DETERMINATION FOR OTHER THAN FULL AND OPEN COMPETITION

(SIMPLIFIED ACQUISITION PROCEDURES – BRAND NAME)

1. Contracting Activity:

U.S. Army Corps of Engineers, Huntington District, CELRH-DCT-C, 502 8th Street, Huntington, WV, 25701

2. Description of Action:

The action submitted for approval is for a brand name procurement of Trimble GPS equipment to augment the Huntington District equipment inventory. The cost for the GPS equipment exceeds Government Visa purchase thresholds. FY19 funds will be used for this supply contract. The total estimated cost for the items is approximately $94,035.96 including freight.

3. Description of Supplies/Services:

See attached Scope of Work for list of Trimble Items.

4. Authority Cited:

10 U.S.C. 2304(c) and FAR 13.106-1(b)(1). The Agency’s need is for brand-name commercial items.

5. Reason for Authority Cited:

The minimum Government need is to procure GPS/GNSS equipment compatible with the existing software and hardware currently in use by the Huntington District and other survey teams inside of LRD. Trimble GPS/GNSS units are currently the only units compatible with the existing software and hardware package utilized by the LRH Survey Team. A change to the system would require a complete overhaul resulting in duplicative purchases, training, and expense. Overhauling an entire system is not in the Government’s best interest, at this time. As a result, the aforementioned brand-name equipment satisfies the Government’s minimum need and thereby precludes consideration of a product manufactured by another company.

6. Efforts to Obtain Competition:

In accordance with FAR 5.101 and 5.102, competition will be obtained by posting a solicitation to the Federal Business Opportunities (FBO) website to allow all interested vendors to submit quotes for the required products. Vendors will be provided no less than three (3) business days to submit quotes. It has been determined it is in the best interest of the Government to set-aside this procurement for small business, in accordance with FAR 19.502(a)(2).

7. Actions to Increase Competition:

Not applicable – see paragraphs 4 and 5 above.

8. Market Research:

Based on market research performed by the customer, there are no other systems by various manufacturers that will meet the mission requirements. All of the current field units and office software processing are Trimble units, and the software is proprietary to the hardware and work flow. The District has no other options from a secondary software manufacturer. Personnel from this office performed independent internet searches for other data collection systems and held conference calls with ESRI and Trimble. The ESRI system did contain the functionality to complete the field mission to the support the EGIS system. No other systems within the Trimble brand were found to perform the adjustments and integration to the District GIS and Mapping system required for current District mission procedures. The contract will require that the Contractor maintain a certified repair facility within a 100 mile radius of the District Office for warranty repair services.

A local vendor has expressed interest in this procurement. To date, no other sources have been explored.
