Per FAR 36.204 the estimated price range for this project is between $100,000.00 and $250,000.00.
NOTE 1: In accordance with FAR Part 28.102-1(b)(1), the Contractor will be required to provide one of the following payment protections for all construction contracts greater than $35,000.00 but not greater than $150,000.00.
(i) Payment bond
(ii) Irrevocable letter of credit
A Payment Bond or Irrecovable Letter of Credit is the SELECTED payment protection for the Government. The penal amount of bond shall be 100% of the original contract price. If the contract price increases, the Government will require an increase in the penal sum of the existing bond. This bond shall be submitted to the Contracting Officer within 10 days after receipt of award.
The payment made under this provision shall not exceed the amount included for Bid Item 0001 of the bid schedule, which payment shall take into consideration any discounts or rebates to the Contractor from the Surety.
FURTHERMORE, THE GOVERNMENT SHALL ONLY REIMBURSE THE CONTRACTOR THE ACTUAL
AMOUNT PAID TO THE SURETY COMPANY FOR PAYMENT BONDS, LESS ANY DISCOUNTS OR
REBATES. AN INVOICE FROM THE SURETY SHALL BE PROVIDED BEFORE PAYMENT IS MADE.
CONTRACTORS ARE ADVISED THAT BID ITEM 0001 IS ONLY FOR THE COST OF BONDS. OTHER
COSTS SHOULD BE ALLOCATED TO THE REMAINING BID ITEM(S).
NOTE 2: The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following technical factors may be used in evaluating offers and are of equal importance:
Experience in the work required (if work is to be performed by a subcontractor, provide the name and necessary credentials, See FAR Clause 52.222-11), capability to perform the work, past performance and schedule control.
Technical factors are significantly more important than price.

6. Contractors shall provide completed FAR clause 52.204-8 (Annual Representations and Certifications) found in Section K of this solicitation with their quote, if the Contractors have not completed their annual representations and certifications electronically via the SAM website at www.sam.gov. (See Paragraph 2 above)
7. Contractors are not required to submit an Accident Prevention Plan (APP) with their quote. The successful offeror will be required to submit this document upon award. The APP must be accepted by the Government Designated Authority prior to the preconstruction conference. EXAMPLES of the APP may be found at http://www.lrh.usace.army.mil/CT under the General Contracting Information heading.
The contractor that receives this award will have 10 calendar days to provide an Accident Prevention Plan (APP). If this deadline is not met, the contractor will be given a cure notice stating that they will have 10 calendar days to cure their non-performance. The contractor will have a total of 30 calendar days from date of award to provide an acceptable APP, otherwise the contract will be terminated for cause.
Section C - Descriptions and Specifications
SCOPE OF WORK
Scope of Work
Asphalt Paving, Patching, and Striping Sutton Lake
GENERAL
The Contractor shall furnish all necessary management, personnel, materials, supplies, tools, equipment, fuel, and vehicles, except as otherwise provided herein, required to perform asphalt paving, patching, and striping at Sutton Lake, as specified and in strict accordance with all Terms, Conditions, General, Specific and Technical Provisions, Drawings, Attachments, Exhibits, etc., contained herein or incorporated by reference. Award of a contract does not guarantee that the Government will order all of the work listed under the contract from the Contractor. The Government reserves the right to perform any portion of the services listed.
The quantities listed in the Price Schedule are provided as information only to assist in preparation of prices. They are not guaranteed and the actual quantities may be less than shown. Variation in these estimated quantities shall not be justification for modification of the contract or request for additional payment.
Contractor's work and responsibility shall include, but shall not be limited to, all planning, programming, administration and management necessary to assure that all work performed is conducted in accordance with the contract and all applicable laws, regulations, codes, or directives. Contractor shall ensure that all work meets or exceeds critical reliability rates or tolerances specified or included in referenced documents. The Contractor shall perform all related Contractor administrative services necessary to perform the work such as supply, procurement, quality control, Contractor financial control, and maintenance of accurate and complete records and files.
