FAR Part 6 Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: US Army Contracting Command - Aberdeen Proving Ground, Edgewood Contracting Division, 8456 Brigade Street, E4215 Aberdeen Proving Ground, MD 21010
2. Description of Action: The Engineering Support Division (ESD) at the U.S. Army Combat Capabilities Development Command (CCDC) Chemical Biological Center requests a firm fixed price with cost CLINs contract with SciTech Services, Inc., 2129 Pulaski Highway Suite 100, Havre de Grace, MD 21078-0000. The Government projects award of the contract by 31 July, 2019, and fiscal year 2019 (FY19) Department of Defense (DoD) Research, Development, Test, & Evaluation (RDTE) funds will be used to fund the base period. 3. Description of Services: Filtration support requires specialized knowledge and training in the area of Chemical, Biological, and Radiological (CBR) defense systems for installation, operation and maintenance, and testing and analysis.
Knowledge of mechanical systems, filtration adsorbents, and filters is needed to support surveillance of CBR systems. This support also includes, but is not limited to, system surveillance, equipment preparation, and equipment transport.
The estimate below is based on historical pricing and the annual increases between years for the Program Manager, Senior Engineer, Senior Engineering Technician, and Engineering Technician labor categories. Options have been included in order to provide continued support for this program to ensure continuity of service and to provide surge capability if required to support additional test, filter installation, system operation and maintenance, equipment preparation, and equipment transport tasks. The surge capability is due to the potential for an increased workload over the next five years. Each option period includes multiple option CLINs, continuing base service and providing options for surge capability. The options will be exercised in accordance with FAR 17.207 if the conditions of FAR 17.207(c) are met.

5. Reason for Authority Cited:
As described in full and open competition need not be provided for when the unless the is permitted to limit the number of sources from which it solicits bids or proposals.
If the contract is not awarded to SciTech, the requirement cannot be supported beyond 31 Jul 19, resulting in a lapse in mission tasks required to keep critical systems in operational status.
The current contractor, SciTech, has the necessary number of employees, in the correct positions In addition SciTech possesses the requisite advanced training and specialized knowledge for the installation, operation and maintenance, and testing of CBR systems. SciTech possesses the subject matter expertise to perform critical chemical performance analysis and data trending that is required to support CBR system surveillance. As a result, SciTech is able to provide all of the necessary support to successfully complete this requirement. Awarding this requirement to a new contractor will cause significant impacts to the program, Alternatives:
a. Solicit the requirement on a competitive basis and award to a new contractor.
This is not an acceptable alternative. The specific program security requirements prohibit additional disclosure of the Government's needs.
b. Use in-house personnel/expertise. The Government does not currently have personnel with the necessary technical expertise
The current technical services will carry the program through 31 Jul 2019. The ESD will be supporting the program for at least the next ten years and beyond.
To provide support for all mission tasks, contract services will be required for at least the next five to six years. Due to the security requirements of the program and the lack of the necessary skill sets being available through Government personnel, competition will not be sought as there are no alternatives available without critical risk to the program.
6. Efforts to Obtain Competition: In accordance with FAR 5.202(a)(1) this action will be synopsized.
a. Effective Competition: Because this is a sole source action, effective competition is not applicable.
b. Subcontracting Competition: SciTech is as small business and its employees hold the necessary clearances. It is not expected that they will need to subcontract and a subcontracting plan will not be required in accordance with FAR 19.702(b)(1).
7. Actions to Increase Competition:
For the current requirement, no actions can be taken to increase competition due to the sensitive nature of the program. Due to the specific program required by the customer, the current individuals supporting the effort will need to be retained. The has the sole authority to approve personnel for a in support of their program. Only the personnel that currently possess this are related to this effort. This restricts the distribution of information for the purpose of contract solicitation.
In order to enhance competition, ESD will seek to recruit the necessary expertise during the period of this contract in order to provide the technical capability that is required in the classified portion of the program in house. This will allow for the unclassified portion of the work to be competitively acquired. The unclassified work is limited to the equipment preparation and loading (including filters) onto vehicles for transport. This work can be covered by one technician on a part-time basis.
However, they would be unable to provide service on any equipment preparation that identifies either the customer or location. It is not in the best interest of the government to break out this work at this time, as it is estimated that creating a second contract for this support technician would result in an additional cost to the Government in the amount of $385,378.00, representing duplicative administrative costs over the next five years. The duplicative costs include the additional Program Management hours, overhead, general & administrative, and profit associated with a separate contract. Furthermore, there are additional costs associated with the Contracting Officer Representative (COR) to perform technical point of contact duties, invoicing, reporting, financial reviews, and meetings. The additional cost for a second contract for the unclassified portion of work would not result in an overall cost savings for the Government through competition.
8. Market Research:
A sources sought was posted to Federal Business Opportunities on 7 Jun 2018.
The sources sought was a means of conducting market research to identify parties having an interest in and the resources to support the need for technical services related to the installation, maintenance and repair, and testing of filtration systems and their associated components. The required capabilities requested were filtration preparation and installation, transport and delivery of filters and materials, maintenance and/or system level repair, and system level testing using complex test equipment. The sole respondent is identified in the table below. In addition to the required capabilities, in order to work on all capabilities of this requirement, all technicians require both the Any new technician to the project will require the six month minimum for approval in order to work at the customer and will be relegated to warehouse work in the interim.
They will effectively be limited to the filtration preparation and loading for transport tasks.
In addition to the sources sought discussed above, additional market research was performed during May and June 2018. Market Research techniques included;
discussions with knowledgeable people (Government and industry) in specific markets, reviewed specific knowledge, and skill sets with the current award.
Discussions were held with other Engineering Division Chiefs and vendors in the 541330 Engineering Support NAICS code to determine available resources, and if
Program: Filtration Technical Support the current personnel can still be retained through the vendor. The previous market research report dated 27 Oct 2011 for contract was also reviewed.
Information was requested through the current contracting office to see about any additional contract mechanisms since the expiration of Chemical, Biological Radiological, Nuclear, and Explosive (CBRNE) Mission Support Contract (MSC) for specialized support. It was determined that there were no suitable contract mechanisms available to support the scope of this requirement.
Research methods also included: internet tools and web searches to research previous companies under the CBRNE-MSC small business suite for CBR defense system experience and any specialized skills; results of recent market research on similar or identical requirements; and review of previous market research proposals from similar contract efforts under CBRNE-MSC, previously awarded under this recurring requirement. The search identified four companies that have experience with CBR support:
SciTech Services, Inc. is currently performing an ESD task order with a similar scope to this task that needs to be solicited. The ESD task is
. has experience in research and development, however it was not specific to the CBR tasks in this solicitation, except for experimental filtration media, which is not comparable to the items supported on this contract.

SciTech provided the sole response to the sources sought posted on 08 Jun 18. To date, no other sources have written to express an interest in the acquisition.
