SCOPE OF WORK
Statement of Work (SOW) for Forest Resources Inventory and
Report
Walter F. George Lake
1.0 General
1.1 Purpose. This project is an inventory of forest resources encompassing approximately 4860 acres of forested public land managed by the United States Army Corps of Engineers (USACE) at Walter F. George Lake. The project is located near Eufaula, Alabama, along the Chattahoochee River. The inventory is needed to better manage the forested ecosystems at ACF Rivers Project. It will be used by foresters and other natural resource managers to make informed management decisions based on solid inventory data and to study the effects of those decisions on sustainability, forest regeneration, and biodiversity. The majority of the forested area is composed of upland mixed pine hardwood with loblolly, shortleaf and longleaf being the dominant species and yellow-poplar, sweet gum and various oak species as co-dominant. The basic objectives of this project are to obtain an inventory of current volume of merchantable timber within identified management units, and to provide a description of these forest units that includes overstory and understory species, site conditions, species distribution, and percent ground cover. This is to be accomplished by installing a total of 972 sample plots/points and associated sub-plots within the 4860 acre area identified for timber management.
2.0. Technical Requirements.
2.1. Overall Management of Work. The Contractor shall furnish all labor, materials, equipment, transportation, supplies, and supervision needed to perform required field sampling and computations, and to prepare tables, charts, and reports as described herein.
Work shall be performed in accordance with all applicable Federal, State, and local laws and regulations.
2.2. Staffing. The Contractor must maintain an adequate work force at all times to ensure timely completion of the work and is responsible for the crew(s) understanding and correctly performing the requirements of the contract. Persons designated by the Contractor as Supervisors must actually perform in that capacity by effectively directing the crew, making periodic inspections of the crew’s work, identifying any deficient work, and ensuring that deficiencies are corrected. The designated supervisor shall be capable of speaking, reading, and writing English well enough to ensure effective communication with the USACE Quality Assurance (QA) inspector. Workers without a supervisor will not be considered a crew. The Contractor shall submit in writing to the Contracting Officer’s Representative (COR) supervisory designation, listing of crew personnel, and a work schedule at least 48 hours prior to beginning work or making any significant changes.
2.3. Personnel Qualifications. The contractor shall submit at the pre-work c nference the following items:

2.3. Natural Resources Management. The Contractor shall be knowledgeable of general natural resources management philosophies and techniques. These topics include fish and wildlife, vegetation, natural areas, wetlands and floodplains, biodiversity and ecosystem management, forestry, improved grounds maintenance, pest management, invasive species management, range management, soil conservation, and outdoor recreation. Knowledge of current regional and national initiatives with regard to the management of Federal lands, including those related to "ecosystem management", is also required.
2.4. Policy and Compliance. The Contractor shall be knowledgeable of Federal, state and local environmental laws and regulations applying to natural resources management.
Applicable Federal laws and regulations are cited in Appendix A of USACE Regulation ER 1130-2-540. In addition, the contractor shall comply with the USACE Safety Manual EM 385- 1-1.
2.5. Centralized Files. The Contractor shall maintain a centralized file containing detailed records of the information used to conduct the forest inventory. A separate records file will be maintained for the USACE ACF Rivers Project. Each file will contain all documents, data, analytical tools, sampling methodologies, and reference material used by the Contractor. The Contractor shall not disclose any contract deliverables to the public without prior approval from the Contracting Officer's Representative (COR) and the USACE ACF Rivers Project to ensure that disclosure, when appropriate, is made in accordance with the provisions of the Freedom of Information Act (FOIA), if invoked by the requestor. All such records and files shall be deemed the property of the Government. Each records file will be provided to the USACE ACF Rivers Project at the completion of work as a portion of the Administrative Record for the contract.
2.6. Field Trips. The Contractor shall use field trips to obtain forest inventory data. No plot data may be derived from imagery or previous inventories.
