FAR SUBPART 13.5 SIMPLIFIED PROCEDURES FOR CERTAIN COMMERCIAL
ITEMS – SOLE SOURCE JUSTIFICATION AND APPROVAL
Supply/Service: ECBC Engineering, Protection Engineering Division seeks to purchase 22 modernized 8020M M41 Protective Assessment Systems which are now commercially available from TSI Inc. of Shoreview, Minnesota. The 22 systems will be used for verification and validation of Operational Requirements contained in CARDS 1265 [Catalogue of Approved Army Requirements Documents for Protective Mask Fit Validation. Additionally the 22 systems will be subjected to engineering tests outlined in the standard M41 PATS purchase specification, MCT-1537.
Authority: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 as implemented by FAR Subpart 13.5 and Class Deviation – 2015-O00004.
Amount: $ 244,000 The total estimated cost for the firm-fixed price purchase of 22 each commercially available Modernized 8020M M41 Protective Assessment Test Systems (PATS) is $244,000. No options are required.

Source Justification and Approval
1. Contracting Activity: Edgewood Contracting Activity, Gunpowder, MD 21010-5423
2. Description of Action: US ARMY EDGEWOOD CHEMICAL BIOLOGICAL CENTER requests a FIRM FIXED PRICE CONTRACT with TSI, INC. Shoreview, Minnesota. The Government projects award for DEC 2016and fiscal year 2017, Funds Type: Other Procurement Army) funds will be used.
X -An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).
No previous Contract Action for procurement of the Modernized 8020M M41 Protective Assessment System (PATS).

5. Reason for Authority Cited:
TSI is the only manufacturer of the Army’s M41 PATS system. TSI has experience going back to 1986 in the creation of the system for the Army. TSI has developed using their own resources a modernized M41 PATS 8020 M Potacount based on improvements of the legacy M41 PATS. The new system is still compatible with the Army’s investment in Calibration and Repair Maintenance facilities located in Europe and The Continental U.S.A. Only TSI has technology for a COTS NDI military oriented mask fit test device that uses condensation particle counting. The system does not need an additional aerosol, but uses particles naturally occurring in ambient air to determine adequacy of mask fit. The system can count particles as small as 0.02 microns and particles up to 0.2 micron and up to 1 micron with specialized firmware embedded into the Electronic Programmable Read only Memories.
