PERFORMANCE WORK STATEMENT (PWS)
FORT BRAGG, NC
9 May 2016
1. GENERAL
1.1. Scope of Work. The Contractor shall provide the services described in this Performance Work Statement, including the set-up and take-down of:
Tents, Tables, and Chairs:
*One (1) 40’x80’ tent with four (4) walls and three (3) doors;
*Chairs - One hundred and fifty (150) folding chairs, five chairs per table;
*Tables - Thirty (30) 30”x8’ folding tables;
Tent and Chairs:
*Four (4) 30’x30’ tents with four (4) walls, one (1) door, and hard surface flooring;
*Chairs – Thirty (30) folding chairs;
Air conditioning units:
*One (1) unit per each 30’x30’ tent, capable of cooling the tents to 75F in 95F weather;
*Three (3) units for 40’x80’ tent capable of cooling the tent to 75F in 95F weather;
Trash collection and disposal:
*Thirty (30), 50-gallon trash cans with lids and liners; and
Bleachers:
*Twenty (20) bleacher units, each ten (10) rows deep and 30’ wide capable of seating two hundred fifty
(250) personnel, for total additional seating of five thousand (5,000) personnel.
Sun shade for bleachers:
*Shade must cover each existing and additional bleacher units and must be 11’ high, 19’ deep, and 30’ wide and have a 10 degree upward cant; and
Power Breezers for the bleachers:
*Forty (40) Power Breezers, distributed to the rear of and between the bleacher units.
The Contractor shall provide all direct labor, transportation, power generation, supervision of Contractor personnel, and other items and services (not specifically identified herein to be Government Furnished), necessary to provide these services. The Contractor is responsible for the security and prevention of theft and vandalism of their equipment for the duration of the period of performance. These services shall be conducted in support of and in coordination with the POC provided by the Government. The location for the performance of these services is, Fort Bragg, NC.
The period of performance is during normal work hours from 24 May 2016 – 26 May 2016.
1.2. Personnel. The Contractor shall act as, or provide a Project Manager to conduct overall management coordination and be the central point of contact for performance of work specified in this contract. The Contractor of designated individual shall have full authority to contractually commit Contractor administration of this specification. The name of this person or persons who can act for the Contractor shall be submitted in writing to the Contracting Officer two days prior to contract performance. Any changes in this person or persons who can act for the Contractor shall be submitted in writing within 24 hours of such change throughout the terms of this contract.
1.3. Qualifications of Personnel. The Contractor shall provide necessary personnel to accomplish the services covered under this contract within the specified time frames. The Contractor shall ensure that service employees performing work on this contract have any required licenses, permits, and certifications for the state and locality wherein work is to be performed. The Contactor shall provide adequate amount of service employees to conduct contracted service.
1.4. Contractor Identification. Each employee shall wear a Contractor furnished, visible, identifying badge on the outside of their clothing which shall include as a minimum, the person’s name, recent photograph and name of the Contractor at all times when performing work on this contract.
1.5. Conduct of Personnel. The contractor shall ensure that personnel present a professional appearance at all times and that their conduct shall not reflect discredit upon this installation of the Department of the Army. The Contractor shall remove any employee for reasons of misconduct or security. The removal of such a person shall not relieve the Contractor of the requirement to provide sufficient personnel to perform adequate and timely service.
1.6. Security. The Contractor shall be responsible for the security of Contractor furnished supplies, equipment, and vehicles.
1.7. Operating Hours. The Contractor shall perform work during the designated dates required to satisfy all the requirements of the contract. All work should be performed during normal work hours, M-F, 0800- 1700.
1.8 Access and General Protection/Security Policy and Procedures. This standard language text is for contractor employees with an area of performance within an Army controlled installation, facility or area.
Contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
1.9 Eligibility Verification for Employment. E-Verify is an Internet-based system that compares information from an employee's Form I-9, Employment Eligibility Verification, to data from U.S.
