Section C - Descriptions and Specifications

STATEMENT OF WORK

SPECIFICATIONS

FOR SUPPLY, DELIVER, & INSTALL OF 10’X12’ PRECAST CONCRETE BUILDING

AT

BEECH FORK LAKE, LAVALETTE, WV

1. General: Furnish all equipment, material, labor, supplies, and supervision necessary to accomplish the following:

-Remove the old existing structure from the site and dispose of properly;

-Prepare the site by removing the existing foundational pillars and creating a new, level base consisting of crush-and-run stone;

-Install new building on the site, including electrical hook-ups and all other necessary work requisite to the full functioning of the building.

2. Scope: The work site currently has a pre-fabricated, fiberglass building that is used to house the communication equipment requisite to the proper functioning of the radio repeater used by the Beech Fork Project. This equipment will be removed by project staff prior to the commencement of the work outlined in this scope. The contractor shall be responsible for disconnecting electrical service to the building in such a manner as to re-connect it upon installation of the building. The contractor shall also be responsible for removal and proper disposal of the existing structure.

Once the building is removed, the currently-installed concrete pillars and entrance pad shall be removed from the site and disposed of. A level gravel base, 6” deep, 15’x15’ and consisting of crush-and-run stone, shall be installed at the site in preparation for the new building. This base will also be compacted to ensure a firm, secure foundation.

Next, a precast concrete building shall be delivered and installed on the prepared site. The building shall meet the following specifications:

Exterior dimensions: 10’ wide, 12’ long, 9’-6” tall Interior dimensions: 9’-6” wide, 11’-6” long, 9’ tall Design Loads:

-Seismic load performance category ‘C’, Exposure Group III -Standard Live Roof Load – 60 PSF -Standard Floor Load – 250 PSF -Standard Wind Loading – 130 MPH

Sloped Roof: The roof panel shall slope ½” from the left side (if facing the door) to the right side. The roof shall extend a minimum of 2 ½” beyond the wall panel on each side and have a turndown design which extends ½” below the top edge of the wall panels to prevent water migration into the building along top of wall panels. Roof shall also have an integral architectural ribbed edge.

Roof, floor and wall panels: Must each be produced as single component monolithic panels.

No roof, floor, or vertical wall joints will be allowed, except at corners. Wall panels shall be set on top of the floor panel.

Floor panel: Must have ½” step-down around the entire perimeter to prevent water migration into the building along the bottom of wall panels.

3. Materials:

a. Concrete: steel-reinforced, 5,000 PSI minimum 28-day compressive strength, air-entrained (ATSM C26).

b. Reinforcing Steel: ATSM A615, grade 60

c. Post-tensioning Strand: 41K Polystrand CP50, .50, 270 KSI, 7-wire strand, enclosed within a greased plastic sheath, (ASTM A416). Roof and floor to be each post-tensioned by a single, continuous tendon. Said tendon shall form a substantially rectangular configuration having gently curving corners wherein the positioning of the cable member results in a pattern of one or more loops and a bisecting of the loop(s). The cable member starts from one corner of the concrete building panel, forms a gentle perimeter loop(s) returning to a point where the cable member entered the concrete building panel. The tendon then turns 90 degrees and follows the cable member(s) to a point midway along the “Y” axis of the concrete building panel and then turns 90 degrees along the “X” axis of the concrete building panel. This bisects the concrete building panel and crosses the opposite parallel portion of the cable member and exits from an adjacent side of the concrete building panel.

d. Caulking: Joint between building and floor slab shall be caulked on the exterior and interior surface of the joints. Caulking shall be SIKAFLEX-1A elastic sealant or equal.

Exterior caulk joint to be 3/8” x 3/8” square so that the sides of the joint are parallel for correct caulk adhesion. Back of the joint to be taped with bond breaking tape to ensure adhesion of caulk to parallel sides of joint and not the back.

e. Panel Connections: All panels shall be securely fastened together with 3/8” thick steel brackets. Steel is to be of structural quality, hot-rolled carbon complying with ASTM A283, Grade C and hot dipped galvanized after fabrication. All fasteners to be ½” diameter bolts complying to ASTM A307 for low-carbon steel bolts. Cast-in anchors used for panel connections to be Dayton-Superior #F-63, or equal. All inserts for corner connections must be secured directly to form before casting panels. No floating-in of connection inserts shall be allowed.

f. Doors and Frames: Shall comply with Steel Door Institute “Recommended Specifications for Standard Steel Doors and Frames” (SDI-100) and as herein specified.

