DUAO 2nd Floor Carpet Replacement
1.0 GENERAL
1.1 Project Descriptions
The Contractor shall furnish new carpet to replace the existing carpeting on the second floor of the United States Army Corps of Engineer, Duluth Area Office. The existing carpeting on the second floor of the office building was installed in the mid-1980s and was adhered to existing tile. This tile contains asbestos fibers. The contractor shall remove the existing carpet and leave the existing asbestos tiles in place. The new carpet shall be adhered to these asbestos tiles according to the manufacturer’s recommendations. If at any time during the removal of the existing carpet that the asbestos tiles become damaged, work shall stop and the COR shall be notified immediately. The COR will make a determination on how to proceed.
The Government will temporarily relocate its computer equipment, but the Contractor shall be responsible for moving all other items in the work areas. It is recommended that all bidders conduct a site visit to look at the existing conditions in each office. All rooms contain office furniture such as printers, boxes, desks, file cabinets, etc.
The contractor shall return all office furniture to their original locations before the Duluth Area Office employees return to work at 6:00AM. If any of the office furniture is damaged, it is the Contractors responsibility to replace with new.
1.2 Work Period Restriction
It is required that the contractor work between the hours of 5:30 PM and 6:00AM during the week to minimize the impact of the Duluth Area Office operations. An USACE authorized representative shall be on site at all times to provide Quality Assurance oversight. Any variations in time, shall be submitted and approved by the COR 48 hours in advance.
1.3 Pre-Work Meeting
Before the start of work, the Contractor shall meet with the Contracting Officer or Authorized Representative and discuss the Contractor's work plan and quality control system. Before the meeting, the Contractor shall submit all required submittals and background security investigation information. During the meeting, a mutual understanding of control of on-site work must be established. The Contractor must establish and maintain an effective quality control (QC) system. A QC system consists of plans, procedures, and organization necessary to produce an end product which complies with the contract requirements. The project superintendent will be held responsible for the quality of work and is subject to removal by the Contracting Officer for non-compliance with the quality requirements specified in the contract. In this context, the highest level manager responsible for the overall activities at the site, including quality and production is the project superintendent. The project superintendent must maintain a physical presence at the site at all times and is responsible for all Contractor activities at the site, except as otherwise acceptable to the Contracting Officer.
1.4 SUBMITTALS
1.4.1 Work Plan
A Work Plan shall be submitted, reviewed, and revised as necessary, prior to the commencing of work on the site.
At a minimum, the work plan shall describe the sequence of work and duration of each task.
1.4.2 Accident Prevent Plan (APP)
Prepare the APP in accordance with the format and requirements of USACE 385-1-1 and as supplemented herein.
Submit the APP to the Contracting Officer 5 calendar days prior to the date of the pre-work conference for review.
Work cannot proceed without a properly prepared and accepted APP.
1.4.3 Product Data
The contractor shall submit the manufacturer’s data for the following:
Carpet Specifications Carpet Adhesive/Tape Installation Instructions – including preparation of substrate and seaming techniques Operation and Maintenance Data – including recommending type of cleaning equipment and material, spotting and cleaning methods, and cleaning cycles
1.4.4 Schedule
The schedule shall be submitted 7 days after the Notice to Proceed is issued. The schedule shall include removal and installation of new carpet in each room. The schedule shall contain 2 work days advance notification of work to be done in each office for the relocation of computer equipment.
Removal and installation work shall begin after all submittals are approved and all background investigation is complete. The Contractor shall schedule the work such that the removal of items, removal of the existing carpeting, installation of new carpet, and return of items to their original locations shall all be completed prior to the end of each work day in each work area.
1.5 Work with Others
Other contractors may be working at these sites. Contractor shall coordinate work efforts to minimize interferences with other contractors and building occupants.
1.6 Safety
All work will be performed in compliance with US Army Corps of Engineers Safety and Health Requirements Manual, EM385-1-1. The Contractor will not be allowed to park in the Government lot between 5:30PM and 6:00 AM on the weekdays.
1.7 Security Requirements and Clearance of Personnel
1.7.1 Security Requirements
All personnel employed by the contractor in the performance of the services specified in this contract or any representative of the Contractor entering the work area shall conform and comply with all applicable U.S. Army Corps of Engineers, facility access, security policies and procedures (provided by government representative). The contractor shall submit all security information with 2 weeks after the notice to proceed is issued.
