52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
1. EQUIPMENT & STAFFING PLAN:
(a) Submission Requirements: This information consists of the offeror’s intended management approach to executing the contract. It shall include a proposed equipment listing and a staffing plan to perform the work in accordance with the provisions of the contract. The proposed equipment list should only include the equipment which will be used on this contract.
Include age, size, make and model of equipment. List all safety equipment both installed on machines as well as for personnel. If listing equipment to be purchased upon award, a financial responsibility assessment will be made to ensure offeror has the ability to obtain said equipment. The plan must include system for notification and correction of equipment deficiencies, as well as maintenance schedules and location of repair work. It shall also include a staffing plan that will be used to accomplish the work required within the performance work statement. The proposed staffing plan shall include both numbers of personnel proposed and position titles. Resumes for proposed key personnel, consisting of experience and other pertinent information, inclusive of owners, superintendents, quality control inspectors and foremen must also be submitted. If offeror will be relying on a sub-contractor’s experience, a listing of proposed sub-contractors and their experience on recent and relevant jobs must be provided as well as a proposed staffing plan and resumes of any key personnel proposed by the sub-contractor. The contractor must have sufficient equipment and personnel to complete an entire round of mowing within 7 working days, complete daily park cleanup & solid waste removal services, and complete gate attendant services as specified in the provisions of the performance work statement. All of these services are to be performed simultaneously.
(b) Evaluation Criteria: The Government will check Offeror’s equipment and management plan for completeness and reasonableness. A complete and reasonable equipment and management plan will receive a Go rating. Government will evaluate the clarity and strength of the overall organization and how well it is organized and structured to execute the entire scope of work. The Government will evaluate the capability of the firm to execute the project. The Government will evaluate the Contractor’s resources to determine if it has the capability to self-perform the required amount of the project, in accordance with public policy to assure adequate interest in and supervision of all work.
2. EXPERIENCE:
(a) Submission Requirements: The offeror shall demonstrate recent, relevant experience on similar projects. If the offeror is a joint venture, each firm shall demonstrate experience. Submit detailed examples of relevant work that is currently well underway or performed within the past three years. Relevant experience is work previously performed that is similar to the duties required by the Performance Work Statement (PWS).
(b) Evaluation Criteria: The Government will evaluate how well the Offeror demonstrated their recent (within three years of the issue date of the RFQ), relevant experience with similar projects. If the Offeror is a joint venture, each entity must demonstrate qualifying experience comparable to its role on the project. The Government reserves the right to verify the experience record of cited projects or other recent projects or to interview owners or references.
The Government reserves the right to check any or all cited references to verify supplied information. A rating of No Go will be given to an Offeror who cannot demonstrate a history of recent, relevant experience. The Government will consider extent of recent experience, degree of relevance of such experience to this project, demonstrated familiarity with similar sites and local conditions. Some examples of relevancy to this project may include, but not be limited to: (1) Number, size, type work, location; (2) Dates (completion within last 3 years); and
(3) Firm's role and extent of work self-performed (subcontracting out all work is an examples of less relevant experience).
3. PAST PERFORMANCE FACTOR:
(a) Submission Requirements: Past performance refers to the quality of recent project experience from the customer’s perspective. The Offeror shall arrange for the reference customer point of contact for two projects to fill out the Questionnaire (Attachment 1) and return directly to the Contract Specialist, via fax or e-mail. The questionnaires must be forwarded directly by the references. The Government will not release the questionnaire forms to the Offeror at any time, in order for the Government to solicit candid, unbiased responses and comments. Two References from previously completed jobs must be submitted and include a point of contact and phone numbers. These references must be relevant to the work which will be performed in this contract. References must be recent within the past 3 years.
(b) Evaluation Criteria: The Government will assess the degree of success of Offeror’s recent, relevant past performance. Owners/references will be asked to comment on items such as quality of mowing services, timeliness, management of subcontractor work, including timely payment to subs or suppliers, safety, relations between customer and contractor, level of support for such things as correcting errors. The Government will target areas covered in the requirements of the Performance Work Statement including records conforming to quality, schedule, customer satisfaction, and problem resolution for errors and safety. The Government will give a Go rating to documented successful outcomes that are supported by outside source confirmation (e.g. but not limited to telephone interviews with points of contact identified in the proposal, agency performance databases, offeror furnished references, or personal knowledge).
Successful outcomes are defined as having received a rating of satisfactory or better, or the equivalent. If the Government does not obtain past performance information for the projects identified by the offeror and cannot establish a past performance record for the offeror through other sources, or if the offeror has no past performance record and cannot tie significant, relevant experience of key personnel proposed for this project to cited experience, past performance will be rated neither favorably nor unfavorably.
4. PRICE:
Price will be evaluated by utilization of price analysis. This analysis will include the cost of the base and all option years. Submit the SF 1442, completed and signed by a person authorized by the Offeror. Offerors shall complete the Bid Schedule by filling out the pricing data blanks in the solicitation. This submission item is not rated.
Award will be made to the offer that represents the lowest priced quote of those determined to be technically acceptable after evaluation. The decision will involve an analysis of factors 1-3, providing a go/ no go determination for each.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

RATING DEFINITION NOTE
(E) Exceptional Performance meets contractual requirements and exceeds many to the Government/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with few minor problems for which corrective actions taken by the contractor was highly effective.
An Exceptional rating is appropriate when the Contractor successfully performed multiple significant events that were of benefit to the Government/Owner. A singular benefit, however, could be of such magnitude that it alone constitutes an Exceptional rating.
Also, there should have been NO significant weaknesses identified.
(VG) Very Good Performance meets contractual requirements and exceeds some to the Government’s/Owner’s benefit. The contractual performance of the element or sub-element being assessed was accomplished with some minor problems for which corrective actions taken by the contractor were effective.
A Very Good rating is appropriate when the Contractor successfully performed a significant event that was a benefit to the Government/Owner. There should have been no significant weaknesses identified.
(S) Satisfactory Performance meets minimum contractual requirements. The contractual performance of the element or sub-element contains some minor problems for which corrective actions taken by the contractor appear or were satisfactory.
A Satisfactory rating is appropriate when there were only minor problems, or major problems that the contractor recovered from without impact to the contract.
There should have been NO significant weaknesses identified. Per DOD policy, a fundamental principle of assigning ratings is that contractors will not be assessed a rating lower than Satisfactory solely for not performing beyond the requirements of the contract.
(M) Marginal Performance does not meet some contractual requirements. The contractual performance of the element or sub-element being assessed reflects a serious problem for which the contractor has not yet identified corrective actions. The contractor's proposed actions appear only marginally effective or were not fully implemented.
A Marginal is appropriate when a significant event occurred that the contractor had trouble overcoming which impacted the Government/Owner.
(U) Unsatisfactory Performance does not meet most contractual requirements and recovery is not likely in a timely manner. The contractual performance of the element or sub-element contains serious problem(s) for which the contractor's corrective actions appear or were ineffective.
An Unsatisfactory rating is appropriate when multiple significant events occurred that the contractor had trouble overcoming and which impacted the Government/Owner. A singular problem, however, could be of such serious magnitude that it alone constitutes an unsatisfactory rating.
(N) Not Applicable No information or did not apply to your contract Rating will be neither positive nor negative.