The building shall be equipped with double 3’-0” x 6’-8” x 1’-3/4”, 18-guage galvanized/insulated Dominion Imperial right hand reverse metal doors with 16-guage galvanized frames. Doors and frames shall be bonderized and painted one coat of rust inhibitive primer and one finish coat of enamel paint; color shall be Chateau Brown or equivalent.

g. Door Hardware:

- Handle: Best 40H Series, AB-Office (F20) model mortise lock; satin stainless-steel finish; style 14 lever; Style R rose. Mortise lock shall be installed in door upon delivery, minus the key core (which shall be installed by the Government).

- Hinges: PB-31/NRP/26D 4 ½” x 4 ½” (chrome-plated with non-removable hinge pins), 3 per door or equal.

- Surface Bolt, Upper: Cal-Royal 045901426D (satin chrome finish) or equal.

- Surface Bolt, Lower: Cal-Royal 045901426D (satin chrome finish) or equal.

- Astragal: A4441/68R or equal.

- Threshold: National Guard 897V60 raised interior, extruded aluminum threshold with neoprene seal or equal.

- Door Holder: Glynn-Johnson 904HUS32D (stainless steel finish), overhead slide type surface mounted door holder or equal.

- Drip Cap: National Guard 15D72 or equal.

- Door Stop: Ives 445B26D (inactive leaf only) or equal.

h. Finishes: Interior of building: smooth steel form finish on all interior panel surfaces.

Exterior of building: finish shall be exposed stone. Contractor will provide all available color options to the Government prior to construction to allow the Government to select the desired finish colors, which are dependent on availability by location.

i. Electrical: Building shall be equipped with a 100 amp panel board, surface mounted on the left-hand side of the interior of the building, two (2) feet back from the front-left corner and at an elevation prescribed by the National Electric Code standards. A 2” hole to the exterior of the structure will accommodate the entry of the service wire. This hole shall be centered underneath the panel board, 1’ above the floor. The panel board shall be comprised of the following components, or equivalent:

-NF Enclosure, MH38WP (Qty: 1)

- NQ Panelboard Interior, NQ18L1C (Qty: 1)

- QO Load Center Ground Bar Assembly, PK27GTA (Qty: 1)

- Neutral Bar, NQN1CU (Qty: 1)

- Circuit Breaker, HDL36100 (Qty: 1)

- 20 Amp Circuit Breaker, QOB120 (Qty: 8)

- 30 Amp Circuit Breaker, QOB230 (Qty: 2)

- Surge Protection Device, SSP01BIA10PBQ1 (Qty: 1)

- Installation Kit, NQMB2HJ (Qty: 1) The electrical system will include 6 circuits: a circuit for the repeater receptacle, a circuit for the tower light control equipment, a circuit for the AC unit (wired directly to the panel per manufacturer’s specifications), a circuit for the two 8’ LED interior lights, a circuit for the two exterior wall packs (on a photocell), and a circuit for 3 wall-mounted receptacles (Exhibit A). Electrical service from the old structure shall be re-established to the new panel board upon completion of the building installation, and all circuits shall be ran through appropriately-sized rigid conduit (surface-mounted) and shall meet current National Electrical Code standards.

j. Exterior Lights: LED wall packs shall be TWH LED 20C 1000 50K T3M MVOLT DDBXD model units with tamper proof screws (TP option), or equivalent. These lights shall be on a dedicated circuit with a photocell in order to operate in low-light conditions and at night.

k. Air Conditioning Unit: A Bard Q-Tec model Q24A2A10EXVDXX air conditioning unit, or equivalent, shall be installed in the building and venting to the exterior of the building using the QWS42A wall sleeve and QLS2-10 outdoor louver grille. Other field accessories to be installed include the QCDS48A Drain Kit, QSTX42A-V-S10 side trim extension kit (color to match exterior building color), and the QPB42-V plenum box (or equivalents). The unit shall be wired directly to the 100 amp panel per manufacturer’s recommendations.

l. Cable Entry: A Roxtec Cable Entry, utilizing the G-frame and including twelve (12) RM40 cable sealing modules, eight (8) RM30 cable sealing modules, six (6) RM20W40 cable sealing modules, and two (2) RM60 24-54 cable sealing modules, plus all other applicable components, shall be cast into the rear wall of the building, centered on the left 1/3 of the wall, 1” down from the interior ceiling, to facilitate the routing of communications cables to the exterior of the building (Exhibit B).

