About this file
This document contains a justification for other than full and open competition for a federal contract award. The contract is for dedicated hosting and maintenance of Immersive Terf, a virtual online transition center, including renameable seat licenses and virtual world specialist support. The requirement is to support the Army Transition Assistance Program for remote soldiers separating from the Army. The incumbent contractor is Three Wire Systems, a service disabled veteran owned small business. Market research found no other approved product on the DoD approved product list that could satisfy the requirement. The justification cites FAR 6.302-1 for only one responsible source being available. The one year contract was awarded on January 17, 2020 to an unknown vendor for an unknown amount to ensure soldiers can complete mandatory transition activities virtually.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA, and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses brand-name, product, or feature of a product peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
Three Wire Systems is the current contractor providing the hosting, professional services and technical support in the design and implementation of the virtual counseling and TAP services concept for the Transition Assistance Program.
Immersive Terf is the only authorized virtual collaboration product on the DoD Approved Product List (APL) that satisfies the need in accordance with DoD Risk Management Framework Guidelines. No other approved product is viable.
If this project is not renewed, it will adversely affect the Soldiers ability to interact virtually with the TAP centers worldwide. This is a high risk condition which will significantly impact the overall HRC mission. Approximately 20% or 17,200 of the 86,000 Soldiers that transition from the Army utilize the Virtual Center and the Terf tool at least once in the process. If not awarded, approximately 17,000 Soldiers would not be able to perform the Transition activities without significant issue.
6. Efforts to Obtain Competition: In accordance with FAR 12.203, the contracting officer may use the streamlined procedure for soliciting offers for commercial items prescribed in FAR 12.603. IAW FAR 12.603(a), when a written solicitation will be issued, the contracting officer may use the following procedure to reduce the time required to solicit and award contracts for the acquisition of commercial items. This procedure combines the synopsis required by FAR 5.203 and the issuance of the solicitation into a single document. Therefore, this contract action will not be synopsized.
Effective Competition: Attempts were made within CHESS and GSA to acquire quotes with other vendors. Zero quotes were received and are not available via CHESS nor GSA therefore, effective competition is not applicable.
7. Actions to Increase Competition: PERSINSD has begun the market research to define replacement products in such a manner as not to require a specific brand or manufacturer. It is estimated that it would take 180 days to identify replacement products, gain approval from the DoD APL, and an additional six months to procure a new product.

8. Market Research: Although the System for Award Management (SAM) search and DSBS resulted in multiple small business located nationwide under the selected NAICS of 511210, this requirement may not be set-aside for small business through CHESS.
The Terf License and Hosting Servers are not manufactured in the U.S. Market research supports that the requirement is not available, and cannot be satisfied through the CHESS program. The customer provided an approved CHESS Statement of Non- Availability (SoNA Number: 216751860) and ITAS waiver supporting the fact that this contract action cannot be procured through CHESS.
Another option found through market research would be to utilize NASA SEWP V Contract Vehicle. Three Wire, a Service Disabled Veteran Owned Small Business (SDVOSB) on SEWP V, is currently the only authorized reseller with preferred pricing for 3D ICC registered products on SEWP V. Utilizing the NASA SEWP contract, Group B, an SDVOSB will not only meet fair opportunity requirements but will also allow for small business credit. Under Unison Marketplace, product Code 70 requires using reverse auction to the greatest extent practicable, in accordance with MICC Command Policy Memorandum 12-15. Therefore, this requirement could also be satisfied by soliciting unrestricted via Unison reverse auction, available to the open market. However, the SEWP Fee is .375% and the FedBid Fee is 3%. Any cost savings by soliciting this contract action through SEWP or Unison will be lost due to the solicitation fees. A review of procurement history shows solicitation to be open market, awarded to the same vendor.
In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought notice was posted to SAM.gov on 17 December 2019 for three days and resulted in zero responses.