Reporting Requirements. The Final Forest Inventory Report shall be typed with the margins set for reproduction on both sides of the paper. The size of the pages shall be 8.5 inches by 11 inches, except for foldout maps, charts, or other illustrative material. Each line of each page of the Draft documents shall be numbered to facilitate review. Type size and the font used must be approved by the Government prior to printing. An Executive Summary with technical appendices will be included as necessary. A minimum of two professionally bound copies of the report will be provided by the contractor. A digital copy will be provided as well. All field tally sheets, maps and notes will be provided to the ACF Rivers Project. Forest Inventory Report Tables listing merchantable volume inventory and other associated stand data in Microsoft Excel format will be provided. Any GIS point, line, or polygon data generated by the contractor in accomplishing the inventory shall also be submitted at the close of the contract.
2.9. Pre-Work Conference. Prior to commencement of work the contractor shall attend a pre-work conference. The date and time will be arranged by the COR, at which time the lines of authority and Government procedures for contractual, administrative, and work matters will be established. A review of critical aspects of the contract will be conducted, and specific, technical issues as well as special contract clauses will be discussed.
2.7. WORK REQUIREMENTS.
2.8. Introduction. The Contractor shall provide sufficient personnel to assure that the forestry inventory is given equal priority in all efforts, with no action being deferred because of competing actions on other projects. Services provided by the Contractor shall be performed in accordance with specific requirements listed below.
2.9. Conduct Project Forest Inventory.
3.2.1. General. The intent of this effort is to obtain an inventory of approximately 4860 forested acres. The installation of the 972 sample plots/points and subplots will result in approximately a 2% inventory of the designated acreage. This information will be used by project personnel to plan and implement present and future forest management activities.
3.2.2. Transportation and Equipment. The Contractor shall provide all necessary transportation equipment and specialized limited use equipment. The Contractor shall provide all equipment needed to accomplish the inventory.
3.2.3. Safety. The Contractor shall insure that all inventory participants comply with applicable worker safety and health requirements listed in EM 385-1-1. These specifications require work in various outdoor conditions and environments which may present hazards such as excessive heat or cold, lightning, biting/stinging insects, poisonous snakes, etc. The contractor shall ensure that all personnel working on the project take all reasonable precautions to protect themselves from these risks.
3.2.4. Oversight. The Contractor shall provide project oversight and review the work to insure the resulting data, reports, and other products comply with contract requirements.
3.2.5. Specifications. The forest inventory of USACE managed land will be conducted in timber stands by fixed/variable plot sampling in accordance with standard forest inventory methods and merchantability standards applicable to the region and the specifications herein.
The Contractor will be provided area maps as a basis for initial planning. The Contractor shall delineate manageable areas into individual forested stands.
Computing Number of Sample Points Per Unit. The number of plots to be placed in each management unit will be based on the unit's size in proportion to the whole of the forested acres selected for inventory. The total number of plots for each unit will be provided to the contractor by ACF Rivers Project personnel.
• Location of Sample Points. The Contractor is required to apply standard forestry practices to establish random sample points in a fashion that ensures the validity of the field data. Sample points shall be established at a spacing not less than 1.5 chains apart, nor within one chain from the edge of a stand or from other significant stand breaks (i.e. roads, trails, power line rights of way, etc.). ACF Rivers Project personnel must approve the plot layout in each stand prior to the contractor performing the inventory for that stand.
• Identification of Sample Points. At each plot the contractor will record the latitude and longitude coordinates on the tally sheet, using a format that lists degrees, minutes, and seconds.
Should the contractor use an electronic data logger, all pertinent stand and plot information shall be available on a printable plot record sheet and shall be made available upon request for quality checks. The plot number will be written with indelible ink on a pin flag or flagging tape placed at plot center at ground-level and again at eye-level on the nearest tree, shrub, or live branch. The flag placed at ground level will be placed in the staff hole, anchored with a stick or small rock, and marked with stand identification number and plot number. The approximate location will be annotated on the field map.