A 2” diameter hole shall be drilled through the left wall (if facing the front of the building and doors) in the vicinity of the electrical panel to accommodate the feeder wire to the panel. The hole is intended to allow a PVC conduit to pass through. A Roxtec SLFO EXT model sleeve (or equivalent) of appropriate size shall be installed on the exterior of the building to provide an adequate seal for the conduit.

4. Site Access Limitations: The access road to the building site is a dirt road (Exhibit C) and rather soft in places due to ground water saturation. Delivery of the building immediately following a rain event in not advised. The currently-installed building and radio tower are surrounded by a chain-link fence. There is a double-leaf gate to access the building site, the width of which is 11’.

6. Hours of Operation: Normal working hours are Monday-Friday, 0730-1600. Work inside Government buildings or other secured areas shall be performed during the above reference work hours. Ten Federal holidays observed are as follows:

New Years Day (January 1st) Martin Luther King Day (3rd Monday in January) President’s Day (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October)

Veterans Day (November 11th) Thanksgiving Day (4th Thursday in November) Christmas Day (December 25th) When one of the above designated holidays falls on a Sunday, the following Monday is observed as a legal holiday. When a designated holiday falls on a Saturday, the preceding Friday is observed as the legal holiday.

8. Contractor Accident Prevention Plan (APP):

a. General: Contractor shall comply with all Federal, State and Local safety requirements including those specified by the Occupational Safety and Health Act (OSHA) in 29 CRF 1910 General Industry Standard, 1926 Construction Standard and the U.S. Army Corps of Engineers Safety & Health Requirements Manual EM 385-1-1 as currently revised. Where a conflict exists between safety standards/requirements the contractor shall comply with the more stringent requirement. If the Contractor fails or refuses to promptly comply with safety and security requirements as specified herein, any project employee may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such work stoppage shall be made subject to any claims for extension of time or for excess costs or damages sustained by the Contractor. Also, the Contractor will not be paid for work not performed as a result of the stop order.

b. Contractor Accident Prevention Plan (APP): The Contractor shall prepare a site-specific Accident Prevention Plan following the outline provided in EM 385-1-1, Appendix A as a minimum. The contractor shall address each element and sub-element in the outline in the order they appear in Appendix A. Any item from the outline that does not apply must be listed, in its assigned place and a brief explanation of the reason it is not required/provided. The APP shall address any unusual or unique aspects of the project or activity. This plan must be accepted by the Contracting Officer prior to commencement of any work. Contractors are encouraged to contact the USACE Safety & Occupational Health Office for questions or information regarding the development of contract Accident Prevention Plans. (1) The contractor shall have on site an employee designated as a Site Safety and Health Officer (SSHO) who has completed the OSHA 30-hour Construction Safety training or its equivalent as specified in EM 385-1-1, 01.A.17 and has at least five years experience relative to the work to be performed. No work will be permitted unless the SSHO is present at the work site.

(2) Work crews of two or more must have two people holding current certification in First Aid and CPR from the American Red Cross, American Heart Association or a licensed physician. Training must include a hands-on component that cannot be taken online and the contractor must maintain appropriate First Aid kit on site.

Single individuals working alone must have current certification in First Aid as a minimum.

(3) All work that potentially exposes the worker to falls of six feet or more will require the contractor to submit a Site Specific Fall Protection & Prevention Plan in accordance with EM 385-1-1, Section 21.D.

(4) Cranes and hoisting equipment shall be operated only by qualified personnel (operators licensing, physical and drug testing in accordance with EM 385-1-1

Section 16.B). Note: CDL Medical Clearance is not acceptable. Please see attached medical clearance requirements.

(5) Effective November 8, 2010 all “Signalpersons” and “Riggers” shall be qualified. This is a mandatory requirement in accordance with 29 CFR 1926.1400 Regulations. Riggers must be a qualified person for the performance of specified hoisting activities such as during assembly/disassembly, in accordance with OSHA 1926.1404(r)(1) and 1926.1425(c)(3).

c. Risk Management Process: The Contractor shall utilize risk management tools such as Activity Hazard Analysis (AHA), Job Hazard Analyses (JHAs), Job Safety Analyses (JSAs) or similar tools to identify, assess, prioritize risks and develop controls to minimize, monitor and control the probability and/or impact of unfortunate events to an acceptable level. Within each major phase, all activities, tasks or Definable Features of Work (DFOWs) shall be identified that will require an AHA/JSA/JHA. For each work activity, task or DFOW contractor shall prepare the initial AHA/JSA/JHA. A Risk Assessment Code (RAC) is assigned to each step, to the risk that remains after controls have been applied (residual risk) a final RAC (cannot be lower than the highest step RAC) shall be assigned. See EM 385-1-1 Section 01.A.14.b. for further guidance or contact the SOHO for assistance. The AHA/JSA/JHA shall be reviewed and accepted by the proper authority in order to proceed with the activity. All on-site employees shall review the accepted AHA/JSA/JHA prior to performing work and during weekly and “Tool Box” safety meetings as appropriate.

