Addendum - 52.212-2 Evaluation -Commerical Items

a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

Major Defects - One (1) Major Defect, as listed in Table 1, shall fail the sample and be considered unacceptable to the government.

Minor Defects - Three (3) Minor Defects, as listed in Table 1, shall fail the sample and be considered unacceptable to the government.

a. Basis for Contract Award. This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) 13, Simplified Acquisition Procedures, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS).

The Simplified Acquisition Procedure authorized under FAR Subpart 13.5 is applicable to this acquisition. Award will be made to a single offeror who is deemed responsible in accordance with the Federal Acquisition Regulation (FAR), whose offer is technically acceptable, conforms to the solicitation requirements, and whose offer, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the lowest price.

b. Award for All of the Work. The Government intends to award one Firm Fixed Price Contract. Proposals received for less than the stated number of items listed in the Price Schedule will be considered ineligible for award. The Government intends to evaluate proposals and award a contract without discussions with offerors. Therefore, the offeror's initial proposal should contain the offeror's best terms from a price and technical standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary.

c. Evaluation Criteria. Product samples. The sample unit shall be a CADET SWORD. The sample shall be submitted at no expense to the Government. Samples will be evaluated in accordance with the evaluation criteria listed below. Evaluation criteria consist of factors. The proposals will be evaluated under two (2) evaluation factors: Technical and Price.

Factor 1 – Technical. The Sample will receive one of the ratings defined below.

In order to receive an acceptable rating, the sample submissions must not contain any major defects as stated in the evaluation criteria listed in Paragraphs 4.5 (Table 1) and 4.5.1 Evaluation Criteria of the attached specifications.

Factor 2 – Price. Price will not be scored or rated. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 13.106-3(a). Through these techniques the Government will determine whether prices are reasonable.

d. Notice of Award. A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

IN ORDER TO BE CONSIDERED FOR AWARD, A SAMPLE MUST BE RECIEVED.

The sample unit of a CADET SWORD MUST BE RECEIVED ON OR BEFORE THE LISTED DATE IN BLOCK 8 ON PAGE 1 OF THE SOLICITATION.
