Sole Source Justification and Approval Under FAR 13.501
1. Contracting Activity: Mission and Installation Contracting Command (MICC)-West Point 681 Hardee Place West Point, NY 10996.
2. Description of Action: The United States Military Academy (USMA), Jefferson Library at West Point, New York is requesting a contract to procure a software subscription to access ProQuest online database. This approval is for a new contract, funded with fiscal year 2024, Operations and Maintenance funds. Proposed contractor:

3. Description of Supply: This is a request to procure a software subscription to access ProQuest online database. ProQuest information archive includes academic journals, video, dissertations, Ebooks, newspapers, periodicals, historical collections, music scores, governmental and cultural archives; a collection of diverse and inclusive content that showcases unique perspectives and voices. This database consists of electronic and digitalized prints of the following materials:

6. Efforts to Obtain Competition:
A Special Notice (ID: W911SD-24-R-0012) was published on 07 November 2023 to 09 November 2023 to the Governmentwide Point of Entry System for Award Management (SAM) at https:// SAM.gov. An approved Statement of Non-Availability (SONA # 216801782) was submitted along with an IT Approval System Waiver (# 20231016001051298). Also, a memo was received from ProQuest stating that their database are derivative works as defined under the Copyright Act of 1976, Title 17 U.S.C and are subject to separate copyright protection. ProQuest is the sole holder of the copyright in the ProQuest-created products and services as a collective or derivative.
7. Actions to Increase Competition: Market research will be conducted for future requirements to determine if the market conditions have changed.
8. Market Research: Small Business Administration (SBA), Dynamic Small Business Search (DSBS) database revealed a total of five (5) small businesses under NAICS 513210 and keyword: Software Publisher. In addition, a Quick Market Search was conducted with NAICS and same keyword. All mandatory sources of supply and services were considered (FAR Part 8), and there are no mandatory schedules that applies to this requirement.
9. Interested Sources: To date, no other sources have written to express an interest.
The notices required by FAR 5.201 have been published, any bids or proposals received shall be considered.
10. Other Facts:
a. Procurement history. Previous contracts for the ProQuest database subscription have been reviewed and considered as part of the Market Research. Contracts W911SD-20-P-0019 and W911SD-16-P-0013 were for a base and three (3) option periods, with an average price of
