The successful offeror will be required to submit this document upon award. The APP must be accepted by the Government Designated Authority prior to the preconstruction conference.
The contractor that receives this award will have 10 calendar days to provide an Accident Prevention Plan (APP). Section C - Descriptions and Specifications
SOW
Scope of Work Asphalt Sealing, Patching and Striping Yatesville Lake – Louisa, KY
1. General
These specifications cover the asphalt sealing, patching and striping at Yatesville Lake, Louisa KY from State route 1185 to the Intake Facilities. Exhibits 1-5 correspond to the items listed in the scope.
2. Scope of Work and Information
The contractor shall furnish all personnel, equipment, supplies, and materials necessary. Prices should be reflected in the Price Breakout Schedule.
All the materials removed from the government property shall be disposed of in accordance with state, local and federal laws.
Work shall consist of the following within the specified perimeter area referenced in Exhibit 1 through 5.
1. OFFICE PARKING AREA:
A. Contractor shall use the necessary power equipment to thoroughly clean and prep pavement consisting of approximately 48,000 SQ FT. Note that parking blocks will remain in place.
B. Fill approximately 1200 LF of hot pour crack filler. All cracks ¼” and larger are to be filled and will be designated by Government representative.
C. Mill sunken areas consisting of approximately 370 SQ FT., clean, apply tack coat, pave with 2” asphalt, compact and seal edges.
D. Apply 2 coats of Silica Tar Mac (Sealmaster), or equivalent, for a durable skid resistant surface.
E. Contractor is to layout and re-stripe parking lot as per existing labels, arrows and handi-cap parking areas.
2. ENTRANCE ROAD:
consisting of approximately 50,000 SQ FT.
B. Fill approximately 2000 LF of hot pour crack filler. All cracks ¼” and larger are to be filled and will be designated by Government representative.
C. Mill sunken areas consisting of approximately 1600 SQ FT., clean, apply tack coat, pave with 2” asphalt, compact and seal edges.
D. Apply 2 coats of Silica Tar Mac (Sealmaster), or equivalent, for a durable skid resistant surface.
E. Contractor is to layout and re-stripe roadway as per existing labeling.
3. OFFICE ROAD
consisting of approximately 60,000 SQ FT.
B. Fill approximately 2000 LF of hot pour crack filler. All cracks ¼” and larger are to be filled and will be designated by Government representative.
C. Saw-cut and remove approximately 170 SQ FT of broken pavement and replace with 4” asphalt compact and seal edges.
D. Apply 2 coats of Silica Tar Mac (Sealmaster), or equivalent, for a durable
E. Contractor is to layout and re-stripe roadway as per existing labeling.
4. DAM ROAD
consisting of approximately 44,000 SQ FT.
B. Fill approximately 1900 LF of hot pour crack filler. All cracks ¼” and larger are to be filled and will be designated by Government representative.
C. Apply 2 coats of Silica Tar Mac (Sealmaster), or equivalent, for a durable
D. Contractor is to layout and re-stripe roadway and parking area as per existing labeling.
5. DOWNSTREAM ROAD
consisting of approximately 78,000 SQ FT.
B. Fill approximately 3000 LF of hot pour crack filler. All cracks ¼” and larger are to be filled and will be designated by Government representative.
C. Mill sunken areas consisting of approximately 1350 SQ FT., clean, apply tack coat, pave with 2” asphalt, compact and seal edges.
D. Apply 2 coats of Silica Tar Mac (Sealmaster), or equivalent, for a durable skid resistant surface.
E. Contractor is to layout and re-stripe roadway and parking area as per existing labeling.
3. Hours of Operation
Working Hours: Government and Contractor shall agree upon working days and hours to reduce the amount of closures and/or delays during normal business hours. Normal business hours are Monday- Friday 0730-1600 Eastern Standard Time (EST). Work may continue outside these times with permission from the onsite government representative. All work shall be performed during daylight hours. Delay of work may occur during excessive rainfall or wet periods due to access to the site.
