JUSTIFICATION DOCUMENT
FOR OTHER THAN FULL AND OPEN COMPETITION
Logistics Information System (LIS) Support Services
1. CONTRACTING AGENCY: Mission and Installation Contracting Command – Fort Bragg, North Carolina
2. DESCRIPTION OF ACTION: Approval is requested for a justification for other than full and open competition for a four (4) month contract action to CGI Federal the current provider for a critical United States Army Reserve Command (USARC) Logistics Information System (LIS) support services. Services covered under this contract are all of the enterprise IT systems that track, report and document USAR material and equipment including but not limited to fleet management, aviation, unit equipment training, and readiness and fielding. The competitive follow-on, W91247-15- C-0008 was awarded, but a GAO Protest B-410354.2 filed on April 17, 2015 stayed performance of the new contract. This Justification permits the critical USARC logistics mission to continue for a four (4) month period without interruption during the resolution of the protest.
3. DESCRIPTION OF SUPPLIES/SERVICES: This justification will allow the status quo support to USARC wide logistics IT systems Standard Army Management Information Systems (STAMIS), Business Intelligence Tools (BIT), Programs and Systems, USARC Unique Sustainment Information System such as Logistics Data and Analysis Tool (LogDAT) and Standard Army Maintenance System - Fleet Management (SAMS-FM) as well as Sustainment Information System (SIS) New Equipment Fielding; New Equipment Training (NET); functional, technical sustainment, and life cycle support of SIS for USARC to be maintained during the protest period. The due date for GAO’s decision is 27 July 2015. The estimated value of the proposed action is $4.5M. Fiscal Year (FY) 2015 Operation and Maintenance, Army Reserve (OMAR) funds will be used for four (4) months.
4. AUTHORITY CITED: This action is authorized under provisions of 10 U.S.C. 2304(c)(2) as implemented by FAR 6.302-2, Unusual and Compelling Urgency.
5. REASON FOR AUTHORITY CITED: Pursuant to FAR 6.302-2, the services required are of such a nature that the Government would be seriously injured if they are not allowed to continue in light of the GAO Protest. Delay or discontinuance of these services would critically impact USARC’s mission. Specifically, without these services, equipment repair and status are not able to be documented, reported, and maintained; the ability to provide for accountability of equipment and status will be lost; equipment would be deadlined (to include grounding of USARC aviation assets) which would result in mission compromise and failure. Additionally, these services are highly specialized, requiring skilled individuals with both IT and logistics system training and experience, with the Contractor required to provide staffing at locations through the Continental United States and Puerto Rico. It would be nearly impossible for another Contractor to obtain qualified staffing at all locations and be prepared to perform these key services with no phase-in time. Therefore it is not reasonable or practicable to obtain any competition for this interim requirement under the circumstances. Market Research on the follow on indicates that there are small businesses available who are capable of performing the work, however only the incumbent is capable of providing these services with no phase in time for the short period of performance required. Failure to provide these services would essentially eliminate USARC’s ability to perform its mission as it would create a domino effect, potentially losing all logistical functions. These services are the backbone of the
USARC G4.
Contract W91247-15-C-0008 was awarded to The Oryza Group, LLC on 27 March 2015. Post Award Debriefings were held on April 14, 2015, and on April 17, 2015, Hughes Group, LLC filed a GAO protest against contract W91247-15-C-0008. Approval of this Justification for four months will allow enough time to continue service without interruption until the GAO Protest has been resolved.
a. Background: This is a follow-on requirement for services. Services are currently being received under task order W911SE-07-D-0010-1N05 from Stanley Associates, Inc. (now CGI – Federal), a large business based out of Fairfax, Virginia. The current requirement was solicited under fair opportunity provided to the Field and Installation Readiness Support Team (FIRST) Unrestricted Suite and was awarded to Stanley Associates, Inc.
on 11 September 2011 in the amount of $39,825,463.00. The task order was awarded as a single Firm Fixed Price (FFP) Hybrid type task order with Travel and ODC Contract Line Items (CLINs). The basis for award was Lowest Price Technically Acceptable (LPTA). Two (2) of the fifteen Contractors within the suite submitted proposals. The current task order was due to expire on 29 March 2015, but was extended for the period of 30 March 2015 through 28 April 2015 under the authority of FAR Clause 52.237-3, Continuity of Services to effect an orderly and efficient phase-in of the new award. The current task order’s expiration date is 28 April 2015 and the FIRST ordering period for a new contract has expired.
b. Alternatives:
i. Use of In-House Resources: USARC HQ does not have 70-80 IT Logistics professionals ready to step in and provide these services.
