JOHN DAY LOCK AND DAM

STS CRANE REPAIR

JUSTIFICATION TO SOLE SOURCE

PURSUANT TO FAR 13.501

1. CONTRACTING AGENCY: Portland District, U.S. Army Corps of Engineers, Contracting Division, 333 SW First Avenue, OR 97204-3495.

2. DESCRIPTION OF ACTION: Approval is being requested for the award of a firm fixed price commercial supply and services contract to Knight Construction & Supply for the replacement of control system parts to repair the John Day Dam Submerged Traveling Screen (STS) crane. This is a commercial acquisition conducted pursuant to FAR Subpart 13.5, Simplified Procedures for Certain Commercial Items.

3. DESCRIPTION OF SUPPLIES/SERVICES OR NATURE OF CONSTRUCTION:

The John Day Dam STS Crane requires repairs to the drive control system. The replacement of the main drive, associated control systems, and all necessary parts are to be acquired in order to properly repair the crane. The contractor will also be required to install the parts in order to repair the crane. The total estimated value of the supplies and services is $198,915.00.

4. AUTHORITY CITED: IAW FAR 13.501(a)(2)(i), Unusual and compelling urgency.

For a proposed contract exceeding $150,000, but not exceeding $700,000, the contracting officer’s certification that the justification is accurate and complete to the best of the contracting officer’s knowledge and belief will serve as approval, unless a higher approval level is established in accordance with agency procedures.

5. REASON FOR AUTHORITY CITED: The John Day Dam STS Crane was tagged out of service on 13 October 2016 due to a failure of the existing DC Drive to operate properly. The DC Drive, which require immediate repair, controls the motor of the crane and the brakes, and therefore the John Day Dam STS Crane cannot be operated safely until repairs are made to the crane. Loss of the use of the crane has a major impact on both routine Operations & Maintenance and Large Capital work.

With the crane out of service, the Operating Project is prevented from being able to remove STS fish screens from the main unit turbine-generator slots for annual or spot maintenance repair. When a screen is torn or damaged, which is a frequent occurrence, the main unit must be shut down until it is repaired or replaced pursuant to the Fish Operations Plan. Therefore, having the STS Crane out of service causes a significant loss of power generation due to the inability to pull fish screens, which are required to be in place for the generators to operate. The loss of power generation greatly affects the Bonneville Power Administration (BPA), because the power generation is a source of revenue for BPA.

Additionally, loss of the STS Crane has a major impact on upcoming Capital work, including the Main Unit 5 Kaplan Repairs, scheduled to be undertaken by Andritz Hydro beginning on 14 Nov 2016. Until the STS Crane can be repaired, the contractor will be unable to begin work and work will be delayed.

A summary of known direct impacts to routine and non-routine O&M and Capital work due to the STS Crane’s out of service condition are as follows (All of the below actions should currently be taking place, but cannot due to the ineffective crane):

Currently Prevented Routine work:

Main Generating Unit 13, five year maintenance and the Main Generating Unit 2, annual maintenance. Both the annual and five year maintenance provide required inspections to look and fix any problems before they turn into major problems.

Currently Prevented Non-Routine work:

Main Generating Unit 8 and the Main Generating Unit 10: Return of unit back to service. Currently the STS Crane is unable to move the fish screens. These screens rotate and help direct juvenile fish safely around the generator so they don’t get killed. Being unable to move the fish screens has caused a loss of power generation.

Currently Delayed or Impacted Large-Capital Repair/Upgrade Contracts:

Main Generating Unit 5, Kaplan Runner Repairs: This is a current ongoing project to fix rudders at the John Day Dam. With the STS Crane being inoperable this project has been suspended until the crane is fixed.

Main Generating Unit 2, oil change out, delivery, pickup: with the STS Crane being inoperable the generators are not working properly to remove oil; the project has been suspended until the crane is fixed.

6. EFFORTS TO OBTAIN COMPETITION: Due to the urgent and compelling nature of this procurement, the manufacturer of the DC Drive, Magnetek, was contacted. They recommended a company that could supply the needed parts and services. USACE, Portland District, contacted the firm recommended as well as a local crane company for quotes. Therefore, USACE, Portland District, received a total of two quotes for this procurement. All offers received will be considered, with award being made to the responsible offeror with the lowest quote.

7. ACTIONS TO INCREASE COMPETITION: Due to this being urgent and compelling nature of this action no further action.

8. MARKET RESEARCH: Searched PD2 and U.S. Corps of Engineers Fort Worth website of IDIQs (https://swdweb.swf.usace.army.mil/contracting/currentIDIQContracts.cfm) for potential IDIQs that we could borrow capacitance from; unfortunately found no such IDIQs. In addition, market research was conducted through UNICOR and the Ability One sites for potential procurement providers and none were found. All required sources of supply were considered but none are capable of providing the part and needed services.

9. INTERESTED SOURCES: There are no other interested sources known.

10. OTHER FACTS: There is no procurement history for this type of procurement.

11. TECHNICAL CERTIFICATION: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