4. Federal Holidays:
When one of the designated holidays falls on a Sunday the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work that interferes with other ongoing functions at the project shall be scheduled around normal working hours to be approved by Project Manager. Work shall be scheduled around the above listed Federal holidays unless approved in advance.
Ten Federal holidays observed are as follows:
New Years Day (January 1st) Martin Luther King Day (3rd Monday in January) President’s Day (3rd Monday in February) Memorial Day (Last Monday in May) Independence Day (July 4th) Labor Day (1st Monday in September) Columbus Day (2nd Monday in October) Veterans Day (November 11th) Thanksgiving (Last Thursday in November) Christmas (December 25th)
5. Access to Work Location
Access to main work location shall be through the main road of the park. Project personnel will open gate to compound each work morning at 07:30 A.M. EST and lock gate at the end of each work day at 4:00 P.M. EST dependent on work hours scheduled by Government and Contractor.
6. Contractor and Government Equipment and Supplies
The contractor shall furnish all personnel, equipment, transportation, disposal, supplies and materials to perform the work. No U.S. Government owned equipment or supplies shall be used for this project.
7. Period of Performance: Work must begin within (7) calendar days after contractor receives Notice to Proceed and be completed within thirty (30) calendar days after contractor receives Notice to Proceed. Adjustments will be made only for circumstances deemed to be beyond the contractor’s control.
8. Contractor Safety Requirements
General: If the Contractor fails or refuses to promptly comply with safety and security requirements as specified herein, any project employee may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such work stoppage shall be made subject to any claims for extension of time or for excess costs or damages sustained by the Contractor. Also, the Contractor will not be paid for work not performed as a result of the stop order.
9. Contractor Accident Prevention Plan (APP). The Contractor shall prepare a site-specific Accident Prevention Plan following the outline provided in EM 385-1-1, Appendix A as a minimum. The contractor shall address each element and sub-element in the outline in the order they appear in Appendix A. Any item from the outline that does not apply must be listed, in its assigned place and a brief explanation of the reason it is not required/provided. The APP shall address any unusual or unique aspects of the project or activity. This plan must be accepted by the Contracting Officer prior to commencement of any work. Contractors are encouraged to contact the USACE Safety & Occupational Health Office for questions or information regarding the development of contract Accident Prevention Plans. (1) The contractor shall have on site an employee designated as a Site Safety and Health Officer who has completed the OSHA 30-hour Construction Safety training or its equivalent as specified in EM 385-1-1, Appendix A, paragraph 4 and two people at each work location with current certification in First Aid and CPR as specified in Section 3 of EM 385-1-1.
(2) 16.B.01 Cranes and hoisting equipment shall be operated only by qualified personnel (operators licensing, physical and drug testing in accordance with EM 385-1-1 Section 16). Effective November 8, 2010 all “Signalpersons” and “Riggers” shall be qualified. This is a mandatory requirement in accordance with 29 CFR
1926.1400 Regulations. Riggers must be a qualified person for the performance of specified hoisting activities such as during assembly/disassembly, in accordance with OSHA 1926.1404(r)(1) and 1926.1425(c)(3).
10. Activity Hazard Analysis (AHA). The Contractor shall prepare and use an AHA (Attached) as one of many tools to insure safe performance of work. It is the Contractor's responsibility to prepare the AHA. The AHA shall be reviewed and accepted by the on-site government representative prior to commencement of work. All on-site employees shall review the approved AHA prior to performing work at the site.
a. AHAs shall define the activities being performed and identify the work sequences, the specific anticipated hazards, site conditions, equipment, materials, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level of risk.

b. Work shall not begin until the AHA for the work activity has been accepted by the Government Designated Authority (GDA) and discussed with all engaged in the activity, including the Contractor, subcontractor(s), and Government on-site representatives at preparatory and initial control phase meetings.
c. The names of the Competent/Qualified Person(s) required for a particular activity (for example, electrical, excavations, scaffolding, fall protection, other activities as specified by OSHA and this manual) shall be identified and included in the AHA. Proof of their competency/qualification shall be submitted to the GDA for acceptance prior to the start of that work activity.
d. The AHA shall be reviewed and modified as necessary to address changing site conditions, operations, or change of competent/qualified person(s).