Department of Homeland Security and Social Security Administration records to confirm employment eligibility. The U.S. Department of Homeland Security is working to stop unauthorized employment. By using E-Verify to determine the employment eligibility of their employees, companies become part of the solution in addressing this problem. All U.S. employers must complete and retain a Form I-9 for each individual they hire for employment in the United States. This includes citizens and noncitizens. On the form, the employer must examine the employment eligibility and identity document(s) an employee presents to determine whether the document(s) reasonably appear to be genuine and relate to the individual and record the document information on the Form I-9. The list of acceptable documents can be found on the last page of the form. E-Verify is mandatory for employers with federal contracts or subcontracts that contain the Federal Acquisition Regulation E-Verify clause.
2. DEFINITIONS AND ACRONYMS
2.1. DEFINITIONS:
2.1.1. CONTRACTOR. A supplier or vendor awarded a contract to provide specific supplies or service to the Government. The term used in this contract refers to the prime.
2.1.2. CONTRACTING OFFICER (KO). A person with authority to enter into, administer, and/or terminate contracts, and to make related determinations and findings on behalf of the Government. Note:
The only individual who can legally bind the Government.
2.1.3. CONTRACTING OFFICER'S REPRESENTATIVE (COR). An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor, as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. CONTRACTOR PERSONNEL. Contractor and subcontractor employees performing working under this contract.
2.1.5. DEFECTIVE SERVICE. A service output that does not meet the standard of performance associated with the Performance Work Statement (PWS).
2.1.6. DELIVERABLE. Anything that can be physically delivered, but may include non-physical things, such as meeting minutes or reports.
2.1.7. GOVERNMENT-FURNISHED PROPERTY (GFP) OR GOVERNMENT PROPERTY (GP).
Property in the possession of or directly acquired by the Government and subsequently made available to the Contractor.
2.1.8. KEY PERSONNEL. Contractor employees who are critical for achieving PWS objectives. Key personnel shall meet position qualification and experience requirements indicated in the PWS. When key personnel qualifications are used as an evaluation factor in “Best Value” procurement, the Contracting Officer is the only one authorized to concur with key personnel replacement after award of the contract.
When proposed key personnel resumes are used as an evaluation factor in best value procurement, a letter of commitment may be required from the individual whose resume is provided.
2.1.9. LOCAL TRAVEL: Any travel that is required to perform services IAW the PWS that is within a 50-mile radius of the place of performance.
2.1.10. PERFORMANCE REQUIREMENT SUMMARY (PRS). A listing of the service outputs under the contract that are to be evaluated by the COR on a regular basis, the surveillance methods to be used for these outputs, and the performance requirement of the listed outputs.
2.1.11. PHYSICAL SECURITY. Actions that prevent the loss or damage of government property.
2.1.12. QUALITY ASSURANCE. A planned and systematic pattern of all actions necessary to provide confidence that adequate technical requirements are established; products and services conform to established technical requirements; and satisfactory performance is achieved. For the purposes of this document, quality assurance refers to actions by the Government.
2.1.13. QUALITY ASSURANCE SURVEILLANCE PLAN (QASP). The Government’s organized written document specifying the surveillance methodology to be used for surveillance of Contractor performance.
2.1.14. QUALITY CONTROL. All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.15. SUBCONTRACTOR. One that enters into a contract with a prime Contractor. The Government does not have privity of contract with the subcontractor.
2.1.16. WORK DAY. The length of time during a day in which the Contractor provides services, in accordance with the contract. Also referred to as Business Day.
2.1.17. WORK WEEK. Monday through Friday, unless otherwise specified.

3. GOVERNMENT-FURNISHED PROPERTY AND SERVICES
3.1. Facilities. The Government will provide, without cost, the required space available at Fort Bragg.
3.2. Emergency Medical Treatment. Medical services for Contractor personnel are the responsibility of the Contractor, however, the Government may provide, on an emergency basis, medical services for job related injuries while an employee is performing under this contract if Government facilities are available.