• Sampling Procedure. The fixed radius plot sampling or variable radius plot sampling method shall be used to record plot data. Fixed radius plots shall be a 1/10th acre plot (radius of
37.2 feet). Should the Contractor use variable radius plots, then a 10 BAF prism shall be used.
For each "in" tree with a Diameter Breast Height (DBH) of 5-inches and over, record species, DBH, merchantable height, and any other attribute as needed to compute merchantable volume. Minimum acceptable measurements should include species, DBH, and merchantable height. At each sample plot, a sub plot of 1/50th acre (radius of 16.7 feet) shall be used to measure regeneration and ground cover.
3.3 Volume Analysis. Volumes will be calculated by product class as pulpwood or sawtimber and will be further divided into pine and hardwood components. Height and diameter limits for each pine and hardwood product class will conform to current local standards for product class determination. Merchantable volume for each species shall be determined using locally derived and acceptable volume tables. Copies of volume tables used in this inventory will be included in the final report. Volumes will be summarized for each unit by product class for pine and hardwood and totaled for the entire installation by product class for pine and hardwood. Results are to be expressed in tons.
3.4 Additional Stand Data. In addition to the merchantable volume estimates, a characterization of mid story regeneration, percent woody and herbaceous ground cover, average total height, average DBH, basal area, diameter distribution curves and species distribution curves will be produced for each unit. Further information about these data requirements follows.
3.4.1. Average Total Height and Average DBH. As part of the merchantable volume estimation, total height (measured in l0-foot classes) and DBH (measured in 2-inch DBH classes) will be recorded for each measurable tree on field tally sheets for each sample plot.
Based upon this data, an average total height and DBH will be provided for each individual stand for both the pine and hardwood components.
• Basal Area. Basal area (BA) will be collected using 1/10th acre plots or 10 BAF prism points. An overall average basal area will be determined for each individual unit; all "in" trees, regardless of merchantability or size class that have a measureable DBH should be counted to ensure total BA is accurate. Additionally, the average BA also will be summarized and reported for pine and hardwood species in each stand. Three measurements of BA will be provided for each stand: overall average BA, average pine BA, and average hardwood BA.
• Snag Count. The number of dead and dying snags per acre will be recorded within each plot. To be recorded, a snag must be at least five inches DBH and 15 feet in height. Summarize sample data per stand to compute the average number of snags per acre and the average DBH for snags.
• Under-story/Regeneration Characterization. A subplot shall be used to record regeneration data utilizing a 1/50th acre plot (radius of 16.7 feet) at the same plot center as the 1/10th acre plot. All tree species, regardless of future merchantability, between 1" and 5" will be counted. Measurements will consist of recording total height to the nearest foot for each individual stem and counting all stems by species at each plot. This data will be recorded on field tally sheets and summarized in the final report as an average for each species class.
• Percent Ground Cover. A subplot shall be used to record herbaceous ground cover data utilizing a 1/50th acre plot (radius of 16.7 feet) at the same plot center as the 1/10th acre plot.
An estimation of the ground surface covered by forbs, grasses, and/or legumes expressed as a percentage of the total area in the plot. In addition, an estimation of ground surface within the 1/50th acre plot covered by woody species (< 1 inch DBH or no DBH), will be recorded as a percentage of the total area in the plot. This data will be recorded on field tally sheets and summarized in the final report as an average for each unit.
• Growth. Growth will be determined by removing increment cores from a minimum of two dominant or co-dominant trees for each unit less than 200 acres. For units in excess of 200 acres 1 dominant or co-dominant tree per 100 acres will be selected for measurement. Growth will be determined by measuring the width (expressed in 20th of inches (e.g. 10 = 10/20th of an inch growth) of the last 5 growth rings (radial growth during last 5 years), measured at DBH, and measuring bark thickness. The location of cored trees within a plot will be noted on field tally sheets to allow for re-identification in the field. Growth will be expressed as a percentage of current annual growth using formulas from the U.S. Department of Agriculture (USDA) Service Foresters Handbook. Species selected for determination of growth will be those species determined by the Contractor to be the best management indicator species for each individual stand (i.e. the preferred species for management on the site). Growth data, including measurements of radial growth, percent gross growth, and percent annual growth, will be included in the final report.
