PROVISIONS

SPECIAL NOTE TO ALL VENDORS: PLEASE READ THE FOLLOWING COMMENTS.

PROVISION 1 - Contract Specialist: Tamula McCombs, (256)235-6904, tamula.c.mccombs.civ@mail.mil

The following documents are incorporated as part of this solicitation.

1 Statement of Work

2 Technical Information Questionaire

3 Evidence of Authority To Sign Offers

PROVISION 2 - Award will be made to the responsible offeror whose offer, conforming to the solicitation, will be most advantageous to the Government, considering price and price related factors. The following factors shall be used to evaluate offers:

(i) Technical capability of the item offered to meet the Government requirement;

(ii) Delivery;

(iii) Price;

Technical Capability is more important than Delivery and Price. Delivery is slightly more important than Price.

When combined, Technical Capability and Delivery are significantly more important than Price. While Price is not the most important factor, the closer the Offerors' evaluations are in those factors other than Price, the more important Price becomes in the decision. Notwithstanding the relative order of importance of the three evaluation factors as stated herein, Price may be controlling when:

(1) Proposals are otherwise considered approximately equal in Technical Capability and Delivery; or

(2) An otherwise superior proposal is unaffordable; or

(3) The advantages of a higher rated, higher priced proposal are not considered to be worth the price premium.

(b) Affordability- Price can also play a role in the Government evaluation of the affordability of an Offeror's proposal. An Offeror may not receive an award if his proposal is unaffordable, even though the proposal is judged to be the best value to the Government.

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

PROVISION 3 ‐ The specified items must comply with all requirements of the Statement of Work (SOW). PLEASE

SUBMIT A PRODUCT DESCRIPTION SUFFICIENT TO VERIFY THAT THE PRODUCT MEETS ALL

PARAGRAPHS OF THE SOLICITATION STATEMENT OF WORK. Please refer to the ADDENDUM OF 52.212-1.

The vendor shall state at time of proposal either "EXCEPTION" or "NO EXCEPTION" to each and every paragraph of the STATEMENT OF WORK. Where exception is taken, the degree of noncompliance shall be fully explained. The bid shall clearly indicate any exceptions to, or alternatives to, every part of this specification.

Bids shall be arranged similar to this specification and shall reference paragraph numbers for ease of analysis and discussion, if the Government determines discussion to be necessary.

PROVISION 4 - TECHNICAL LITERATURE IS REQUIRED FOR THIS SOLICITATION. Please see the following clause and review in their entirity:

52.0214-4713 TECHNICAL LITERATURE--SUPPORTIVE DOCUMENTATION (OCT 1993)

52.0214-4803 TECHNICAL LITERATURE (OCT 1993)

(a) Technical literature must be furnished with the proposal. The literature must be identified to show the item in the offer to which it pertains. The technical literature is required to establish, for the purposes of proposal evaluation and award, details of the products the offeror proposes to furnish. Technical literature on the items proposed must explain in detail the functional capabilities, logical operation, exact speed and capacities, limits, configuration rules, features, and interfaces.

(b) Failure of the technical literature to show that the products offered conform to the specifications and other requirements of this Request for Proposal may cause rejection of an offer.

PROVISION 5 ‐ Items quoted must meet or exceed standards of the suggested parts listed in the item descriptions.

Technical evaluations will be performed. Contractor to show how your proposal meets each and every salient feature listed within the statement of work and the Technical Information Questionaire. The statement of work is located on page ____ of this contract.

52.0000-4702 AMC-LEVEL PROTEST PROGRAM

If you have complaints about this procurement, it is preferable that you first attempt to resolve those concerns with the responsible contracting officer. However, you can also protest to Headquarters, AMC. The HQ, AMC-Level Protest Program is intended to encourage interested parties to seek resolution of their concerns within AMC as an Alternative Dispute Resolution forum, rather than filing a protest with the General Accounting Office or other external forum. Contract award or performance is suspended during the protest to the same extent, and within the same time periods, as if filed at the GAO. The AMC protest decision goal is to resolve protests within 20 working days from filing. To be timely, protests must be filed within the periods specified in FAR 33.103.

Complete AMC Protest Procedures can be found at: http://www.amc.army.mil/amc/commandcounsel.html

An agency protest may be filed with either the contracting officer or to HQAMC but not both following the procedures listed on the website above.