Emergency medical care is available to Contractor employees at the Base Hospital. For Emergency ambulance service, call 911. Such emergency medical care will be limited to those services necessary to prevent undue suffering or loss of life and will be provided only during the period of emergency. In such circumstances, action shall be taken to transfer employees of the contractor to a civilian health care provider as soon as the emergency period ends. The Contractor shall reimburse the Government for emergency medical services provided. If the invoice is not paid, the Contracting Officer may set off the cost against future payments to the Contractor.
4. CONTRACTOR-FURNISHED ITEMS
4.1. General. The Contractor shall furnish everything required to perform all tasks delineated in the PWS to include all equipment and training material required to satisfy all the requirements of the contract.
4.2. Equipment and Training Material. The Contractor shall provide all equipment required to perform all tasks delineated in the PWS required to satisfy all the requirements of the contract.
5. SPECIFIC TASKS
5.1. Basic Services. The Contractor shall provide all direct labor, transportation, supervision (of all contractor personnel) and other items and services (not specifically identified herein to be Government Furnished), necessary to complete the work established by this contract. The location of performance for all services is on Fort Bragg, NC. The Contractor is responsible for the security and prevention of theft and vandalism of their equipment for the duration of the period of performance. These services shall be conducted in support of and in coordination with the POC provided by the Government.
5.2. The Contractor shall set up one (1) 40’x80’ tent with four (4) walls and three (3) doors no later than 1700 hours on 24 May 2016. This tent will be set up on the concrete pad behind the bleachers at Fort Bragg, NC.
5.2.1. Inside the 40’x80’ tent, the Contractor shall set up thirty (30) 30”x8’ folding tables and one hundred and fifty (150) folding chairs, five chairs per table, no later than 1700 hours on 24 May 2016.
5.2.2. The Contractor shall connect three (3) air conditioning units capable of cooling the 40’x80’ tent to 75F in 95F weather, and ensure the tent is cooled to this temperature no later than 0900 hours on 25 May 2016. The Contractor is responsible for power generation, and noise abatement that reduces the generator noise level to no more than 65 dB at 10’.
5.3. The Contractor shall set up four (4) 30’x30’ tents, each with four (4) walls, one (1) door, and hard surface flooring, no later than 1700 hours on 24 May 2016.
5.3.1. Inside each 30’x30’ tent, the Contractor shall set up thirty (30) folding chairs no later than 1700 hours on 24 May 2016.
5.3.2. The Contractor shall connect one (1) air conditioning unit to each of the 30’x30’ tents, capable of cooling the tents to 75F in 95F weather, and ensure that the tents are cooled to this temperature no later than 0800 hours on 25 May 2016. The Contractor is responsible for power generation, and noise abatement that reduces the generator noise level to no more than 65 dB at 10’.
5.4. The Contractor shall provide thirty (30) 50-gallon trash cans with lids and liners distributed around the tents and latrines on Fort Bragg. The contractor is required to conduct hourly trash disposal of all thirty trash cans at the designated dumpster.
5.5. The Contractor shall provide twenty (20) bleacher units, each ten (10) rows deep and 30’ wide capable of seating two hundred fifty (250) personnel, for total additional seating of five thousand (5,000) personnel. These bleachers will be placed adjacent to the existing bleachers at Fort Bragg. The bleachers must be set up no later than 1700 hours on 24 May 2016.
5.5.1. The Contractor shall provide sun shade over each of the existing and additional bleacher units. The shade structures must be 11’ high, 19’ deep, and 30’ wide and have a 10 degree upward cant, so that spectators in the back row can observe the aircraft flying at 2,000’ AGL. The sun shade must be set up no later than 1700 hours on 24 May 2016.
5.5.2. The Contractor shall provide forty (40) Power Breezers, distributed to the rear of and between the bleacher units. The Power Breezers must be in place and in operation no later than 0900 hours on 25 May 2016. The Contractor is responsible for the power generation, noise abatement (65 dB at 10’), and water supply for the Power Breezers.
5.6. The Contractor is responsible for taking down all equipment, beginning no earlier than 1500 and no later than 1700 hours on 26 May 2016.
