SUMMARY OF CHANGES
SECTION 00 10 00 - SOLICITATION
The required performance has changed from Construction of a temporary cofferdam at Bluestone Dam, Hinton, West Virginia. The estimated order of magnitude of this procurement is between $10,000,000.00 and $25,000,000.00. The North American Industry Classification System (NAICS) Code for this acquisition is 237990.
This is a full and open procurement. In accordance with FAR 19.1307, this project requires the HUBZone 10% price evaluation.All bidders must return the Standard Form 1442, Section 00 10 00 (Bid Schedule), Section 00 45 00 (Representations and Certifications, in its entirety), and a bid guarantee (see FAR Clause 52.228-1).Contractor registration is available through the System for Award Management (SAM), available at www.sam.gov. Offerors must comply with requirements of 52.204-7, 52.204-8, 52.232-33, and any other SAM requirements, to include completing requirements in this solicitation through SAM.Refer to "Instructions to Offerors" for acceptable submission format. SUBMISSIONS RECEIVED SOLELY VIA ELECTRONIC MEDIA SUCH AS CD, DVD, THUMBDRIVE, EMAIL, OR FACSIMILE WILL NOT BE CONSIDERED.A pre-bid meeting and site visit will be conducted. SECTION 00 21 00 - INSTRUCTIONS
The following have been modified:
INSTRUCTIONS TO BIDDERS
BID OPENING
The bid opening will be held at the U.S. Army Corps of Engineers, Room 125, 502 8th Street, Huntington, WV 25701. For date and time of bid opening, see Block 13 on Standard Form 1442. Upon arrival, attendees must check in with the security desk to have the guards contact Leah Morgan at ext. 5548 to submit your bid and be escorted to the room for the bid opening.
PRICE BASIS
Bidders are advised that only bids submitted on a firm-fixed price basis will be considered, and that bids submitted on any other than firm-fixed price basis will be rejected.
Bid price alterations, i.e., crossed-out or white-out changes on the bid will not be accepted unless the change(s) is/are initialed.
BID QUANTITIES
Bids for less than specified quantities of each item in the Schedule will not be considered. Failure to submit a unit price for each item where required in the bid schedule will be considered as a material deviation from the requirements of the solicitation, and the bid will be rejected. (FAR 14.404-2)
ARITHMETIC DISCREPANCIES
(a) For the purpose of initial evaluation of bids, the following will be utilized in resolving arithmetic discrepancies found on the face of the bidding schedule as submitted by the bidders:
(1) Obviously misplaced decimal points will be corrected;
(2) In case of discrepancy between unit price and extended price, the unit price will govern;
(3) Apparent errors in extension of unit prices will be corrected;
(4) Apparent errors in addition of job and extended price will be corrected; and
(b) For the purpose of bid evaluation, the Government will proceed on the assumption that the bidder intends their bid to be evaluated on the basis of unit prices, extensions, and totals arrived at by resolution of arithmetic discrepancies as provided above and bid will be so reflected on the abstract of bids.
ADDITIONAL INSTRUCTIONS
I. BIDS MUST SET FORTH FULL, ACCURATE, AND COMPLETE INFORMATION AS REQUIRED BY
THIS INVITATION FOR BID (INCLUDING ATTACHMENTS). THE PENALTY FOR MAKING
FALSE STATEMENTS IN BIDS IS PRESCRIBED IN 18 U.S.C. 1001.
II. THE HUNTINGTON DISTRICT CORPS OF ENGINEERS DOES NOT ACCEPT BIDS BY
FACSIMILE TRANSMISSIONS AND/OR EMAIL.
III. NOTE THE AFFIRMATIVE ACTION REQUIREMENTS OF THE EQUAL EMPLOYMENT
OPPORTUNITY CLAUSE (FAR 52.222-23) WHICH WILL APPLY TO THE CONTRACT
RESULTING FROM THIS SOLICITATION.
IV. ONE SEALED PAPER ORIGINAL AND ONE PAPER COPY OF BIDS ARE DUE AT THE
PLACE SPECIFIED ON THE STANDARD FORM 1442, ITEM 8. IN ADDITION TO THE HARD
COPIES, IT IS PREFERRED THAT BIDDERS SUBMIT A SEARCHABLE PDF DOCUMENT ON
A CD OR DVD. SUBMISSIONS RECEIVED SOLELY VIA ELECTRONIC MEDIA SUCH AS
CD, DVD, THUMBDRIVE, EMAIL, OR FACSIMILE WILL NOT BE CONSIDERED.
V. IF THE APPARENT LOW BIDDER IS OTHER THAN SMALL BUSINESS, A
SUBCONTRACTING PLAN MAY BE REQUIRED IN ACCORDANCE WITH FAR CLAUSE
52.219-9 ALTERNATE I (DEVIATION), SMALL BUSINESS SUBCONTRACTING PLAN.
DETERMINATION OF RESPONSIBILITY
To ensure award is made to a responsible bidder, a determination of responsibility will be conducted. The apparent low bidder will be contacted by the Contracting Officer and will be required to provide the requested responsibility information within 4 calendar days. As part of this responsibility determination, the Contracting Officer will utilize the guidance contained in FAR 9.104-1 which states to be determined responsible, a prospective contractor must:
a. Have adequate financial resources to perform the contract or the ability to obtain them.
b. Be able to comply with the required or proposed delivery or performance schedule.
c. Have a satisfactory performance record.
d. Have a satisfactory record of integrity and business ethics.
e. Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them.
f. Has the necessary production, construction, and technical equipment and facilities, or theability to obtain them.
g. Be otherwise qualified and eligible to receive an award under applicable laws and regulations.