1.7.2 Pre-screening of contractor candidates via E-verify Program The Contractor must pre‐screen Candidates using the E‐verify Program (http://www.dhs.gov/E‐Verify) website to meet the established employment eligibility requirements. The Vendor must ensure that the Candidate has two valid forms of Government issued identification prior to ensure the correct information is entered into the E‐verify system. An initial list of verified/eligible Candidates must be provided to the COR no later than 3 business days after the initial contract award.
1.7.3 Clearance of Personnel
All Contractor and Subcontractor employees entering the work site are required to have a FBI National Criminal History Check (fingerprint check). The Government will provide the required fingerprint cards. The Contractor will be required to complete the fingerprint cards from a local police station for each employee. The completed fingerprint card shall be provided to the Contracting Officers Representative (COR) prior to the first day the employee starts work on the site, unless a time extension not to exceed five (5) work days is granted by the COR. After five (5) work days, the employee will be excluded from the site if the fingerprint card has not been provided.
1.7.4 Security Checks
All employees must carry pictured identification at all times. They must show I.D. upon request by Government personnel. The Contractor's employees will be subject to such additional checks as may be deemed necessary to ensure that no violation of security rules has occurred.
1.7.5 Exclusion or Expulsion from the Site
A negative FBI National Criminal History Check (fingerprint check) may result in the exclusion or expulsion of the Contractor employee from the site as determined by the Detroit District, Chief, Security & Law Enforcement.
Additionally any failure to observe the security rules will also result in the potential exclusion or expulsion of Contractor employees from the site. Exclusion or expulsion of an employee resulting from a negative FBI National Criminal History Check (fingerprint check) or the failure of an employee to observe the security rules shall not be subject to the Disputes clause and shall not result in an increase in the contract amount.
1.8 DELIVERY AND STORAGE
Deliver materials to the site in the manufacturer's original wrappings and packages that are clearly labeled with the manufacturer's name, brand name, size, dye lot number, and related information. Remove materials from packaging and store them in a clean, dry, well ventilated area, protected from damage, soiling, and moisture, strong contaminant sources and residues, and maintain at a temperature above 60 degrees F for 2 days prior to installation.
Carpet or carpet tiles shall not be stored with materials which have high emissions of volatile organic compounds (VOCs) or other contaminants. Do not store carpet near materials that may off gas, or emit harmful fumes, such as kerosene heaters, fresh paint, or adhesives.
A parking lot space and lay down area on the Second floor shall be coordinated and approved by the COR.
1.9 ENVIRONMENTAL REQUIREMENTS
Provide temporary ventilation during work.
1.10 WARRANTY
Provide manufacturer's standard performance guarantees or warranties including minimum ten (10) year wear warranty, two (2) year material and workmanship and ten (10) year tuft bind and delamination warranty.
2.0 PRODUCTS
2.1 CARPET
Furnish first quality carpet; free of visual blemishes, streaks, poorly dyed areas, fuzzing of pile yarn, spots or stains, and other physical and manufacturing defects. Furnish approximately 350 square yards (includes the 10% extra) of Shaw Collection Jekyll EW24 Style #59366, Color #66855 or approved equal. Provide carpet materials and treatments as reasonably non-allergenic and free of other recognized health hazards. Provide a static control construction on all grade carpets which gives adequate durability and performance.
2.1.1 Physical Characteristics
Modular Tile Carpet [A] Carpet shall comply with the following:
a. Carpet Construction: Multi-Level Pattern Loop.
b. Type: Modular tile 24 by 24 inches square with 0.15 percent growth/shrink rate in accordance with ISO 2551.]
c. Pile Type: Tip Sheared Textured Loop.
d. Pile Fiber: Commercial 100 percent branded (federally registered trademark) nylon continuous filament.
e. Yarn Ply: Minimum two (2) in accordance with ASTM D 1423.
f. Gauge or Pitch: Minimum 5/64 inch in accordance with ASTM D 5793.
g. Stitches or Rows/Wires: Minimum 9.8 per inch.
h. Finished Pile Yarn Weight: Minimum 32 ounces per square yard. This does not include weight of backings.
Determine weight in accordance with ASTM D 5848.
j. Dye Method: Yarn (or Skein) dyed.
k. Backing Materials: Provide primary backing materials like reinforced synthetic.
2.4 CARPET MOLDINGS
Install carpet moldings (vinyl or aluminum) where carpet material changes or carpet edge does not abut a vertical surface.
2.5 ADHESIVES AND CONCRETE PRIMER
Adhesives and concrete primers shall comply with applicable regulations regarding toxic and hazardous materials.
