This section supplements clause 52.212-1 and 52.212-2 which is included elsewhere in this request for quotes. The Government intends to evaluate offer and award a contract without discussions. Therefore, the offeror’s initial offer should contain the offeror’s best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions if later determined by the Contracting Officer to be necessary. The Government may reject any or all offers if such action is in the public interest and waive informalities and minor irregularities in offers received.
This solicitation shall be evaluated by awarding to the quote that is technically acceptable and the lowest price.
TECHNICAL FACTOR:
Evaluation –Each item in Technical Requirements Table will receive one of the adjectival ratings defined below. Any criterion that receives “U” rating will result in an overall unacceptable rating for the factor and are not eligible for award.
ADJECTIVAL RATING
DEFINITION
Acceptable (A)
Quote clearly meets the minimum requirements of the solicitation.
Unacceptable (U)
Quote does not clearly meet the minimum requirements of the solicitation.
TECHNICAL CRITERIA
A or U
The offeror has no active or inactive exclusions listed in their Entity Record on the System for Award Management (SAM).
In accordance with FAR 42.15, the offeror does not have any relevant Past Performance rated at “Marginal” or “Unsatisfactory”.
| PRICE FACTOR: | |
| Submission Instructions – Offeror shall submit a fully completed SF 1449, Pricing Schedule, or acceptable | alternative as identified in 52.212-1 or elsewhere in the RFQ. |
The agreed upon items and quantities will be multiplied times their respective unit prices found in the RFQ.
As part of price evaluation, the Government will evaluate its option to extend services (see FAR Clause 52.217-8) by adding six (6) months of the offeror's final option period price to the offeror's total price. Offerors are required only to price the base and option periods. Offerors shall not submit a price for the potential six month extension of services period. The Government may choose to exercise the Extension of Services at the end of any performance period (base or option periods), utilizing the rates of that performance of period.
As part of its proposal, the offeror must provide the estimated total cost (if any) incurred to comply with the enterprise Contractor Manpower Reporting Application (eCMRA) requirement. Offeror will determine to price or not separately price the CMRA requirement. CMR CLIN(s) is the CLIN(s) under which the Contractor shall bill for all costs associated with the CMRA requirement.
Evaluation – Price will not be assigned an adjectival rating; and will be evaluated to determine if the offeror quoted price is fair, reasonable, and balanced. The government may determine that an offer is unacceptable if prices are significantly unbalanced. Price shall be evaluated at estimated quantities multiplied times their respective unit price.
Unrealistically Low Prices: Prices quoted may be reviewed to determine whether they reflect a lack of technical understanding of the requirements and to assess the risk inherent in an offeror’s quoted prices. Unrealistically low quoted prices, initially or subsequently, may be grounds for rejection for this solicitation.
Unbalanced Pricing: Offeror is cautioned against submitting quote that contains unbalance pricing. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly over or understated as indicated by the application of cost or price analysis techniques. The Government shall analyze offers to determine whether they are unbalanced with respect to separately priced line items or subline items. Quotes that are determined to be unbalanced may be rejected if the contracting officer determines that the lack of balance poses an unacceptable risk to the Government.
26. ALTERNATE DISPUTES RESOLUTION: In furtherance of Federal policy and the Administrative Dispute Resolution Act of 1990 (ADR Act), Public Law 101-552 and FAR Clause 52.233-1, Subparagraph (d) (2) (1) (B) (2), the Contracting Officer will try to resolve all post award acquisition issues in controversy by mutual agreement of both parties. Interested parties are encouraged to use alternative dispute resolution procedures to the maximum extent practicable, in accordance with the authority and requirements of the ADR Act.
27. CONTRACT PERFORMANCE:
Purpose. IAW with FAR Subpart 42.1500 contractor past performance information (PPI) is relevant information for future source selection purposes regarding a contractor’s actions under previously awarded contracts. It includes, for example, the contractor's record of conforming to contract requirements and to standards of good workmanship; the contractor's record of forecasting and controlling costs; the contractor's adherence to contract schedules, including the administrative aspects of performance; the contractor's history of reasonable and cooperative behavior and commitment to customer satisfaction; and generally, the contractor's business-like concern for the interest of the customer. Contractor past performance information is one of the tools that support Army efforts to acquire best value and is used to evaluate performance risk in source selection. The feedback provided by the government to the contractor in collecting PPI, and the knowledge that PPI will be used in future source selection decisions, should result in improved performance and a greater contractor focus on customer satisfaction.
Assessment Period. Performance Assessment Reports (PAR) shall be prepared IAW AFARS Subpart 42 upon physical completion of the contract. If the period of performance will exceed 18 months, an “interim” assessment report shall be prepared at the completion of 12 months performance and annually thereafter until the contract is physically complete. An out-of-cycle or “addendum” report may be prepared if there is a need to record an extraordinary event prior to the next regularly scheduled evaluation or if it is necessary to report a meaningful occurrence during the period between physical completion of the contract and contract closeout. Additionally, addendum reports may be prepared to record contractor’s performance relative to contract closeout and other administrative requirements (e.g. final indirect cost proposals, technical data, etc.).