ii. Cease Support Services: While an alternative, this approach was never considered as it would result in failure to provide Logistics Information Systems Support to the entire United States Army Reserve Command. This would result in mission failure at USARC and would make any action that requires logistical coordination within the USARC impossible. All USARC Aviation assets would immediately be deadlined, and unit equipment could soon follow. This is to say that it would become inoperable and unavailable for use, and commanders would be unable to accurately report their assets. This series of events would occur as a domino effect, and would get worse the longer the services are ceased, and would effectively shut the USARC down.
iii. Compete the Immediate Requirement: While an alternative, this approach is not logical or efficient under the circumstances. The current task order expires on 28 April 2015. The competitive follow-on provides for a 30 day phase-in period, which is deemed adequate. It is both unlikely and unreasonable to expect a new
Contractor to be staffed and ready to go at numerous locations throughout the Continental United States and Outside the Continental United States without adequate phase-in time. In addition to this disruption to mission, a competitive procurement for such a short period of time could result in a substantial increase in price as Contractors will price for the length of the procurement in order to ensure that they realize a profit as a result of the Contract. Lastly, incumbents are typically awarded interim contracts in the event of a GAO Protest in order to meet the intent of maintaining the status quo of services until such time that the GAO Protest is resolved. This helps to ensure a smooth continuation of the required services, which would not occur if this requirement were to be competed for this short period of time.
c. Justification: In accordance with FAR 6.302-2, the Government’s need for these services are of such an unusual and compelling urgency that the Government would be seriously injured unless award can be made to CGI - Federal pending the outcome of the GAO Protest. A delay or discontinuance of these services for even one day would seriously damage the readiness posture of many USARC units and would be unacceptable to the mission.
d. Impact: Without this support, the USARC Sustainment Automation Support Management Office (SASMO) program will completely shut down. The monthly average of 1500 line replacement unit issue and repair from the Tactical Computer Exchange (TCX) will stop. The helpdesk averaging 1800 Log Automation queries per month will be shut down. Fielding of new systems will not be placed on the Army Reserve Network (ARNET) rendering any future systems in a “stand-alone” mode. The LOGDAT warehouse servers will no longer be updated and operate unmanned until a server error renders it inoperable. Army Materiel Status System (AMSS) and Total Cost of Ownership TCO reporting will no longer go forward via network to Logistics Support Agency (LOGSA). The Fleet Management Systems (FLMS) located at over 150 Equipment Concentration Sites (ECS) and Area Maintenance Support Activities (AMSA) supported by centrally located servers at Fort Bragg would quickly become unserviceable causing all maintenance facility to resort to the Army maintenance manual system.
Repair part orders would become backlogged, with real likelihood for deadlining all equipment indefinitely. Without reported data, the AR commanders at all levels will have limited visibility of their units’ logistics readiness posture, and they will be unable to report their Unit Status Report (USR). This will impact unit readiness and critically impact USARC’s mission.
6. EFFORTS TO OBTAIN COMPETITION: Competition for this requested action is not possible due to the short time until the current contract expires, the relatively short duration of the GAO protest period, and the required phase-in time. Obtaining competition for this requested action also goes against the held guidance to maintain the status quo during the GAO protest period. Market Research completed on the follow on indicates that there are many sources capable of performing this requirement however, it is not appropriate in these circumstances.
7. ACTIONS TO INCREASE COMPETITION: The new contract for this requirement awarded 27 March 2015 which is currently under protest, was solicited as a service disabled veteran owned small business set aside, with good competition, 8 offerors submitted proposals. The current task order was solicited with fair opportunity provided for all FIRST Unrestricted Suite contract holders.
8. MARKET RESEARCH: Market research was conducted for the competitively awarded follow-on order which showed numerous sources available capable of performing these services. Limited market research was conducted on this requested action as the intent is to maintain the Government’s status quo while waiting for the decision from the GAO on the protest.
9. INTERESTED SOURCES: No Sources Sought notice was posted for this requested action, and the Notice of Intent is exempt from synopsizing IAW FAR 5.202(a)(2).
10. OTHER FACTS:
a. Urgent and Compelling: As summarized above, failure to approve this justification would result in mission failure as Logistics Information Systems Support to the entire USARC would cease. All unit equipment would become inoperable and unavailable for use as ordering for parts would cease.
Commanders would lose the ability to report on the readiness status of their units, equipment for logistical support would not be issued, repaired, or replaced, which would cause units to not have equipment to perform their missions. It would make any action that requires logistical coordination within the USARC impossible. This series of events would occur as a domino effect, and would get worse the longer the services are ceased, and would effectively shut the USARC down.
b. Small Business Competition Plan: IAW FAR 19.702(a)(1), a small business subcontracting plan will be obtained.