Provide waterproof, nonflammable, and non-staining adhesives and concrete primers for carpet installation to meet local air-quality standards, and as required by the carpet manufacturer. Provide release adhesive for modular tile carpet as recommended by the carpet manufacturer. Provide adhesives flashpoint of minimum 140 degrees F in accordance with ASTM D 3278.
2.8 TAPE
Provide tape for seams as recommended by the carpet manufacturer for the type of seam used in installation.
2.9 COLOR, TEXTURE, AND PATTERN
Provide color, texture, and pattern to meet the color chart below:
Modular Carpet: Shaw Collection Jekyll EW24 Style #59366, Color #66855 or approved equal.
3.0 EXECUTION
3.1 SURFACE PREPARATION
Do not install carpet on surfaces that are unsuitable and will prevent a proper installation. Repair holes, cracks, depressions, or rough areas using material recommended by the carpet or adhesive manufacturer. Free floor of any foreign materials and sweep clean. Before beginning work, test subfloor with glue and carpet to determine "open time" and bond.
3.4 INSTALLATION
The contractor shall provide 350SY of carpet and install 246SY of the carpet. Perform all work by installers who are CFI certified (International Certified Floorcovering Installer Association), or manufacturer's approved installers.
Conduct installation in accordance with the manufacturer's printed instructions. Follow ventilation, personal protection, and other safety precautions recommended by the adhesive manufacturer. Continue ventilation during installation and for at least 72 hours following installation.
3.4.1 Modular Tile Installation
Install modular tiles with release adhesive, as recommended by the manufacturer, and snugly jointed together. Lay tiles in the same direction with accessibility to the subfloor where required.
3.5 CLEANING AND PROTECTION
3.5.1 Cleaning
After installation of the carpet, remove debris, scraps, and other foreign matter. Remove soiled spots and adhesive from the face of the carpet with appropriate spot remover. Cut off and remove protruding face yarn. Vacuum the carpet clean.
3.6 REMNANTS
All carpet remnants shall be removed and recycled off site.

3. All offerors shall be registered at https://www.sam.gov with the NAICS code that is shown on the front page of the SF1449 in Block 10 prior to submission of the quote.

ALTERNATE I (MAY 2014)
An offeror shall complete only paragraph (b) of this provision if the offeror has completed the annual representations and certifications electronically via http://www.acquisition.gov. If an offeror has not completed the annual representations and certifications electronically at the System for Award Management (SAM) website, the offeror shall complete only paragraphs (b) through (i) of this provision.
(a) Definitions. As used in this provision:
"Emerging small business" means a small business concern whose size is no greater than 50 percent of the numerical size standard for the NAICS code designated.
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
Inverted domestic corporation, as used in this section, means a foreign incorporated entity which is treated as an inverted domestic corporation under 6 U.S.C. 395(b), i.e., a corporation that used to be incorporated in the United States, or used to be a partnership in the United States, but now is incorporated in a foreign country, or is a subsidiary whose parent corporation is incorporated in a foreign country, that meets the criteria specified in 6 U.S.C.
395(b), applied in accordance with the rules and definitions of 6 U.S.C. 395(c). An inverted domestic corporation as herein defined does not meet the definition of an inverted domestic corporation as defined by the Internal Revenue Code at 26 U.S.C. 7874.
“Manufactured end product” means any end product in Federal Supply Classes (FSC) 1000-9999, except—
(1) FSC 5510, Lumber and Related Basic Wood Materials;
(2) Federal Supply Group (FSG) 87, Agricultural Supplies;
(3) FSG 88, Live Animals;
(4) FSG 89, Food and Related Consumables;
(5) FSC 9410, Crude Grades of Plant Materials;
(6) FSC 9430, Miscellaneous Crude Animal Products, Inedible;
(7) FSC 9440, Miscellaneous Crude Agricultural and Forestry Products;
(8) FSC 9610, Ores;
(9) FSC 9620, Minerals, Natural and Synthetic; and
(10) FSC 9630, Additive Metal Materials.
“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.
Restricted business operations means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate—
(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;
(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;
(3) Consist of providing goods or services to marginalized populations of Sudan;
(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;
(5) Consist of providing goods or services that are used only to promote health or education; or
(6) Have been voluntarily suspended.
Sensitive technology—
(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--
(i) To restrict the free flow of unbiased information in Iran; or
(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and
(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).
Service-disabled veteran-owned small business concern—
(1) Means a small business concern--
(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and
(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.
(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).
"Small business concern" means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

(A) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