Completion Due Date. The government will complete the PAR within 60 days after the end of the assessment rating period.
Evaluators. The Contracting Officer and the Contracting Officer’s Representative will jointly complete the performance assessment.
Contracts Performance Elements. The contractor’s performance shall be assessed in accordance with elements and rating system set forth in AFARS Subpart 42.
Contractor Review. The Contracting Officer will furnish a copy of the PAR to the contractor requesting that the contractor submit comments, rebutting statements, or additional information to the Contracting Officer within 30 calendar days of receipt. Failure to respond within the designated timeframe will be taken as agreement with the assessment.
Contract Concurrence. Where a contractor concurs with, or takes no exception to a PAR, such report shall be considered final and releasable for use in source selection and other deliberative purposes.
Contractor Rebuttal. Where a contractor takes exception to a performance report, the Contracting Officer will review the contractor’s rebuttal or comments and make appropriate changes. If the Contracting Officer makes changes, the changed rating will be reflected in the narrative. The Contracting Officer will make all reasonable efforts to reconcile the report and the contractor’s comments. However, it is not necessary that they reach agreement on the report where such is clearly impracticable. The contractor’s rebuttal or comments shall be made part of the PAR.
Resolving Disagreements between the Government and the Contractor. In the event disagreements between the parties regarding the PAR occur, the Contracting Officer will review the rebuttal and make appropriate changes. If no agreement is reached, the PAR is forwarded to the Reviewing Official (Director of Contracting) along with the Contracting Officer’s Findings and Recommendation and supporting documentation. The decision of the Reviewing Official is final. Copies of the PAR and the contractor’s response and review comments, if any, shall be retained as part of the evaluation.
Release of Contractor Performance Evaluation Information. The evaluation will not be released to other than government personnel and the contractor whose performance is evaluated. The performance evaluation information will be input into the applicable module within Contractor Performance Assessment Reporting System (CPARS) database (or Government system in use at time of the evaluation).
Source Selection Information. Departments and agencies will electronically access the PAR information to support future award decisions.

PART 4
CONTRACTOR FURNISHED ITEMS AND SERVICES
4. CONTRACTOR FURNISHED ITEMS AND RESPONSIBILITIES:
4.1 General: The Contractor shall furnish all supplies, equipment, facilities and services required to perform work under this contract.
PART 5
SPECIFIC TASKS
5. SPECIFIC TASKS:
5.1 Basic Services:
5.1.1 All services will be scheduled in advance with notification being made to the designated COR.
5.1.2 All contracted services will be performed only on a weekday – Monday to Friday.
5.1.3 Services will be performed in accordance with the schedule as specified in the contract and performed in a manner consistent with acceptable industry standards regarding consideration of pending weather conditions; e.g., rain, wind, etc.
5.1.4 Scheduled services will not be performed immediately prior to or on the day of a Commemorative Area activity; advance coordination with the designated COR will identify when these events will occur.
5.1.5 Access into the Commemorative Area is monitored and controlled. The contractor must adhere to these access restrictions. No motorized four-wheel vehicles will be allowed onto the Commemorative Area grounds including the Equipment Park site. Access to the Equipment Park site in order to service the artifact display pads will be by manual means and/or with the use of hoses. All vehicles will remain on the asphalt parking areas of the cul-de-sac or those parking lots adjacent to the Commemorative Area.
5.1.6 The COR will approve the type of application equipment to be used. Manual (push behind) rotary and drop spreaders are acceptable. Mechanical spreaders, including stand-on models that are less 500 pounds in weight are acceptable.
5.1.7 The contractor will be responsible for any damage to any Commemorative Area property during the discharge of the requirements of this contract. Special care must be given to the asphalt surface areas when unloading or re-loading tools, equipment and materials. The COR will designate an authorized staging area when performing all scheduled services.
5.1.8 All un-used products, package and/or other materials will be removed from the Commemorative Area and taken to an off-post disposal site.
5.1.9 The Commemorative Area outdoor rest room is not to be used by contractor personnel for the cleaning of tools and equipment nor for the clean-up of crew personnel. An outdoor water faucet is available if an on-site water source is required.
5.1.10 When treating the Commemorative Area Equipment Park artifact display pads, the contractor will exercise extreme care and caution, using professionally accepted application methods, to prevent any “over spray” of a chemical onto the grounds area – a situation where existing grass would be damaged or destroyed. If such a situation were to occur, the contractor will be fully liable for all damages; i.e., to remove the damaged / contaminated sod and sub-surface top soil and replace the damaged area with new (high quality) top soil and sod. The contractor would need to remove the damaged or contaminated soil/sod and transport said material off the installation for disposal. The vendor will also have to water any such restored areas until the new grass has properly rooted.