(1) AHA/JSA/JHA shall define the activities being performed and identify the work sequences, the specific anticipated hazards, site conditions, equipment, materials, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level of risk. AHA/JSA/JHA should indicate compliance with EM 385-1-1 personal protective equipment requirements (safety-toed work boots, safety glasses, gloves, hard hats, etc.), work crews of two or more must have two people currently qualified in first aid and CPR and the appropriate first aid kit on site. Single individuals working alone must have current certification in First Aid only.

(2) The names of the Competent Person(s) and Qualified Person(s) required for a particular activity (e.g., excavation, scaffolding, fall protection, or other activities as specified by OSHA and this manual) shall be identified and included in the AHA/JSA/JHA, as well as proof of their competency/qualification.

c. Accident/Mishap Reporting: The Contractor shall report all recordable mishaps to the GDA within 24-hours in accordance with EM 385-1-1 Section 01.D. Accidents shall be investigated to determine causal factors and corrective actions shall be implemented. Accidents resulting in: days away injuries, days away illnesses, restricted/transfer injuries, property damage of $5,000.00 or more shall be investigated and reported to the GDA using the USACE Accident Investigation Report Form ENG 3394 within 24 hours of the occurrence.

(1) Immediate notification to the GDA is required for all serious accidents:

a. Fatal Injury/illness;

b. Permanent totally disabling injury/illness;

c. Permanent partial disabling injury/illness;

d. One (1) or more persons hospitalized as inpatients as a result of a single occurrence;

e. $500,000 or greater accidental property damage;

f. Three (3) or more individuals become ill or have a medical condition suspected to be related to a site condition, or a hazardous or toxic agent on the site;

g. USACE aircraft destroyed or missing;

The Contractor shall maintain an OSHA Log of Work Related Injuries and Illnesses, OSHA Form 300 and comply with all accident reporting and recordkeeping requirements specified in 29 CFR 1904.39.

(2) In addition to the above, any mishap occurring in any of the following high hazard areas shall be reported immediately to the GDA, investigated and corrective actions implemented.

a. Electrical (includes Arc Flash, electrical shock, etc.);

b. Uncontrolled Release of Hazardous Energy (includes electrical and non-electrical);

c. Load Handling Equipment (LHE) or Rigging;

d. Fall-from-Height (any level or other than same surface);

e. Underwater Diving

9. Security Requirements: All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12). The Huntington District Security Management Office shall submit contractor(s) personal information in order to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee’s suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results provided by the Huntington District Security Management Office of the background investigation. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.

Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities. The Contractor must also provide the following:

(1) Name of the Contract Specialist with whom he/she is working,

(2) Project Name,

(3) Contract Number and

(4) Task Order Number when applicable.

The documents listed below are required:

SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form).

FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management office).

Contractor shall report any changes in personnel or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.

Following submission of paperwork, the Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, Security Management Office will make recommendations to the PCO or their Designated Representative.

The Security Management Office cannot give approval due to unfavorable report(s). The Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise Contractor of the decision.

FOREIGN NATIONALS

The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All Foreign Nationals must comply with the following paragraph:

In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.

In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Security Management Office. All Foreign National Visit Requests MUST be submitted to the Security Management Office 30 days in advance of the visit per Army Regulation 380-10, Foreign Disclosure and Contacts with Foreign

Representatives. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.

Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

AT/OPSEC Requirements: The following shall be accomplished by the contractor prior to the issuance of the Notice to Proceed:

(1) Access and General Protection/Security Policy and Procedures. All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office.

Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the Government may require changes in contractor security matters or processes.

(2) For contractors who do not require Common Access Card (CAC), but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.

(3) Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See Something, Say Something). The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the Contracting Officer NLT 5 calendar days after the completion of the training.

(4) Pre-screen candidates using E-Verify Program. The Contractor must prescreen candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the Contracting Officer no later than 3 business days after the initial contract award."

*When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

The invoice shall be on typed letterhead and shall include the Contract Number, Date, Contractor Name & Address, and the total amount of the awarded contract.