3.4.7. Stand Age and Site Index. For each unit, age and site index (50 year) will be determined by removal of a core and calculation of total height from a minimum of two dominant or co-dominant trees for each unit less than 200 acres. For stands in excess of 200 acres 1 dominant or co-dominant tree per 100 acres will selected for measurement. Species selected for determination of site index will be the species determined by the Contractor to be the best management indicator species for each individual unit (i.e. the preferred species for management on the site). Trees selected for site index determination shall be chosen by random methods, but must have either a dominant or co-dominant position in the stand.
• Plot Records. Plot data will be recorded in such a way as to make available to QA inspectors a complete tally record for each plot.
• Unique features. Any threatened or endangered species or unique features such as gopher tortoise burrows, eagle nests, rock outcrops, old home sites, etc., should be noted and location recorded on data sheet.
3.5. Special Conditions.
3.4.2. Contract personnel shall comply with the applicable OSHA regulations and with ACF Rivers Project physical security guidelines. Keys issued to the contractor to facilitate the work shall be accounted for and returned when the contract is complete.
3.4.3. Digitized mapping through the Geographic Information System (GIS) and PhotoImagery, will be made available by the Government.
3.4.4. Contractor shall provide an estimate of the volume of pulpwood (5.0-11.9 inches DBH) and volume of saw timber (12 inches and up in DBH) on each unit, for each of the major species. Veneer volume (12 inches DBH and up) shall be estimated for the species groups of pine and hardwood.
3.4.5. Plots that fall within non-forested areas, shall identify the plant species found growing there.
3.6. Quality Assurance.
The Contractor's performance will be monitored by the USACE ACF Rivers Project forester.
QA results will be determined by comparing the contractor's field data with data obtained by USACE personnel from field investigation. A minimum of 1 plot per unit will be checked, with a total comparison rate of 5-10% of the plots. If USACE personnel determine a series of continuous errors or discrepancies are occurring that could affect the validity of the stand data, the Contractor will be required to resample all plots located within the stand that contains the unacceptable plot(s). A copy of each stand inspection will be forwarded to the Contractor, and a second inspection will be made upon completion of the Contractor's re-sampling of unacceptable areas. The following acceptable ranges of error will be used as a measure of contractor performance:
3.6.1. Individual Tree Data.
Determination of whether a merchantable tree is recordable ("in") based upon the plot radius limits (critical distance) for a 1/10th acre plot or 10 BAF prism -- No Error Allowed.
Species. No Error Allowed.
Total Height. Height will be recorded in 10-foot classes. Value must be within ± 10 feet of Government measurement. Error greater than this (a difference of more than 1 height class) is unacceptable.
DBH. DBH will be recorded in 2-inch classes. Value must be within ± 1 inch of
Government measurement. Error greater than this (a difference of more than 1 diameter class) is unacceptable.
Snag Count. No Error Allowed.
3.6.2. Plot Data.
Basal Area. Value must be within 10 square feet of Government measurement. Error greater than this is unacceptable.
Plot Identification. Plots must be clearly marked as indicated above to allow for revisits.
No error allowed.
3.6.3. Draft and Final Reports. The Contractor shall prepare (using the documentation described above) a comprehensive Forest Inventory Report (FIR) by unit. 52.212-1 INSTRUCTIONS TO OFFERORS--COMMERCIAL ITEMS (OCT 2018)
(a) North American Industry Classification System (NAICS) code and small business size standard. The NAICS code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet (SF 1449). However, the small business size standard for a concern which submits an offer in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.
