Justification and Approval for Other than Full and Open Competition
1. Contracting Activity: Army Contracting Command Detroit Arsenal (ACC-DTA), proposes to acquire the items described herein under the authority of this Justification for other than full and open competition.
2. Description of Action: ACC-DTA proposes to award a Firm Fixed Price (FFP) contract to Engineering Technology Corporation, for the purchase of one new Filament Winder (with the option for a second machine) needed at Watervliet Arsenal (WVA).
FY23 PM Abrams funding will be used for this procurement.

3. Description of Supplies/Services: This procurement is for one (1) new Filament Winder with an option for a second machine, with all the features and accessories defined in the Equipment Engineering Specification #16-22-3419. The Engineering Technology Corporation Filament Winder will be used in the production of all cannon tube bore evacuators. This action will be funded with Fiscal Year 2023 Production Base Support funding in the estimated amount of $1,000,000 for one machine and an estimated amount of $1,000,000 for the option for a second machine with a total cost of $2,000,000.
Dollar and Amount:
The estimated total purchase price, including the option, is $2,000,000.
4. Authority Cited: The statutory authority permitting other than full and open competition for this action is 41 U.S.C. 1901 as implemented by FAR 13.501(a) Sole source acquisitions (application for brand-name descriptions).
5. Reason for Authority Cited: Engineering Technology Corporation is uniquely qualified to fulfill the contract requirement because they are the Original Equipment Manufacturer (OEM) of the Filament Winder System which has features that are peculiar to this manufacturer.

Another manufacturer would have to develop, receive approval, and test these winding profiles which would lead to additional cost and uncertainty to the Government. Additionally, the space where the Government intends to install the filament winding machine was the site of a similar Engineering Technology Corporation filament winding machine in the past. Therefore, site infrastructure work will be kept to a minimum.
Engineering Technology Corporation is the only manufacturer that can provide this piece of equipment to the Government with minimal cost and technical risks. The Government would incur significant duplication of costs for the research, development, installation, production, and sustainment of the filament winding machine. These costs are not expected to be recovered through competition. In order to pursue full and open competition for the Filament Winder, the Government would have to either procure a Technical Data Package (TDP) from Engineering Technology Corporation or issue a solicitation for the Filament Winding Machine based on a performance specification.
6. Efforts to Obtain Competition:
a. Effective Competition: As described in section 5, this procurement requires a specific Filament Winding machine that only Engineering Technology Corporation is capable of providing, therefore this action will not be competed. The notices required by FAR
5.201 will be published and any proposals received will be considered.
b. Subcontracting Competition: Engineering Technology Corporation is a large business and will require a subcontracting plan. The new contract will contain clauses FAR 52.204-10, Utilization of Small Business Concerns, FAR 52.219-16 Liquidated Damages Subcontracting Plan, FAR 52.244-5 Competition in Subcontracting, and FAR 52.244-2 Subcontracts.
7. Actions to Increase Competition: Engineering Technology Corporation is the only known manufacturer of the Filament Winding machine to support this specific Army requirement. This procurement will be synopsized on the System for Award
Management (SAM) requirement will be considered and reviewed for their capability to produce a Filament Winding Machine that matches the requirements in the Performance Specification. The Government will continue to survey the marketplace and review our acquisition strategy should additional information be received. Any information received will be considered to determine potential future requirements.
8. Market Research: The Contract Specialist posted a Sources Sought notice on www.sam.gov November 28 - December 1, 2022. There were no contractors that showed interest.
An Equipment Specialist at the Watervliet Arsenal conducted market research through the internet and used personal knowledge of the supplies/services of this type based on general knowledge acquired in the workplace. There were other manufactures that were contacted directly through email, no one showed interest in working with us. It was determined that the Engineering Technology Corporation Filament Winder and associated tooling packages are not available from any other vendors. This resulted in the determination that Engineering Technology Corporation, is the only contractor with specifications, schematics, and proprietary information necessary to manufacture the Filament Winder.
Based on the market research, the features of this product from Engineering Technology Corporation essential features provided in paragraph 5 above.
9. Interested Sources: To date, no other sources have written to express an interest.
10. Other Facts:
a. Procurement History: In FY1985 and FY 2002, the Watervliet Arsenal procured similar Filament Winders from Engineering Technology Corporation, custom models that have gone through retrofits and rebuilds that are still running today.
The contract number or any other information is not available at this time due to the age of the previous procurement.
b. Other Facts:
machines within ACC-WVA. Having compatibility with the other machines is very important, as it provides workload flexibility and interoperability of equipment.
This could result in unexpected delays in commissioning the winding machine as problems and errors could occur during the operation of the winding machine and users will be required to learn the new operation of the winding machine. A filament winding machine from Engineering Technology Corporation would avoid these problems and it w of this product from Engineering Technology Corporation are essential to the essential features.

Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable based on the Independent Government Estimate.
