection with performing the contract:

And, when contract performance involves use of vessels, the Contracting Officer shall require, as determined by the agency, vessel collision liability and protection and indemnity insurance. The contractor is responsible for contacting the state for compliance with its workman’s compensation laws.
(n) State and Local Taxes:
The U.S. Army Corps of Engineers is exempt from paying state and local taxes per Title 4 United States Code 104-
107. The U.S. Army Corps of Engineers Tax ID Number is 62-1642142.
Contractors performing services for the U.S. Army Corps of Engineers are not exempt from state and local taxes in transactions with vendors, suppliers or subcontractors.
52.212-2 ADDENDUM-EVALUATION
EVALUATION--COMMERCIAL ITEMS
(a) The Government will award a contract resulting from this solicitation to the responsible quoter whose quote conforming to the solicitation will the best value to the Government. The quoter shall provide a separate document that contains the following information for each factor below. The following factors shall be used to evaluate quotes:
1. Technical – The quoter shall provide descriptive literature notating that the semi-tractor meets the minimum specifications and accessories stated in the specification. All other pertinent information that pertains to the semi-tractor shall also be provided.
A rating of exceptional will be given for a quote that exceeds two (2) or more of the minimum specifications and accessories. A rating of unsatisfactory will be given for a quote that does not meet any of the minimum specifications or accessories. A rating of satisfactory will be given for a quote that meets all of the minimum specifications and accessories.
2. Delivery – The government intends to have the semi-tractor delivered within 180 calendar days from award. The quoter shall provide a delivery date in the quote that indicates when the semi-tractor will be delivered.
A rating of exceptional will be given for a quote that reflects a shorter delivery date. A rating of unsatisfactory will be given for a quote that reflects a delivery date that exceeds 180 calendar days. A rating of satisfactory rating will be given for a quote that meets the delivery of 180 calendar days.
3. Warranty – The minimum product warranty from defects in material or structural defects and workmanship of manufacture is for a period of 12 months from date of delivery. The quoter shall provide a description of the warranty with their quote. A rating of exceptional will be given for a quote that reflects a longer warranty period.
A rating of unsatisfactory will be given for a quote that reflects a shorter warranty period. A satisfactory rating will be given for the minimum warranty period of 12 months.
4. Location – Each quoter shall have a service center 100 miles from the Garrison Project office. The quoter shall provide the location of the service center and state the distance in miles from the Garrison Project office.
A rating of exceptional will be given for a quote that reflects a closer service center location. A rating of unsatisfactory will be given for a quote that reflects a service location that is greater than 100 miles. A rating of satisfactory will be given for a quote that is 100 miles from the Garrison Project Office.
5. Parts Availability – The government expects each quoter to have an adequate supply of major and minor parts on hand or have the ability to obtain the necessary parts quickly. The quoter shall confirm that for this specific semi-tractor, all major or minor parts are on hand or can get the parts within three (3) days.
A rating of exceptional will be given for a quote that reflects that all parts are on hand or if needed can get them in less than three (3) days. A rating of unsatisfactory will be given for a quote that reflects that most parts are not on hand and/or would take longer than three (3) days to get. A rating of satisfactory will be given for a quote that reflects that most parts are on hand or can get them within three (3) days.
6. Past Performance – The quoter shall provide three references of similar semi-tractors delivered within the past five (5) years. Experience can be based on projects completed as a prime contractor or projects of qualified subcontractors that have the capabilities to perform this work. These references need to be equal to or similar in scope of this requirement. The contractor shall provide dates and pertinent information to demonstrate how they are comparable to this requirement in size and complexity. The contractor shall include points of contact, titles, telephone numbers, and email addresses (if available) for all references.
Additionally, past performance may be based on the contracting’s officer’s knowledge of and previous experience with similar purchases acquired and any information contained in the Governmentwide Past Performance Information Retrieval System (PPIRS), contained at www.ppirs.gov.