All work shall be done in a professional manner in accordance with industry standards, this Scope of Work, all applicable codes and practices common to the trade, and applicable provisions of the State of West Virginia, Department of Highways - "Standard Specifications Roads and Bridges," the latest version, available at:

Quantities are estimated. Prospective quoters are encouraged to visit the work sites to verify actual quantities.
Award of a contract does not guarantee that the Government will award all of the work listed below to the Contractor. Price Item 0001 is the Base Work. Price items 0002 through 0006 are Option Items that will be exercised at the time of award at the discretion of the Government. (See FAR Clause 52.217-4)
* Should the Government be unable to issue Notice To Proceed prior to the end of the paving season, the contractor will be required to perform the work at the awarded price in the spring once the batch plant is open and weather permits the work to be done.
Prior coordination with the respective Resource Manager is required to minimize impacts to the park users and project personnel.

WORK TO BE PERFORMED
The following work shall be performed:
Price Item 0001. Lower Gerald R. Freeman Launch Ramp Road and Turning Area.
Install minimum of 1.5 inches (compacted thickness) of overlay wearing course asphalt at the designated area in Lower Gerald R. Freeman Campground in accordance with the applicable requirements of Section 401.
Roadway and Turning Area shall be graded and have a minimum 2” base of compacted crusher run stone. The stone base shall be topped with a minimum 2.5” inches (compacted thickness) of base asphalt and 1.5 inches (compacted thickness) of wearing course asphalt.
Existing pavement shall be milled to blend with existing parking lot. Milling shall be done in accordance with the SURFACE PREPARATION specification. Millings shall be piled at a designated location near the work area.
The Turning area is roughly circular and covers 4000 square feet. The Roadway is approximately 440 feet long and shall be paved 18 feet wide. The total quantity for this area is approximately 11,920 square feet.
Dimensions are in Exhibit A and the area is shown in Exhibit B.
Price Item 0002 (Option 1). Lower Gerald R. Freeman Campsites 132 – 139 and Roadway. Install minimum of 1.5 inches (compacted thickness) of overlay wearing course asphalt at the designated area in Lower Gerald R. Freeman Campground in accordance with the applicable requirements of Section 401.
New blacktop shall be placed and compacted on the existing Roadway and sites 132 –
136. The roadway is approximately 620’ long and 18’ wide. Campsites are 12’ wide and between 46’ and 66’ long. Individual dimensions are shown in Exhibit B.
Sites 137, 138 and 139 shall be graded and have a minimum 2.5” inches (compacted thickness) of base asphalt and 1.5 inches (compacted thickness) of wearing course asphalt. The entrance and exit to each site shall have a 3’ flare on the left side.
There is approximately 250 square feet of repair that shall be completed in accordance with the Base Failure specification. Milling shall be performed by the Contractor in the areas where the new blacktop ends.
Dimensions are in Exhibit A and the area is shown in Exhibit B.
Price Item 0003 (Option 2). Lower Gerald R. Freeman Campground Roadway and Parking Lots between Launch Ramp Road and Stone Bridge. Install minimum of 1.5 inches (compacted thickness) of overlay wearing course asphalt at the designated area in Lower Gerald R. Freeman Campground in accordance with the applicable requirements of Section 401.
New blacktop shall be placed and compacted on the existing Roadway. The roadway is approximately 560’ long and 16’ wide. At the intersection with the road near site 139, there is approximately 1000 sq. ft. of un-paved road. Crusher run stone shall be graded and the stone base shall be topped with a minimum 2.5” inches (compacted thickness) of base asphalt and 1.5 inches (compacted thickness) of wearing course asphalt.
Dimensions are in Exhibit A and the area is shown in Exhibit B.