(b) Submission of offers. Submit signed and dated offers to the office specified in this solicitation at or before the exact time specified in this solicitation. Offers may be submitted on the SF 1449, letterhead stationery, or as otherwise specified in the solicitation. As a minimum, offers must show--
(1) The solicitation number;
(2) The time specified in the solicitation for receipt of offers;
(3) The name, address, and telephone number of the offeror;
(4) A technical description of the items being offered in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature, or other documents, if necessary;
(5) Terms of any express warranty;
(6) Price and any discount terms;
(7) "Remit to" address, if different than mailing address;
(8) A completed copy of the representations and certifications at FAR 52.212-3 (see FAR 52.212-3(b) for those representations and certifications that the offeror shall complete electronically);
(9) Acknowledgment of Solicitation Amendments;
(10) Past performance information, when included as an evaluation factor, to include recent and relevant contracts for the same or similar items and other references (including contract numbers, points of contact with telephone numbers and other relevant information); and
(11) If the offer is not submitted on the SF 1449, include a statement specifying the extent of agreement with all terms, conditions, and provisions included in the solicitation. Offers that fail to furnish required representations or information, or reject the terms and conditions of the solicitation may be excluded from consideration.
(c) Period for acceptance of offers. The offeror agrees to hold the prices in its offer firm for 30 calendar days from the date specified for receipt of offers, unless another time period is specified in an addendum to the solicitation.
(d) Product samples. When required by the solicitation, product samples shall be submitted at or prior to the time specified for receipt of offers. Unless otherwise specified in this solicitation, these samples shall be submitted at no expense to the Government, and returned at the sender's request and expense, unless they are destroyed during preaward testing.
(e) Multiple offers. Offerors are encouraged to submit multiple offers presenting alternative terms and conditions, including alternative line items (provided that the alternative line items are consistent with subpart 4.10 of the Federal Acquisition Regulation), or alternative commercial items for satisfying the requirements of this solicitation.
Each offer submitted will be evaluated separately.
(f) Late submissions, modifications, revisions, and withdrawals of offers:
(1) Offerors are responsible for submitting offers, and any modifications, revisions, or withdrawals, so as to reach the Government office designated in the solicitation by the time specified in the solicitation. If no time is specified in the solicitation, the time for receipt is 4:30 p.m., local time, for the designated Government office on the date that offers or revisions are due.
(2)(i) Any offer, modification, revision, or withdrawal of an offer received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--
(A) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 5:00 p.m. one working day prior to the date specified for receipt of offers; or
(B) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or
(C) If this solicitation is a request for proposals, it was the only proposal received.
(ii) However, a late modification of an otherwise successful offer, that makes its terms more favorable to the Government, will be considered at any time it is received and may be accepted.
(3) Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the offer wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
(4) If an emergency or unanticipated event interrupts normal Government processes so that offers cannot be received at the Government office designated for receipt of offers by the exact time specified in the solicitation, and urgent Government requirements preclude amendment of the solicitation or other notice of an extension of the closing date, the time specified for receipt of offers will be deemed to be extended to the same time of day specified in the solicitation on the first work day on which normal Government processes resume.
(5) Offers may be withdrawn by written notice received at any time before the exact time set for receipt of offers.
Oral offers in response to oral solicitations may be withdrawn orally. If the solicitation authorizes facsimile offers, offers may be withdrawn via facsimile received at any time before the exact time set for receipt of offers, subject to the conditions specified in the solicitation concerning facsimile offers. An offer may be withdrawn in person by an offeror or its authorized representative if, before the exact time set for receipt of offers, the identity of the person requesting withdrawal is established and the person signs a receipt for the offer.
(g) Contract award (not applicable to Invitation for Bids). The Government intends to evaluate offers and award a contract without discussions with offerors. Therefore, the offeror's initial offer should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest; accept other than the lowest offer; and waive informalities and minor irregularities in offers received.
(h) Multiple awards. The Government may accept any item or group of items of an offer, unless the offeror qualifies the offer by specific limitations. Unless otherwise provided in the Schedule, offers may not be submitted for quantities less than those specified. The Government reserves the right to make an award on any item for a quantity less than the quantity offered, at the unit prices offered, unless the offeror specifies otherwise in the offer.