A rating of exceptional will be given for a quoter’s past performance that demonstrates successful completion of similar purchases on all references and the additional information retrieved from PPIRS and from the Contracting Officer is favorable. A rating of unsuccessful will be given for a quoter’s past performance that does not demonstrate any successfully completed similar purchases on the references and the additional information from PPIRS and the Contracting Officer is not favorable. A rating of satisfactory will be given for a quoter’s past performance that has at least one reference that demonstrates successful completion of similar purchases and the information from PPIRS and the Contracting Officer is favorable.
7. Price – The quote shall be inclusive of all costs to provide the semi-tractor and delivery to the Garrison Project Office.
After a preliminary consideration of all quotations, the government will identify from all quotations one that is the most suitable to the user and screen all lower priced quotations based on the readily discernible value factors (1-6) above.
SPECS
HEAVY HAUL SEMI-TRACTOR
SCOPE: It is intended by this specification to obtain one (1) new, current year production, heavy haul semi-tractor, complete, ready for work, and includes all standard equipment as shown in the manufacturer’s printed literature unless otherwise specified below. Contract supplier is responsible for shipping to the Garrison Project, Riverdale, ND.
PART 1 – GENERAL
1.1 Manufacturer Requirements:
Semi-tractor will be a standard manufacturer unit made by a reputable manufacturer.
1.2 Operations and Maintenance Manuals:
Semi-tractor will be furnished with one (1) complete set of operation and maintenance repair manuals.
1.3 Filter Replacements:
Semi-tractor will be furnished with one (1) complete set of filters for operation and maintenance to include all: fuel, hydraulic, air, cabin, etc.
1.4 Service
Supplier shall conduct the first service on the machine after the manufacture recommended break in period. Service shall include all recommended fluids and filter replacements along with a complete inspection of the machine. Any defects found during inspections shall be reported to a government representative and forwarded on to the manufacturer’s warranty department. Service shall be conducted by a qualified mechanic that has proper tools and training for the servicing and inspecting of the machine.
1.5 Warranty:
Minimum product warranty from defects in material or structural defects and workmanship of manufacture for a period of twelve (12) months from date of delivery of the product. A description of the warranty shall be included with the quote.
1.6 Submittals:
Product verification descriptive literature notating the specifications, accessories and all other data that pertains to the unit shall be submitted with the quote. Manufacturer’s standard product warranty must be submitted with the quote.
1.7 Trade In Credit:
The Garrison Project shall furnish one (1) 1996 Ford AT9513, VIN # 1FTYY96D6VVA17440, with approximately 592,000 miles to date as a trade-in unit to be exchanged at the time of the delivery of the new operating unit. The credit for the trade in shall be expressed in a dollar amount that will be stated on the bid sheet, and the credit must be deducted from the overall purchase price of the new replacement semi-tractor. The Garrison Project has documented work orders of when most maintenance was performed on the unit while owned by the Garrison Project. This documentation can be turned in with the semi-tractor if requested. The supplier of the new replacement unit is responsible for the transport of this unit from the Garrison Project Maintenance Facility near Riverdale, ND to the supplier’s point of origin. This machine is available for viewing at the Garrison Project Maintenance Facility near Riverdale, ND. Please contact Brandon Sailer or Sallie Pochant (contact information below) to notify the government if a viewing visit is requested. Photos of the Ford can be seen in appendix A.
1.8 Delivery:
The semi-tractor and equipment shall be delivered to the Garrison Project Maintenance Facility no later than 180 days after the notice of award is given.
PART 2 - DESIRED NOMINAL PRODUCT FEATURES FOR NEW UNIT
2. 1 General Information:
The semi-tractor must be new, unused, and of current production year heavy haul model. It shall have all standard equipment as shown in the manufacturer’s printed literature. The semi-tractor will be primarily used for transporting heavy construction equipment both on and off highway to job sites typically within 5 to 200 miles.