(1) If more than one Competent/Qualified Person is used on the AHA activity, a list of names shall be submitted as an attachment to the AHA. Those listed must be Competent/Qualified for the type of work involved in the AHA and familiar with current site safety issues.
(2) If a new Competent/Qualified Person (not on the original list) is added, the list shall be updated (an administrative action not requiring an updated AHA). The new person shall acknowledge in writing that he or she has reviewed the AHA and is familiar with current site safety issues.
11. On-site Public Safety. Work on this contract is immediately adjacent to public recreation facilities. Safety precautions to warn and limit public access shall be addressed in both the APP and AHA.
12. Damage Reports: All instances where Government materials supplies, property, and/or equipment are damaged shall be reported immediately to the Resource Manager.
13. Accident Reporting: The Contractor shall maintain an accurate record of ENG Form 3394, and report to the Resource Manager all accidents within 24 hours of the occurrence. All serious accidents (those resulting in death or injury requiring medical attention) shall be reported immediately. The Contractor shall maintain an OSHA Log of Work Related Injuries and Illnesses, OSHA Form 300.
14. Minimum Personal Protective Equipment: Long pants, safety toe shoes/boots, and shirt with minimum 4 inch sleeve, hard hat and safety glasses.
15. Pre-Construction Conference: The Contractor shall attend a pre-construction conference, prior to the initiation of work under this contract. The Contractors Safety Plan must be approved prior to this meeting.
16. SECURITY REQUIREMENTS: All Contractors and subcontractor employee(s) working on this contract who require access in and/or around any Huntington District facilities shall receive authorization to be on site at these facilities based upon a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD 12).
The Huntington District Security Management Office shall submit contractor(s) personal information in order to complete the basic background investigation in order to make a recommendation to the Contracting Office of an employee’s suitability for work on Government property. The Procuring Contracting Officer (PCO) has the right to deny any contractor or subcontractor employee from working on the contract based upon the results provided by the Huntington District Security Management Office of the background investigation. The Government, Contractor, and subcontractors shall not permit any employee(s) access to drawings, blueprints, records, photos, sites, or projects until the Huntington District Security Management Office has completed an Operations Security (OPSEC) review of such items and determined they can be released.
Contractors shall submit a complete investigation packet for each contractor and subcontractor employee to the Huntington District Security Management office within 10 working days after award of any contract, or prior to the individual being permitted unescorted access in or on District facilities. The Contractor must also provide the following: (1) Name of the Contract Specialist with whom he/she is working, (2) Project Name, (3) Contract Number and (4) Task Order Number when applicable.
The documents listed below are required:
SF 85, Questionnaire for Non-Sensitive Positions (see http://www.opm.gov/forms/ to print form). FD 258, Contractor Fingerprint Card (one card for digital prints, two for ink prints) (NOTE: a trained/qualified individual must take prints, ORI block on the FD 258 must be USOPM000Z) (Contractor Fingerprint Cards (FD-258) may be obtained by Contracting Division by contacting the Huntington District Security Management office).
Contractor shall report any changes in personnel or at any time conditions change at least 5 working days prior to individual(s) need to have access to the site. The Contractor shall provide the same information as listed above for all new employees.
Following submission of paperwork, the Security Management Office will conduct an initial criminal check based upon the information provided. If there are no issues, Security Management Office will make recommendations to the PCO or their Designated Representative. The Security Management Office cannot give approval due to unfavorable report(s). The Security Management Office shall coordinate with Office of Counsel and will jointly make recommendations to the PCO and/or the Designated Representative should a background investigation come back with derrogatory information. The PCO will make the determination whether to allow the Contractor personnel to work on the site based on Security and Office of Counsel recommendations, and the PCO will advise Contractor of the decision.