(i) Availability of requirements documents cited in the solicitation. (1)(i) The GSA Index of Federal Specifications, Standards and Commercial Item Descriptions, FPMR Part 101-29, and copies of specifications, standards, and commercial item descriptions cited in this solicitation may be obtained for a fee by submitting a request to--GSA Federal Supply Service Specifications Section, Suite 8100, 470 East L'Enfant Plaza, SW, Washington, DC 20407, Telephone (202) 619-8925, Facsimile (202) 619-8978.

(j) Unique entity identifier. (Applies to all offers exceeding $3,500, and offers of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management (SAM).) The Offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation ``Unique Entity Identifier'' followed by the unique entity identifier that identifies the Offeror's name and address. The Offeror also shall enter its Electronic Funds Transfer (EFT) indicator, if applicable. The EFT indicator is a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the Offeror to establish additional SAM records for identifying alternative EFT accounts (see subpart 32.11) for the same entity. If the Offeror does not have a unique entity identifier, it should contact the entity designated at www.sam.gov for unique entity identifier establishment directly to obtain one. The Offeror should indicate that it is an offeror for a Government contract when contacting the entity designated at www.sam.gov for establishing the unique entity identifier.
(k) Reserved.
(l) Debriefing. If a post-award debriefing is given to requesting offerors, the Government shall disclose the following information, if applicable:
(1) The agency's evaluation of the significant weak or deficient factors in the debriefed offeror's offer.
(2) The overall evaluated cost or price and technical rating of the successful and the debriefed offeror and past performance information on the debriefed offeror.
(3) The overall ranking of all offerors, when any ranking was developed by the agency during source selection.
(4) A summary of the rationale for award;
(5) For acquisitions of commercial items, the make and model of the item to be delivered by the successful offeror.
(6) Reasonable responses to relevant questions posed by the debriefed offeror as to whether source-selection procedures set forth in the solicitation, applicable regulations, and other applicable authorities were followed by the agency.

52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (DEC 2019)
ALTERNATE I (OCT 2014)
The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (v) of this provision.
(a) Definitions. As used in this provision--
“Covered telecommunications equipment or services” has the meaning provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
“Economically disadvantaged women-owned small business (EDWOSB) concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Forced or indentured child labor” means all work or service—
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
“Highest-level owner” means the entity that owns or controls an immediate owner of the offeror, or that owns or controls one or more entities that control an immediate owner of the offeror. No entity owns or exercises control of the highest level owner.
“Immediate owner” means an entity, other than the offeror, that has direct control of the offeror. Indicators of control include, but are not limited to, one or more of the following: Ownership or interlocking management, identity of interests among family members, shared facilities and equipment, and the common use of employees.
“Inverted domestic corporation,” means a foreign incorporated entity that meets the definition of an inverted domestic corporation under 6 U.S.C. 395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c).
“Manufactured end product” means any end product in product and service codes (PSCs) 1000-9999, except—
(1) PSC 5510, Lumber and Related Basic Wood Materials;
(2) Product or Service Group (PSG) 87, Agricultural Supplies;
(3) PSG 88, Live Animals;
(4) PSG 89, Subsistence;
(5) PSC 9410, Crude Grades of Plant Materials;
(6) PSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) PSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) PSC 9610, Ores;
(9) PSC 9620, Minerals, Natural and Synthetic; and
(10) PSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
“Sensitive technology”—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically—
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
“Service-disabled veteran-owned small business concern”—
(1) Means a small business concern—
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.
“Small disadvantaged business concern, consistent with 13 CFR 124.1002,” means a small business concern under the size standard applicable to the acquisition, that--
(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--
(i) One or more socially disadvantaged (as defined at 13 CFR 124.103) and economically disadvantaged (as defined at 13 CFR 124.104) individuals who are citizens of the United…