Some off highway areas contain challenging terrain that require sufficient ground clearance for wheel rutting and other rough road conditions typical of heavy haul/vocational semi-tractors. Typical loads will include a lowboy and heavy machinery; See Appendix B for a list of equipment and more information on the lowboy.
2.2 Basic Criteria:
2.2.1 Frame/Chassis
The frame shall have a minimum RBM of 3,500,000 in. – lbs. The semi-tractor shall be equipped with a tilting hood and fender assembly. The semi-tractor shall have a minimum gross combined weight rating of 105,000 lbs. The semi-tractor shall have an extended tapered frame. The semi-tractor shall have a gross vehicle weight rating of a minimum of 60,000 lbs.
2.2.2 Exhaust
The semi-tractor exhaust system shall be a vertical exhaust system with turnout and guard. The DEF fluid tank, if equipped, shall be full upon delivery.
2.2.3 Fuel System
The fuel system shall have a heated fuel/water separator. The fuel tank shall be a minimum of 50 gallons.
2.2.4 Suspension
The semi-tractor shall have a rear air spring suspension system.
2.2.5 Tires and wheels
The semi-tractor shall have hub piloted wheels with 22.5 inch diameter steel disc. The semi-tractor tires shall fall within the categories of all terrain or for on/off highway use designed for rough road conditions where gaining traction may be difficult such as muddy or snowy surfaces. The semi-tractor shall have all axles equipped with such tires.
2.2.6 Brakes
The semi-tractor shall be equipped with compressor air brakes with a minimum of 15.9 CFM. The air storage tanks for air brakes shall be equipped with an automatic moisture purge on wet tank. The air brake dryer shall be an automatic moisture purge heated, cartridge element type. The semi-tractor shall be equipped with dust shields on rear axle drum brake assemblies. The semi-tractor shall be outfitted with an auxiliary engine compression brake.
2.3 Drivetrain requirements
2.3.1 Engine Minimums
The semi-tractor shall have a diesel engine with an inline 6 cylinder configuration and a minimum displacement of 12 liters. The engine shall have a minimum of 500 HP along with at least 1850 ft-lb torque. The engine shall be equipped with extended coolant life protection to -34 degrees Fahrenheit. The engine must meet current US emission standards for ultra-low sulfur diesel. The engine shall be Bio Diesel (B20) compatible.
2.3.2 Engine Accessories
The engine shall be equipped with an engine air cleaner service indicator. The engine shall have an alarm system for low oil pressure and for low or high coolant temperature shut down. The engine shall be equipped with an engine block heater with a minimum of 1000 watt and 120 volt coolant heater. The engine shall be equipped with an engine hour meter.
2.3.4 Transmission
The transmission shall be an Automated Manual Transmission with a minimum of 12 forward gears and 3 reverse gears.
2.3.5 Axles
The semi-tractor shall be equipped with an 18,000 pound minimum front axle rating. The semi-tractor shall have a 46,000 pound rear axle gross axle weight rating. The semi-tractor shall be equipped with a driver controlled axle differential lock-out and inter-axle differential lock-out. The drive axles shall be equipped with automatic traction control. The front and rear axle assemblies shall be filled with synthetic lubricant.
2.4 Tractor Fifth Wheel
2.4.1 Fifth Wheel
The semi-tractor fifth wheel shall be rated for a 7000 pound vertical load cap, a 150,000 pound pull cap, and a minimum of a 23 inch slide length.
2.4.2 Fifth Wheel Location
The semi-tractor fifth wheel shall be located with a minimum clearance from center of king pin to clear back of cab of 64 inches.
2.4.3 Fifth Wheel Height
The semi-tractor fifth wheel shall have 49 inches of clearance between level ground and top of plate (within a tolerance of plus or minus 3 inches).
2.4.4 Fifth Wheel Air Slide
The semi-tractor shall be equipped with an air slide fifth wheel.