5.1.11 During the treatment of each Equipment Park display pad, the contractor will exercise all appropriate precautions and use acceptable industry-standard / professional application techniques to prevent any damage to the artifact item, the display pad (which includes all pedestrian chain, pad posts, and signage). The weed control/treatment material applied must not stain, corrode, discolor or otherwise damage, whether from direct or indirect contact, in any way the existing Commemorative Area property. Such damage may occur from the product applied and/or the technique (methods / means) by which the crew performs the work required. This includes damage whether caused by direct or indirect contact.
5.1.12 Each display pad, once treated, will be marked with a small wire flag placed in the right front corner of the artifact display pad (the artifact information display sign is always located in the front of the item) to indicate for the COR that a treatment has been performed.
5.1.13 All Equipment Park artifact display pads will be treated at the same time with no exceptions unless unforeseen weather conditions necessitate a halt to the process for that day. In these instances, work will resume and be finished at the next opportunity when weather conditions will allow for the resumption of the work.
5.1.14 The contractor must not allow any material (liquid or dry products) to come into contract with Commemorative Area above-ground structure – including the Veterans Memorial Plaza. No mechanical application equipment is authorized to be used within ten feet of the perimeter of the Veterans Memorial Plaza. This grounds area will be treated using manual application methods. The contractor will be held fully liable for any work situation in which tools, equipment and/or product damages the Veterans Memorial Plaza. If such an incident were to occur, the COR must be notified immediately. Only COR directed mitigation actions (clean-up and/or restoration) will be permitted. These remedial actions may involve the use of a government approved contractor to properly rectify the situation in which case the contractor who caused the damage will be fully liable for all associated costs – government and non-government.
5.1.15 The contractor must monitor on-going weather conditions to control and to prevent any wind drift of material onto other Commemorative Area property adjacent to those areas being serviced. This requirement includes all of the following; fencing (all stone and metal fencing and the adjacent concrete maintenance strip), light poles, information signage, flower beds, sidewalks, curbing, bollards, picnic pavilion, buildings, steps, shed, asphalt vehicle areas, benches, picnic tables, outdoor waste receptacles, artifact display pads and the Veterans Memorial Plaza, etc. This protection requirement also extends to the method and means used to provide the specified services.
5.1.16 The contractor will, prior to leaving the Commemorative Area, remove any product residue from sidewalks, steps, vehicle parking areas, the bollard and fence maintenance concrete strip and curbing, etc. Acceptable removal means are by hand sweeping and/or using a mechanical blower to thoroughly remove any such residue.
5.1.17 The contractor will provide the COR with an application summary report immediately at the conclusion of each treatment. This report will state which materials were applied, the rate of the product (or products) application, the means used and the weather conditions at the time (wind, temperature, etc.)
5.1.18 The treatment of the artifact pads does not need to be performed on the same day as when the other grounds areas are serviced. A separate treatment schedule is provided for each of these two activities.
5.1.19 The contractor must adhere to all industry service standards and product specifications regarding the optimum weather conditions as to when and how to apply product and perform the service application. The government’s requirement is that all contracted services will be made during optimum weather conditions (wind, temperature, dew point, rain, sunlight, etc.) prior to, during and immediately afterward; i.e., so that preventable weather situations which will negate or reduce the effectiveness of the serviced treatment on controlling the growth of weeds and/or un-wanted grasses are avoided.
5.1.20 The contractor will return after a scheduled service has been performed and inspect the grounds for any areas inadvertently missed or which may require an additional immediate application of a product treatment. These contractor quality control measures will be performed (product and service) at no cost to the government.
5.1.21 The contractor is responsible for providing all of the tools and equipment necessary to fulfill the requirements of this contract.
5.1.22 Contractor shall submit for review pesticide labels and MSDS sheets for all the proposed pesticide products before each pesticide application season. All pesticides must be approved prior to application by the United States Army Environmental Command (USAEC) per documents Pesticide Use Proposal (PUP), adhering to pesticide labeling: Fort McCoy Memorandum 200-2 Installation Environmental Policy; Fort McCoy Regulation 200-3 Installation Integrated Pest Management Plan; Fort McCoy Regulation 420-28 Spill Prevention Control, Countermeasure and Installation Spill Contingency Plans; Fort McCoy Regulation 420-30 Installation Wellhead Protection Plan; and Department of defense Instructions 4150.7 Pesticide Management Program.
5.1.23 Contractor shall submit the Pest Management Form no later than the fourth day of the month following each application.
5.1.24 The contractor will perform a soil test every two years during the life of this contract and based on the results of that test make recommendations to the government as to adjustments in the products to be used. The government reserves the right to adjust product type and applications based on ground conditions at the time. The government can request an adjustment to this pre-defined application schedule based on conditions at the time.
