4. Authority:
FAR 13.106-1(b)(1): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available, urgency, exclusive licensing agreements, brand name, or industrial mobilization.
5. Reasons for Authority Cited:
a. Dugway scientists require an online bibliographic database that provides access to an index of the world's largest, most comprehensive collection of chemical information including molecular substances, reactions, and related content. Included in this collection must be the complete suite of current and archival American Chemical Society journals and other publications. In addition the database user interface must be web-based, user friendly, intuitive, and require no expertise in command language searching. Searching by keyword, structures, reactions, substances, patents, and journal references must be available. The recent market research proved the only product available on the market today that meets all these criteria is CAS SciFinder.
b. The American Chemical Society (ACS) holds the intellectual property rights to the information in the databases produced by CAS, a division of ACS. Chemical Abstracts Service databases are the only known source for the proprietary data that includes over 23 million records from over 9,000 journals and patents of chemical information.
SciFinder, a Trademark of ACS, provides direct access to this source of scientific literature and patents that is unique in its comprehensive coverage.
c. SciFinder software provides the most powerful, flexible, user friendly, and highest quality access to chemical literature. CAS provides the world’s most comprehensive body of general chemical literature. There is no competitor in the market who provides this comprehensive a collection coupled with this effective and efficient an access method.
6. Publicizing Contract Actions: For FAR Part 13 actions, the public display and synopsis requirements of FAR 5.101 and FAR 5.203 do not apply due to the $ threshold, apply and will be followed, or do not apply due to an exception at
5.202 ______________________. (Fill in exception).
Requirement to post justification in accordance with FAR 8.405-6(b)(3), FAR 13.105(c), or FAR 16.505(a)(4)(iii)(A)
Action is NOT a brand name restriction and is under $150K, no posting required
Action is a brand name restriction, under $25K, no posting required Action is a brand name restriction, over $25K. It will be redacted and posted with the solicitation.
Action is a brand name restriction over $25K but will not be posted due to exception:
FAR 6.305(f) FAR 8.405-6(b)(3)(iii)(A)
FAR 8.405-6(b)(3)(iii)(B) FAR 8.405-6(b)(3)(iii)(C) FAR 16.505(a)(4)(iii(C)
7. Market Research:
Mandatory sources: AbilityOne, UNICOR, GSAAdvantage searched with negative results. Conducted Google search: found SciFinder in Facebook, Twitter discussion boards. LibGuides at Univ of San Diego, CA also provided by CAS. SciFinder used at Univ. of CA, restricted to students, also provided by CAS. Searched the Federal Procurement Data System. In general prices depend on the size of the agency purchasing the product; exception might be educational institutions who are educating future product users. In 2015 West Point paid $6,605, USDA Agricultural Research Service paid $7,690, US Army Natick paid $32,475, and APG paid $68,455. Also noted that on the Federal Procurement Data System and FedBizOpps sites, all agencies let sole source contracts for SciFinder. The rationale varies slightly from agency to agency but comes down to the fact that SciFinder is the only known source that provides the proprietary data covering over 23 million records from over 9,000 journals and patents of chemical information.