Price Item 0004 (Option 3). Berm Work for Paving in Item 0001. Place and compact crusher run stone along all edges of new pavement not adjoining other pavement or concrete. Stone shall extend 2 feet from pavement and shall be level with the pavement and blended into adjoining surface.
Price Item 0005 (Option 4). Berm Work for Paving in Item 0002. Place and compact crusher run stone along all edges of new pavement not adjoining other pavement or concrete.
On Campsites 132 – 136, stone shall be placed and extend 8 feet from right edge of the pavement, towards the electrical pedestal. Stone shall be level with the pavement and blended into adjoining surface.
On Campsites 137– 139, stone shall be placed and extend 8 feet from right edge of the pavement, away from the electrical pedestal. Stone shall be level with the pavement and blended into adjoining surface.
Between Campsites 132 and 136, stone shall be placed and extend 8 feet from right edge of the pavement, towards the creek. Stone shall be level with the pavement and blended into adjoining surface. Approximately 270 feet.
Between Campsites 137 and 139, stone shall be placed and extend 8 feet from left edge of the pavement, towards the creek. Stone shall be level with the pavement and blended into adjoining surface. Approximately 100 feet.
Along all other edges of new pavement, Stone shall extend 2 feet from pavement and shall be level with the pavement and blended into adjoining surface.
Price Item 0006 (Option 5). Berm Work for Paving in Item 0003. Place and compact crusher run stone along all edges of new pavement not adjoining other pavement or concrete.
On Campsite 140, stone shall be placed and extend 8 feet from right edge of the pavement, towards the electrical pedestal. Stone shall be level with the pavement and blended into adjoining surface.
On Campsites 137– 139, stone shall be placed and extend 8 feet from right edge of the pavement, away from the electrical pedestal. Stone shall be level with the pavement and blended into adjoining surface.
Along all other edges of new pavement, Stone shall extend 2 feet from pavement and shall be level with the pavement and blended into adjoining surface.
ASPHALT PATCHING AND REPAIR REQUIREMENT
Base Failure or No Base: In areas where the asphalt base has failed, and in road-cut areas where no base exists, the Contractor shall remove the asphalt, stone or soil, provide and compact an adequate base, and re-pave with minimum 2.5 inches of base asphalt and 1.5 inches of wearing course asphalt. Contractor shall tack coat vertical surfaces to ensure bondage to existing asphalt. Repaired areas shall be properly compacted so that traffic does not further compress the patched areas.
ASPHALT PAVING REQUIREMENT
Surface Preparation: The Contractor shall clean existing pavement surfaces immediately prior to paving by sweeping or flushing well with water or a combination of both. Contractor shall ensure that the surface is free of dust, dirt, grease, vegetation, oil, standing water or any type of objectionable surface film. The Contractor shall remove oil or grease that has not penetrated the asphalt pavement by scraping or by scrubbing with a detergent and washing thoroughly with clean water. After cleaning, these areas shall be treated with an oil spot primer.
Milling shall be performed by the Contractor in the areas where old asphalt roadways intersect the new surface overlay. The Contractor shall mill the areas to a minimum depth of 2 inches to accommodate a smooth transition with the new pavement.
The Contractor shall apply a tack coat of emulsified asphalt or equivalent. Immediately prior to paving, the tack coat shall be applied to the clean surface at a rate of 0.10 to
0.20 gallons per square yard. Pools of primer material remaining on the surface after application shall be removed. All traffic not essential to the work shall be kept off the tack coat. Care shall be taken when applying the tack coat to prohibit the spray from adhering to any objects other than the surface to be paved. The Contractor shall be responsible for removing over-spray tack coat. The Contractor shall apply the tack coat only to the areas he/she will resurface each day.
Materials: Overlay wearing course asphalt shall be plant-mixed 64/22 Mix Dense-graded Asphalt or equivalent, having a small Nominal Maximum Aggregate Size (NMAS) of #8 or less. The aggregate shall be skid resistant.
Base course asphalt shall be used for the repaired areas. Base shall be a plant-mixed asphalt equivalent to the industry standard for West Virginia – plant mix type
Base 2 aggregate or equivalent.
Application: Asphalt courses shall be spread and struck off with a paver. Any irregularities in the surface of the pavement course shall be corrected directly behind the paver. Excess material forming high spots shall be removed with a shovel or lute.
Indented areas shall be filled with hot mix and smoothed; casting of mix over such areas shall not be permitted.
Paving operations shall be as continuous as possible. The Contractor shall arrange paving to provide hot joints wherever possible. Where it is necessary to leave a cold joint, the edge shall be squared vertically and horizontally and compacted. When matching a cold joint, the Contractor shall paint the joint with emulsion prior to paving.
Areas where it is impractical to use a paver or spread box, asphalt surface courses may be spread and finished by hand. Wood or steel forms, rigidly supported to assure correct grade and cross section, may be used. Placing by hand shall be performed carefully to avoid segregation of the mix. Broadcasting of the material shall not be permitted. Any lumps that do not break down readily shall be removed.
The Contractor shall maintain existing crown and slope and ensure that final grade properly drains surface water.
Compaction: The Contractor shall utilize rolling equipment of adequate size and weight, and begin rolling as soon as the hot mix material can be compacted without displacement. Rolling shall continue until thoroughly compacted and all roller marks have been worked out. In areas too small for roller, a vibrating compactor or hand tamper shall be used to achieve thorough compaction.
HOURS OF OPERATION
Working Hours are from 0730-1600 hours Monday through Friday. Work may continue outside these times with permission from the onsite government representative. All work shall be performed during daylight hours.
FEDERAL HOLIDAYS
When one of the designated holidays falls on a Sunday the following Monday is observed as a legal holiday. When a legal holiday falls on a Saturday, the preceding Friday is observed as a holiday. Work that interferes with other ongoing functions at the project shall be scheduled around normal working hours to be approved by the respective Resource Manager. Work shall be scheduled around the above listed Federal holidays unless approved in advance. Ten Federal holidays observed are as follows:

ACCESS TO WORK LOCATION
Access to the work locations shall be coordinated with the respective Resource Manager. Gate keys will be issued to the Contractor for areas that are locked. The recreation areas will be closed to public access during this work. The Contractor shall ensure that access is provided to Corps of Engineers personnel travelling through work areas and shall coordinate access issues with the onsite government representative well in advance.

The Contractor shall attend a pre-construction conference, prior to the initiation of work under this contract The Contractor’s Accident Prevention Plan and all contractors submittals must be accepted prior to this meeting.
WAGE RATES.
In accordance with contract clause FAR 52.222-6, Davis-Bacon wage rates are applicable to this procurement and can be located at http://www.dol.gov. Applicable wage rates for this procurement are: General Decision number WV160080 01/08/2016

Contractor Accident Prevention Plan (APP).
A. General. Contractor shall comply with all Federal, State and Local safety requirements including those specified by the Occupational Safety and Health Act (OSHA) in 29 CRF 1910 General Industry Standard, 1926 Construction Standard and the U.S. Army Corps of Engineers Safety & Health Requirements Manual EM 385-1-1 as currently revised. Where a conflict exists between safety standards/requirements the contractor shall comply with the more stringent requirement. If the Contractor fails or refuses to promptly comply with safety and security requirements as specified herein, any project employee may stop all or part of the work until satisfactory corrective action has been taken. No part of the time lost due to any such work stoppage shall be made subject to any claims for extension of time or for excess costs or damages sustained by the Contractor. Also, the Contractor will not be paid for work not performed as a result of the stop order.
B. Contractor Accident Prevention Plan (APP). The Contractor shall prepare a site-specific Accident Prevention Plan following the outline provided in EM 385-1-1, Appendix A as a minimum. The contractor shall address each element and sub-element in the outline in the order they appear in Appendix A. Any item from the outline that does not apply must be listed, in its assigned place and a brief explanation of the reason it is not required/provided. The APP shall address any unusual or unique aspects of the project or activity. This plan must be accepted by the Contracting Officer prior to commencement of any work. Contractors are encouraged to contact the USACE Safety & Occupational Health Office for questions or information regarding the development of contract Accident Prevention Plans. (1) The contractor shall have on site an employee designated as a Site Safety and Health Officer (SSHO) who has completed the OSHA 30-hour Construction Safety training or its equivalent as specified in EM 385-1-1, 01.A.17 and has at least five years experience relative to the work to be performed. No work will be permitted unless the SSHO is present at the work site.
(2) For task orders limited to routine mowing, cleaning and janitorial work SSHO responsibilities may be a collateral duty. Contractor may also elect to use an SSHO with either OSHA 30-hour Construction or General Industry qualifications.
(3) Work crews of two or more must have two people holding current certification in First Aid and CPR from the American Red Cross, American Heart Association or a licensed physician. Training must include a hands-on component that cannot be taken online and the contractor must maintain appropriate First Aid kit on site. Single individuals working alone must have current certification in First Aid as a minimum.
(4) All work that potentially exposes the worker to falls of six feet or more will require the contractor to submit a Site Specific Fall Protection & Prevention Plan in accordance with EM 385-1-1, Section 21.D.
(5) Cranes and hoisting equipment shall be operated only by qualified personnel (operators licensing, physical and drug testing in accordance with EM 385-1-1 Section 16.B). Note: CDL Medical Clearance is not acceptable. Please see attached medical clearance requirements.
(6) Effective November 8, 2010 all “Signalpersons” and “Riggers” shall be qualified.
This is a mandatory requirement in accordance with 29 CFR 1926.1400 Regulations.
Riggers must be a qualified person for the performance of specified hoisting activities such as during assembly/disassembly, in accordance with OSHA 1926.1404(r)(1) and 1926.1425(c)(3).
(7) Work orders involving potential exposure to Hazardous, Toxic or Radiological Waste shall require development of Site Specific Safety and Health Plan (SSHP) by qualified personnel as specified in EM 385-1-1 Sections 6 and 33.
C. Risk Management Process. The Contractor shall utilize risk management tools such as Activity Hazard Analysis (AHA), Job Hazard Analyses (JHAs), Job Safety Analyses (JSAs) or similar tools to identify, assess, prioritize risks and develop controls to minimize, monitor and control the probability and/or impact of unfortunate events to an acceptable level. Within each major phase, all activities, tasks or Definable Features of Work (DFOWs) shall be identified that will require an AHA/JSA/JHA. For each work activity, task or DFOW contractor shall prepare the initial AHA/JSA/JHA. A Risk Assessment Code (RAC) is assigned to each step, to the risk that remains after controls have been applied (residual risk) a final RAC (cannot be lower than the highest step RAC) shall be assigned. See EM 385-1-1 Section 01.A.14.b. for further guidance or contact the SOHO for assistance. The AHA/JSA/JHA shall be reviewed and accepted by the proper authority in order to proceed with the activity. All on-site employees shall review the accepted AHA/JSA/JHA prior to performing work and during weekly and “Tool Box” safety meetings as appropriate.
1. AHA/JSA/JHA shall define the activities being performed and identify the work sequences, the specific anticipated hazards, site conditions, equipment, materials, and the control measures to be implemented to eliminate or reduce each hazard to an acceptable level of risk. AHA/JSA/JHA should indicate compliance with EM 385-1-1 personal protective equipment requirements (safety-toed work boots, safety glasses, gloves, hard hats, etc.), work crews of two or more must have two people currently qualified in first aid and CPR and the appropriate first aid kit on site. Single individuals working alone must have current certification in First Aid only.
2. The names of the Competent Person(s) and Qualified Person(s) required for a particular activity (e.g., excavation, scaffolding, fall protection, or other activities as specified by OSHA and this manual) shall be identified and included in the AHA/JSA/JHA, as well as proof of their competency/qualification.
D. Accident/Mishap Reporting: The Contractor shall report all recordable mishaps to the GDA within 24-hours in accordance with EM 385-1-1 Section 01.D.
Accidents shall be investigated to determine causal factors and corrective actions shall be implemented. Accidents resulting in: days away injuries, days away illnesses, restricted/transfer injuries, property damage of $5,000.00 or more shall be investigated and reported to the GDA using the USACE Accident Investigation Report Form ENG 3394 within 24 hours of the occurrence.
(1) Immediate notification to the GDA is required for all serious accidents:
a. Fatal Injury/illness;
b. Permanent totally disabling injury/illness;
c. Permanent partial disabling injury/illness;
d. One (1) or more persons hospitalized as inpatients as a result of a single occurrence;
e. $500,000 or greater accidental property damage;
f. Three (3) or more individuals become ill or have a medical condition suspected to be related to a site condition, or a hazardous or toxic agent on the site;
g. USACE aircraft destroyed or missing;
The Contractor shall maintain an OSHA Log of Work Related Injuries and Illnesses, OSHA Form 300 and comply with all accident reporting and recordkeeping requirements specified in 29 CFR 1904.39.
(2) In addition to the above, any mishap occurring in any of the following high hazard areas shall be reported immediately to the GDA, investigated and corrective actions implemented.
a. Electrical (includes Arc Flash, electrical shock, etc.);
b. Uncontrolled Release of Hazardous Energy (includes electrical and non-electrical);
c. Load Handling Equipment (LHE) or Rigging;
d. Fall-from-Height (any level or other than same surface);
e. Underwater Diving
SECURITY REQUIREMENTS
Security Requirements. All Contractor and subContractor employees working on this contract who require access in or around Huntington District facilities (i.e. flood control dams plants, navigation locks, etc.) shall receive a favorable background investigation in accordance with “Homeland Security Presidential Directive 12: Policy for a Common Identification Standard for Federal Employees and Contractors” (HSPD- 12). The Huntington District Security Management Office (SMO) will complete the background investigation and make the final determination of an employee’s suitability for work on Government property. The SMO and has the right to deny any Contractor or subContractor employee from working on a contract based on results of the background investigation. The Government, Contractor, and sub-Contractors shall not permit any employee access to drawings, records, photos, sites, or projects until the Huntington District Security Management Office has approved them. The Contractor is responsible for meeting this requirement. Contractor’s failure to adhere to this can result in penalties, fines, or sanctions up to and including contract termination and or forfeiture of future contract consideration.
Contractors shall submit a complete investigation package for each Contractor and subContractor employee to the Huntington District Security Management Office within ten (10) working days after award of any contract, OR prior to the individual being permitted unescorted access in or around all District facilities. The documents listed below are required:

Contractor shall report any change(s) in personnel at least 5 working days prior to individual(s) needing access to the site. The Contractor shall provide the same information as listed above for any new employees.
Following submission of paperwork the Huntington District Security Management Office will conduct an initial criminal check based on the information provided. If there are no issues, SMO will provide approval via email to the Contractor and the Contracting Officer or their Designated Representative. If the SMO cannot give approval due to unfavorable report(s), it will notify the Contracting Officer and the Designated Representative; the KO will contact the Contractor. The Government will not provide a reason for disapproval; it will be up to the Contractor and or its employee to investigate the employee’s background information.
Foreign Nationals. The Contractor shall provide the package listed above, as well as additional materials noted below, for all non-U.S. citizens who have lived in the United States for at least three years. The Contractor is to expect additional time in the approval process for all foreign nationals due to the level of review and elevation of the review to Headquarters Staff to accomplish. All non- U.S. citizens, including permanent residents, must comply with the following paragraph:
In accordance with Engineering Regulation 380-1-18, “Technology Transfer, Disclosure of Information and Contacts with Foreign Representatives” dated 1 August 1996, Section 4, all foreign nationals who work on Corps of Engineers’ contracts shall be approved by the Headquarters US Army Corps of Engineers (HQ USACE) Foreign Disclosure Officer before beginning work on this contract; this regulation includes subContractor employees. The Contractor shall submit to the Huntington District Security Management Office, the names of all foreign nationals proposed for performance under this contract, along with documentation to verify legal admittance into the United States, and has authority to work and/or attend school in the U.S. Such documentation shall include at least one of the following a U.S. passport, Certificate of U.S. Citizenship (INS Form N-560 or N- 561), Certificate of Naturalization (INS Form N-550 or N-570), Alien Registration Card with photograph (INS Form I-151 or I-551), Employment Authorization Card (INS Form I-688A), etc. A cleared federal employee shall escort foreign nationals at all times unless otherwise approved in writing by the Huntington District Security Management Office.
In order to assure forms are properly completed, and to minimize time delays, Contractor is encouraged to work closely with the Huntington District Security Management Office. The Government will return for correction incomplete forms, illegible forms, etc. which will delay the Contractor/subContractor from beginning work. No subContractor shall submit forms directly to the Huntington District Security Management Office; these documents shall come through the Prime Contractor.
Security requirements are subject to change in accordance with HSPD-12, Office of Personnel Management, regulation or policy changes, etc. The Government shall add any changes to security requirements by modification to the contract. ATOPSEC
1. For contractors who do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014-05 / AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative, as NCIC and TSDB are available), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
2. Suspicious Activity Reporting Training (e.g. iWATCH, CorpsWatch, or See
Something, Say Something). The contractor and all associated sub-contractors shall receive a brief/training (provided by the RA) on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the COR NLT 5 calendar days after the completion of the training.
3. Pre-screen candidates using E-Verify Program. The Contractor must pre-screen Candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
*When contracts are with individuals, the individuals will be required to complete a Form I-9, Employment Eligibility Verification, with the designated Government representative. This Form will be provided to the Contracting Officer and shall become part of the official contract file.

APPENDIX A
MINIMUM BASIC OUTLINE FOR ACCIDENT PREVENTION PLANS
An Accident Prevention Plan (APP) is a safety and health policy and program document.
The following areas are typically addressed in an APP, but an APP shall be job-specific and shall also address any unusual or unique aspects of the project or activity for which it is written.
The APP shall interface with the employer’s overall safety and health program, and a copy shall be available on the work site. Any portions of the overall safety and health program that are referenced in the APP shall be included as appropriate. ANSI/ASSE A10.38 should be referenced for Programmatic Issues.
1. SIGNATURE SHEET. Title, signature, and phone number of the following:
a. Plan preparer (Qualified Person, Competent Person, such as corporate safety staff person, QC);
b. Plan must be approved, by company/corporate officers authorized to obligate the company;
c. Plan concurrence (e.g., Chief of Operations, Corporate Chief of Safety, Corporate Industrial Hygienist, project manager or superintendent, project safety professional, project QC). Provide concurrence of other applicable corporate and project personnel (Contractor).
2. BACKGROUND INFORMATION. List the following:
a. Contractor;
b. Contract number;
c. Project name;
d. Brief project description, description of work to be performed, and location;
phases of work anticipated (these will require an AHA).
3. STATEMENT OF SAFETY AND HEALTH POLICY. Provide a copy of current corporate/company Safety and Health Policy Statement, detailing commitment to providing a safe and healthful workplace for all employees. The Contractor’s written safety program goals, objectives, and accident experience goals for this contract should be provided.
4. RESPONSIBILITIES AND LINES OF AUTHORITIES. Provide the following:
a. A statement of the employer’s ultimate responsibility for the implementation of his SOH program;
b. Identification and accountability of personnel responsible for safety at both corporate and project level. Contracts specifically requiring safety or industrial hygiene personnel shall include a copy of their resumes. Qualifications shall include the OSHA 30-hour course or equivalent course areas as listed here:
(1) OSH Act/General Duty Clause;
(2) 29 CFR 1904, Recordkeeping;
(3) Subpart C: General Safety and Health Provisions, Competent Person;
(4) Subpart D: Occupational Health and Environmental Controls, Citations and Safety Programs;
(5) Subpart E: PPE, types and requirements for use;
(6) Subpart F: understanding fire protection in the workplace;
(7) Subpart K: Electrical;
(8 Subpart M: Fall Protection;
(9) Rigging, welding and cutting, scaffolding, excavations, concrete and masonry, demolition; health hazards in construction, materials handling, storage and disposal, hand and power tools, motor vehicles, mechanized equipment, marine operations, steel erection, stairways and ladders, confined spaces or any others that are applicable to the work being performed.
c. The names of Competent and/or Qualified Person(s) and proof of competency/qualification to meet specific OSHA Competent/Qualified Person(s) requirements must be attached. The District SOHO will review the qualifications for acceptance;
d. Requirements that no work shall be performed unless a designated competent person are present on the job site;
e. Requirements for pre-task safety and health analysis;
f. Lines of authority;
g. Policies and procedures regarding noncompliance with safety requirements (to include disciplinary actions for violation of safety requirements) should be identified;
h. Provide written company procedures for holding managers and supervisors accountable for safety.
5. SUBCONTRACTORS AND SUPPLIERS. If applicable, provide procedures for coordinating SOH activities with other employers on the job site:
a. Identification of subcontractors and suppliers (if known);
b. Safety responsibilities of subcontractors and suppliers.
6. TRAINING.
a. Requirements for new hire SOH orientation training at the time of initial hire of each new employee.
b. Requirements for mandatory training and certifications that are applicable to this project (e.g., explosive actuated tools, confined space entry, crane operator, diver, vehicle operator, HAZWOPER training and certification, PPE) and any requirements for periodic retraining/recertification.
c. Procedures for periodic safety and health training for supervisors and employees.
d. Requirements for emergency response training. > See paragraph 9.b. below for a list of requirements that may require emergency response training.
7. SAFETY AND HEALTH INSPECTIONS.
a. Specific assignment of responsibilities for a minimum daily job site safety and health inspection during periods of work activity: Who will conduct (e.g., SSHO, PM, safety professional, QC, supervisors, employees – depends on level of technical proficiency needed to perform said inspections), proof of inspector’s training/qualifications, when inspections will be conducted, procedures for documentation, deficiency tracking system, and follow-up procedures;
b. Any external inspections/certifications that may be required (e.g., USCG).
8. ACCIDENT REPORTING. The Contractor shall identify person(s) responsible to provide the following:
a. Exposure data (man-hours worked);
b. Accident investigations, reports, and logs: Report all accidents as soon as possible but not more than 24 hours afterwards to the Contracting Officer/Representative (CO/COR). The contractor shall thoroughly investigate the accident and submit the findings of the investigation along with appropriate corrective actions to the CO/COR in the prescribed format as soon as possible but no later than five (5) working days following the accident. Implement corrective actions as soon as reasonably possible;
c. The following require immediate accident notification:
(1) A fatal injury;
(2) A permanent total disability;
(3) A permanent partial disability;
(4) The hospitalization of three or more people resulting from a single occurrence;
(5) Property damage of $200,000 or more.
9. PLANS (PROGRAMS, PROCEDURES) REQUIRED BY THE SAFETY MANUAL.
Based on a risk assessment of contracted activities and on mandatory OSHA compliance programs, the Contractor shall address all applicable occupational risks and compliance plans. Using the EM 385-1-1 as a guide, plans may include but not be limited to:
a. Layout plans (04.A.01);
b. Emergency response plans:
(1) Procedures and tests (01.E.01);
