Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: Mission and Installation Contracting Command (MICC) Fort Leonard Wood (FLW), Missouri

2. Description of Action: The Logistics Readiness Center (LRC) at FLW requests a firm-fixed price contract modification with the Missouri Department of Social Services, 615 Howerton Ct., Jefferson City, MO 65109-6806. The Government projects award for August 2016 and Fiscal Year 2016 Operations and Maintenance funds will be used.

The Principal Assistant Responsible for Contracting approved a combined acquisition strategy/plan in accordance with DFARS 207.103(d)(i)(B) on 15 October 2014. An addendum to the combined acquisition strategy/plan was approved on 5 February 2016.

This action is a proposed modification to contract W911S7-16-C-0006. Contract W911S7-16-C-0006 is a fixed-price bridge contract awarded under authority of 10 U.S.C.

2304(c)(1) as implemented by FAR Part 6.302-1 -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

The actions taken to increase competition include posting a sources sought notice and conducting market research. Both were accomplished in compliance with DFARS PGI

206.304. Based on the results of market research MICC-FLW developed the Acquisition Strategy and Solicitation as a HUBZone set-aside with the caveat that the State Licensing Agency (SLA), considered other than a small business, will be allowed to compete under the provisions of the Randolph-Sheppard Act of 1936 (R-SA). The solicitation was published on the Government Point of Entry (FBO) on 10 February 2016 and proposals were received 11 March 2016.

Competition was achieved. However, the administrative record had to be more closely reviewed.

3. Description of Supplies/Services: The US Army Sustainment Command (ASC), Rock Island, Illinois; 407th Army Field Support BDE, Fort Hood, Texas; FLW-LRC, Supply and Services Division has a requirement under the Army Food Program to provide Full Food Services (FFS) in ten (10) dining facilities (DFACs) at FLW. FFS operations are those activities that comprise the full operation of an Army dining facility.

These include, but are not limited to, requisitioning, receiving, storing, preparing, and serving rations. FFS facilities are staffed entirely by contractor personnel. This requirement is subject to R-SA.

Period of Performance: Not To Exceed (NTE) 90 days from date of award.

Total Value: $8,200,000

4. Authority Cited: 10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements.

5. Reason for Authority Cited: As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for.

(a) The proposed sole source Contractor is the State of Missouri SLA. This requirement is subject to the RSA, which provides a priority for blind vendors recognized and represented by SLAs in the award of contracts for, among other things, the operation of cafeterias on Federal property. The previous contract for FFS, W911S7-09-D-0029, was awarded to the State of Missouri SLA on a noncompetitive basis under the authority of 10 U.S.C.2304(c)(1), as implemented by FAR 6.302-1. The follow-on acquisition planning process was delayed for multiple reasons. At the beginning of the process, FLW still had military cooks in one (1) DFAC so MICC-FLW began processing two requirements; one for FFS and one for Dining Facility Attendants only in accordance with the Army policy that the term “operation of the cafeteria” (which is the predicate for applying the priority afforded the SLA under the R-SA) applies strictly to FFS only.

Based upon reorganization at FLW, there have been military reductions that have resulted in no military cooks remaining at FLW. The approach was revised again to incorporate changes to the PWS prepared and promulgated by the requiring activity.

The dynamic nature of the requirement delayed the Army’s ability to develop a competitive follow-on solicitation packet in a timely manner. Acquisition Strategy approval was granted on 15 October 2014. However, due to discussions between ASC and Field Directorate Office – Eustis (FDO-Eustis) regarding the period of performance, an addendum to the Acquisition Strategy was developed. The Acquisition Strategy Addendum and Solicitation Review Board packet was submitted to FDO-Eustis for initial review on 26 January 2015. Due to the various levels of reviews and multiple Procurement Analyst changes, Acquisition Strategy Addendum and Solicitation Review Board clearance was not granted until 5 February 2016. Due to the delays noted above, eight (8) sole source contract extensions or bridge contracts (1 June 2014 – 12 August 2016) have been awarded in order to allow the necessary time to process the follow-on contract.

(b) Alternatives: There are two alternatives: Alternative 1; FFS ceases at 23:59 on 12 August 2016 until the new contract is in place; Alternative 2; award an extension for 90 calendar days to continue services.

Alternative 1 may be viable at installations that are populated by permanent party Soldiers. These personnel could conceivably be placed on separate rations and procure their own meals. The situation at FLW is different; the Soldiers here are in a training status with the majority of Soldiers being in One Station Unit Training (OSUT) or Basic Training (BT). These new Soldiers do not have the means to procure their own meals if

For Official Use Only placed on separate rations nor does the training rhythm permit the time required for these Soldiers to travel to an eatery and return to training without undue disruption to the training cycle. For these two reasons Alternative 1 is not a viable option for FLW.

Alternative 2 is viewed as the only real option available to FLW. As stated above the majority of Soldiers served by the FFS contract at FLW are in an initial training status and have no viable alternative to the DFAC for their meals. Extending the services with the current contractor on a short term basis ensures that the initial entry training Soldiers will be able to maintain their training tempo while being sustained with the meal support that is critical to their mission accomplishment.

(c)

1) The verified minimum requirement of the Government is FFS in ten (10) dining facilities (DFACs). The current contract expires 12 August 2016. A 90-calendar day contract modification will provide the necessary time to complete the source selection and Contract Review Board process.

2) This requirement is for a 90-calendar day contract extension with the incumbent contractor. The FFS effort at FLW encompasses 10 DFACs and prepares and serves approximately 25,000 meals per day. Given the time constraints in this situation, the SLA and its subcontractor are the only entity in position to ensure continuation of these FFS operations.

3) If this J&A is not approved, no Soldiers will be fed from 13 August 2016 until the new contract is awarded.

6. Efforts to Obtain Competition: The Contracting Officer published the notice required by FAR 5.201 on 6 November 2015. The solicitation was published on the Government Point of Entry (FBO) as a HUBZone set-aside with the caveat that the SLA, considered other than a small business, would be allowed to compete under the provisions of the R- SA on 10 February 2016 and proposals were received 11 March 2016.

Effective competition was achieved because multiple proposals were received.

7. Actions to Increase Competition: The actions taken to increase competition included posting a sources sought notice and conducting market research. Both were accomplished in compliance with DFARS PGI 206.304. Based on the results of market research MICC-FLW developed the Acquisition Strategy and Solicitation as a HUBZone set-aside with the caveat that the SLA, considered other than a small business, would be allowed to compete under the provisions of the R-SA. The solicitation was published on the Government Point of Entry (FBO) on 10 February 2016 and proposals were received on 11 March 2016.

Competition was achieved. However, an unexpected event occurred and the evaluation process was placed on hold pending guidance from higher headquarters.

8. Market Research: In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), an intent to sole source/sources sought was posted to Federal Business Opportunities on 29 April 2016. Six responses were received, however, none of the vendors meet the requirements of the R-SA.

9. Interested Sources: To date, no sources have written to express interest in the acquisition other than the sources sought responses that were received.