11. Pre-Construction Conference: The contractor shall attend a Pre-Construction Conference prior to the initiation of work under this contract. The Contractor’s Accident Prevention Plan and all contractor submittals (Special Contract Requirements) must be approved prior to this meeting.

12. Wage Rates: Davis-Bacon wage rates are applicable to this procurement and are attached to this solicitation in accordance with contract clause FAR 52.222-6.

13. Site Clean-Up: The contractor shall remove all equipment, trash, debris, and other materials from the site upon completion of work and dispose in accordance with state, local, and federal laws.

14. Deficiencies: If the contractor fails to perform, or if performance in any area is judged unsatisfactory, the Government will take corrective action. See FAR Clause 52.246-12.

BASIS FOR SETTLEMENT OF PROPOSALS (MAR 2009)

Actual costs will be used to determine equipment costs for a settlement proposal submitted on the total cost basis under Federal Acquisition Regulation (FAR) 49.206-2(b). In evaluating a termination settlement proposal using the total cost basis, the following principles will be applied to determine allowable equipment costs:

(a) Actual costs for each piece of equipment, or groups of similar serial or series equipment, need not be available in the contractor's accounting records to determine total actual equipment costs.

(b) If equipment costs have been allocated to a contract using predetermined rates, those charges will be adjusted to actual costs.

(c) Recorded job costs adjusted for unallowable expenses will be used to determine equipment operating expenses.

(d) Ownership costs (depreciation) will be determined using the contractor's depreciation schedule (subject to the provisions of Federal Acquisition Regulation (FAR) 31.205-11).

(e) License, taxes, storage and insurance costs are normally recovered as an indirect expense and unless the contractor charges these costs directly to contracts, they will be recovered through the indirect expense rate.

EQUIPMENT OWNERSHIP AND OPERATING EXPENSE SCHEDULE (MAR 1995)

(a) This clause does not apply to terminations. See UAI 5152.249-9000, Basis for Settlement of Proposals, and Federal Acquisition Regulation (FAR) part 49.

(b) Allowable costs for construction and marine plant and equipment in sound workable condition owned or controlled and furnished by a contractor or subcontractor at any tier shall be based on actual cost data for each piece of equipment or groups of similar serial and series for which the Government can determine both ownership and operating costs from the contractor's accounting records. When both ownership and operating costs cannot be determined for any piece of equipment or groups of similar serial or series equipment from the contractor's accounting records, costs for that equipment shall be based upon the applicable provisions of Engineer Pamphlet (EP) 1110-1-8, Construction Equipment Ownership and Operating Expense Schedule, Region II. Working conditions shall be considered to be average for determining equipment rates using the schedule unless specified otherwise by the contracting officer. For equipment not included in the schedule, rates for comparable pieces of equipment may be used or a rate may be developed using the formula provided in the schedule. For forward pricing, the schedule in effect at the time of negotiations shall apply. For retroactive pricing, the schedule in effect at the time the work was performed shall apply.

(c) Equipment rental costs are allowable, subject to the provisions of FAR 31.105(d)(ii) and FAR 31.205-36. Rates for equipment rented from an organization under common control, lease purchase arrangements, and sale-leaseback arrangements, will be determined using the schedule, except that actual rates will be used for equipment leased from an organization under common control that has an established practice of leasing the same or similar equipment to unaffiliated lessees.

(d) When actual equipment costs are proposed and the total amount of the pricing action exceeds the simplified acquisition threshold (SAT), the contracting officer shall request the contractor to submit either certified cost or pricing data, or partial/limited data, as appropriate. The data shall be submitted on Standard Form 1411, Contract Pricing Proposal Cover Sheet.

51512.236-9009 PARTNERING (FEB 2000)

In order to most effectively accomplish this contract, the Government proposes to form a partnership with the Contractor to develop a cohesive building team. It is anticipated that this partnership would involve the the Contractor, primary subcontractors and designers, and the US Army Corps of Engineers. This partnership would strive to develop a cooperative management team drawing on the strengths of each team member in an effort to achieve a quality project within budget and on schedule. This partnership would be bilateral in membership and participation will be completely voluntary. Any cost associated with effectuating this partnership, excluding travel and lodging cost of Government personnel, will be borne by each party. The partnering meetings, if needed, shall be held informally during the period of performance at Beech Fork Lake, Lavalette, WV; at the request of either the Contractor or the Government.

The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).

Union Rate Identifiers

A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example: PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.

Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.

Survey Rate Identifiers

Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. Survey wage rates are not updated and remain in effect until a new survey is conducted.

Union Average Rate Identifiers

Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.

A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
