4. Authority Cited: Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901 (or 41 U.S.C. 1903 for Special Emergency Procurement) as implemented by FAR Subpart 13.5:
Unusual and compelling urgency FAR 6.302-2 Exclusive licensing agreements Industrial mobilization Other: State the purpose
5. Reason for Authority Cited:
a. Why is this an urgent need?
Critical safety systems have failed at the Materiel Test Facility (MTF). This failure has greatly increased the risk of conducting hazardous operations with Chemical Warfare Agents (CWAs) at the MTF. Residual safety systems are on the verge of collapse and are expected to failure at any time. Complete failure will put workers and the environment at risk of exposure to CWAs. In additional, failure of the residual systems will halt vital chemical defensive testing that support the safety of soldiers. This effort will replace/repair the failed systems and protect our workforce and the environment from the hazards of Chemical Warfare Agents.
b. What would be the impact if the purchase of equipment and install were delayed for up to 8 weeks to allow for competition of requirement?
As stated above - The residual safety systems of the MTF are on the verge of collapse. These systems are many years beyond their expected life cycle. Delay greatly increases the likelihood that safety systems will completely fail before they can be repaired/replaced. Failure of the residual systems will put the workforce and the environment at risk of exposure to Chemical Warfare Agents.
c. What would the life/safety/health impact be if requirement not completed as soon as possible?
Chemical Warfare Agents are some of the most hazardous chemicals known to man. The risk of failure of the residual safety systems is very high. This leads to a high life/safety/health and environmental impact.
d. What would the cost impact be if current equipment failed?
If the residual safety systems failed during a hazardous operation with CWA the cost could be in the hundreds of thousands of dollars. This does not include the possibility of damage to life, health or the environment.

6. Actions to Increase Competition:
This is an urgent and compelling requirement. If time were available to compete, at least one other provider would be capable of providing (Compressor Pump and Service, Salt Lake City, Utah).
7. Market Research: The proposed provider, Mountain Valley Mechanical (MVM), installed the existing 2 generators that currently supply laboratory air to the CHEM TEST facility. This company has manpower and equipment to quickly install, setup, program the systems using knowledge gained during install of other two compressors now supply air to lab.
NOTE: This action is put in place to complete a partially completed contract that was cancelled when the Department of Health and Human Services (HHS) abruptly terminated the action due to their contract warrants being suspended. MICC-DPG has been pressed into supplying the effort to complete the requirement.
8. Other Facts:
9. Technical/Requirements Certification: I certify that the supporting data under my cognizance which are included in the justification are accurate and complete to the best of my knowledge and belief.
10. Best Value Determination/Fair and Reasonable Cost Determination: I hereby determine that the order represents a fair and reasonable price to the Government. Additionally. The MICC- DPG office will ask for “other than certified” cost/price information to show labor rates, overhead, material costs, etc. are fair and reasonable PER FAR Part 15.
This determination will be made using the following: price analysis and IGCE
__X__Other: Contract Specialist has gathered estimates from manufacturers.
10. Reviews: I have reviewed this justification and find it adequate to support limiting competition:
