INSTRUCTIONS TO OFFEROR(S)
In accordance with FAR 12.302, Tailoring of Provisions and Clauses for the Acquisition of Commercial Items, FAR Clause 52.212-1 is tailored as follows to reflect special contract terms and conditions that are unique to this solicitation.
I. INSTRUCTIONS FOR PROPOSAL SUBMISSION
1.1 For a quotation to be acceptable, an offeror must submit quotation to FEDBID no later than the solicitation closing date and time. Failure to submit as required shall be grounds for determining the offer technically unacceptable, and ineligible for contract award. The Government reserves the right to make a contract award determination without any discussions with offerors; however, if an award cannot be made on initial quotes and the Government determines discussions to be necessary, the competitive range will be established in considering technical, past performance and price evaluation factors to conduct discussions.
1.2 Confirmation of submittal requirement prior to the solicitation closing date and time is offeror’s responsibility. Quotations submitted other than Fedbid will not be considered for award.
1.3 Award will be made to the responsible offeror submitting the lowest priced, technically acceptable (LPTA) offer that satisfies all terms and conditions of this solicitation and who is determined to be responsible in accordance with FAR 9.104-1.
II. QUOTE SUBMISSION: Offerors’ quotes shall adhere to the following instructions:
2.1 These instructions are designed to ensure submission of essential information in order for the Government to understanding and evaluate quotes. Offerors are cautioned to follow the detailed instructions fully and carefully, as the Government reserves the right to make award based on initial offers received, without discussions with Offerors.
2.2 Offerors are cautioned to submit adequate information to enable the Government team to fully ascertain each offeror’s capability to perform all of the requirements identified in the solicitation. All commitments made in the quote shall become a part of the resultant contract.
2.3 Offerors are required to submit complete quotes (Technical Proposal and Price quote, below) Past Performance is optional through Fedbid (http://www.fedbid.com/) no later than the solicitation closing date. All questions should be emailed to the Contract Specialist through the Fedbid System within 3 calendar days after the solicitation is issued. Questions received after this date and time may not be answered.
2.4 Offerors quotations MUST include drawings and or diagrams detailing proposed specifications in accordance with the solicitation and the attached NATICK Center Drawing 11-1-7752 requirements. Quotes received without attached drawings and or diagrams will NOT be considered for contract award.
FACTOR I.
Technical Capability: The Offeror’s proposal shall contain all technical factors/subfactors of their technical capability which demonstrates a clear understanding and ability to execute all solicitation and NATICK Center Drawing 11-1-7752 requirements. The offeror shall provide proposed descriptions, literature, part numbers, model numbers, pictures, drawings, brochures and all proposed materials as requested. All materials shall be as described in the solicitation, salient characteristics and in the NATICK Center Drawing 11-1-7752 .
Unacceptable proposals. Proposals not submitted with all required documentations including all sub-factors listed in the solicitation will be deemed unacceptable and will not be considered for award. Not all of the minimum acceptable criteria are clearly met by the proposal will be deemed unacceptable. An unacceptable proposal contains one or more deficiencies. If the offeror’s quote fails to meet specified minimum performance and technical capability requirements defined in the solicitation and NATICK center Drawing 11-1-7752, the proposal will be deemed unacceptable.
Unacceptable proposals will not be considered for contract award. Partial offer is not acceptable.
FACTOR II.
Price: The offeror shall complete the pricing information for Contract Line Number (CLIN) that have quantity identified. The proposed price will be reviewed to determine if the estimate is adequate, reasonable and complete to assess the offeror’s understanding of the solicitation. Be Reasonable: Acceptable estimating methodology for developing the price quotation.

5152.233-4000 AMC-LEVEL PROTEST PROGRAM (Feb 2014) (LOCAL CLAUSE)
Prior to submitting an agency protest, it is preferable that you first attempt to resolve your concerns with the responsible contracting officer. However, you may also file a protest to the Headquarters (HQ), Army Materiel Command (AMC). The HQ AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the Government Accountability Office (GAO) or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 35 calendar days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103. If you want to file a protest under the HQ AMC-Level Protest Program, the protest must request resolution under that program and be sent to the address below.
Headquarters U.S. Army Materiel Command Office of Command Counsel-Deputy Command Counsel 4400 Martin Road Rm: A6SE040.001 Redstone Arsenal, AL 35898-5000 Fax: (256) 450-8840 or email usarmy.redstone.usamc.mbx.protests@mail.mil
The AMC-Level Protest procedures are found at: http://www.amc.army.mil/amc/commandcounsel.html.
If internet access is not available, contact the contracting officer or HQ, AMC to obtain the HQ AMC-Level Protest Procedures.