FOREIGN NATIONALS
The Contractor shall provide the package listed above, as well as additional materials noted below for all Foreign Nationals. The Contractor is to expect additional time in the approval process for all Foreign Nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All Foreign Nationals must comply with the following paragraph:
In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subcontractor employees. The Contractor shall submit to the Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N-561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc.
In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the contractor / subcontractor from beginning work.
Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract.

17. AT/OPSEC Requirements: The following shall be accomplished by the contractor before any work will be ordered:
AT Level I Training. All contractor employees, to include subcontractor employees, requiring access to Army installations, facilities and controlled access areas shall complete AT Level I awareness training within thirty (30) calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the COR or to the contracting officer, if a COR is not assigned, within five (5) calendar days after completion of training by http://www.opm.gov/forms/ mailto:stephen.r.curry@usace.army.mil mailto:matthew.d.green@usace.army.mil mailto:Sandra.L.Hardwick@usace.army.mil all employees and subcontractor personnel. AT Level I awareness training is available at the following website: https://atlevel1.dtic.mil/at/; or it can be provided by the RA ATO in presentation form which will be documented via memorandum.
Access and General Protection/Security Policy and Procedures. All Contractor and all associated sub‐ contractors employees shall comply with applicable installation, facility, and area commander installation/facility access and local security policies and procedures (provided by government representative). The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services, or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
For contractors requiring Common Access Card (CAC). Before CAC issuance, the contractor employee requires, at a minimum, a favorably adjudicated National Agency Check with Inquiries (NACI) or an equivalent or higher investigation in accordance with Army Directive 2014-05 and Homeland Security Presidential Directive-12 (HSPD-12). Proposed language: “The contractor and all sub-contractors employees will be issued a CAC only if duties involve one of the following: (1) Both physical access to a DoD facility and access, via logon, to DoD networks on-site or remotely; (2) Remote access, via logon, to a DoD network using DoD-approved remote access procedures; or (3) Physical access to multiple DoD facilities or multiple non-DoD federally controlled facilities on behalf of the DoD on a recurring basis for a period of 6 months or more. At the discretion of the sponsoring activity, an interim CAC may be issued based on a favorable review of the FBI fingerprint check and a successfully scheduled NACI at the Office of Personnel Management.
For Contracts that Require OPSEC Training. All new contractor employees will complete Level I OPSEC Training within 30 calendar days of their reporting for duty. Pre-screen candidates using E-Verify Program. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of "identifiers" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than "SU" or "UAVG" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the "SU" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.

52.204-13 SYSTEM FOR AWARD MANAGEMENT MAINTENANCE (OCT 2016)
(a) Definitions. As used in this clause--
Electronic Funds Transfer (EFT) indicator means a four-character suffix to the unique entity identifier. The suffix is assigned at the discretion of the commercial, nonprofit, or Government entity to establish additional System for Award Management (SAM) records for identifying alternative EFT accounts (see subpart 32.11) for the same entity.
Registered in the System for Award Management (SAM) database means that--
(1) The Contractor has entered all mandatory information, including the unique entity identifier and the EFT indicator (if applicable), the Commercial and Government Entity (CAGE) code, as well as data required by the Federal Funding Accountability and Transparency Act of 2006 (see subpart 4.14), into the SAM database;
(2) The Contractor has completed the Core, Assertions, Representations and Certifications, and Points of Contact sections of the registration in the SAM database;
(3) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS). The Contractor will be required to provide consent for TIN validation to the Government as a part of the SAM registration process; and
(4) The Government has marked the record ``Active''.
System for Award Management (SAM) means the primary Government repository for prospective Federal awardee and Federal awardee information and the centralized Government system for certain contracting, grants, and other assistance-related processes. It includes—
(1) Data collected from prospective Federal awardees required for the conduct of business with the Government;
(2) Prospective contractor-submitted annual representations and certifications in accordance with FAR subpart 4.12;
and
(3) Identification of those parties excluded from receiving Federal contracts, certain subcontracts, and certain types of Federal financial and non-financial assistance and benefits.
Unique entity identifier means a number or other identifier used to identify a specific commercial, nonprofit, or Government entity.