2.5 Interior Features
2.5.1 Interior General
The semi-tractor shall have a cab air ride suspension system. The semi-tractor shall have a tilt and telescoping steering wheel. The semi-tractor shall be equipped with an air conditioned cab. The semi-tractor shall be equipped with power steering.
2.5.2 Radio
The semi-tractor shall be equipped with an AM/FM radio with a compact disc player.
2.5.3 Seats
The semi-tractor shall be equipped with driver and passenger bucket seats with an air suspension system, adjustable height and lumbar positioning, and adjustable forwards and backwards positioning. The semi-tractor shall have a minimum seating capacity of the driver and one passenger.
2.6 Accessories
2.6.1 Electrical
The semi-tractor shall be equipped air horns. The semi-tractor shall be equipped with an alternator with a minimum of 160 amps and 12 volts.
2.6.2 Exterior
The semi-tractor shall have heated and remote controlled exterior side rearview mirrors. The semi-tractor shall have hood-mounted blind spot mirrors. The semi-tractor shall be equipped with rear fenders covering all rear axles.
2.6.3 Doors and Windows
The semi-tractor shall be equipped with intermittent windshield wipers. The semi-tractor shall have power windows and power door locks.
2.6.4 Lights and Lighting
The semi-tractor shall have daytime running lights. The semi-tractor shall have all light emitting diode lights (LEDs) with the exception of the turn signals and headlamps. The semi-tractor shall have an amber LED warning light bar. The light bar shall be a minimum of 45 inches and visible from all directions. The semi-tractor shall be equipped with fog lights.
2.6.5 Auxiliary Axles
The semi-tractor shall have a 20,000 pound air lift, non-steering, auxiliary pusher axle (tag axle).
2.6.6 Towing
The semi-tractor shall be equipped with a PTO powered 3 line hydraulic supply wet kit for a side dump trailer. The semi-tractor shall be equipped with front tow hooks/loops/eyes mounted to the frame.
2.6.7 Miscellaneous
The semi-tractor shall have a closet type, fully enclosed, cab guard/headache rack cabinet for storing tools, chains, and straps mounted behind the cab of the semi-tractor. The semi-tractor shall be equipped with remote jump start posts.
2.7 Safety
The semi-tractor shall be equipped with a back-up alarm. The semi-tractor shall be equipped with a safety kit including a fire extinguisher. The semi-tractor shall have power anti-locking brakes in both the front and the rear.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (JUL 2016)

The offeror shall complete only paragraphs (b) of this provision if the Offeror has completed the annual representations and certification electronically via the System for Award Management (SAM) Web site located at https://www.sam.gov/portal . If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (r) of this provision.
(a) Definitions. As used in this provision--
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C.
395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United States; and
(ii) Each individual claiming economic disadvantage has a net worth not exceeding $750,000 after taking into account the applicable exclusions set forth at 13 CFR 124.104(c)(2); and
(2) The management and daily business operations of which are controlled (as defined at 13.CFR 124.106) by individuals, who meet the criteria in paragraphs (1)(i) and (ii) of this definition.
“Subsidiary” means an entity in which more than 50 percent of the entity is owned—
(1) Directly by a parent corporation; or
(2) Through another subsidiary of a parent corporation.
“Veteran-owned small business concern” means a small business concern—
(1) Not less than 51 percent of which is owned by one or more veterans(as defined at 38 U.S.C. 101(2)) or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more veterans; and
(2) The management and daily business operations of which are controlled by one or more veterans.
“Women-owned business concern” means a concern which is at least 51 percent owned by one or more women; or in the case of any publicly owned business, at least 51 percent of the its stock is owned by one or more women; and whose management and daily business operations are controlled by one or more women.
“Women-owned small business concern” means a small business concern --
(1) That is at least 51 percent owned by one or more women or, in the case of any publicly owned business, at least 51 percent of the stock of which is owned by one or more women; and
(2) Whose management and daily business operations are controlled by one or more women.
“Women-owned small business (WOSB) concern eligible under the WOSB Program (in accordance with 13 CFR part 127),” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States.
