HCAA Local Clause 5005 (LPTA)
ADDENDUM TO 52.212-2
Paragraph (a) is hereby replaced with the following:
a. Evaluation procedures: The Government will evaluate each quotation using Simplified Acquisition Procedures under FAR 13.5, Simplified Procedures for Certain Commercial Items, lowest price, acceptable past performance and technically acceptable quote to the Government. The Government will evaluate Factor (1) Technical Capability to determine technical acceptability, Factor (2), Past Performance, and Factor (3) Price, to determine the lowest total price. Award will be made using the lowest price technically acceptable (LPTA) evaluation process. Award will be made to the responsible quoter on the basis of the lowest evaluated price of quotes meeting or exceeding the acceptability standards for technical factors, and acceptable past performance. The Government will evaluate each quoter’s past/present performance based on the information taken from all sources, including but not limited to Defense Past Performance Information Retrieval System (PPIRS). The Government intends to make an award without conducting discussions. After the initial evaluation of quotations is completed, if one or more quotations are rated Acceptable Technical, the initial evaluation will become the final evaluation of quotations and award will be made without discussions to the lowest priced quote with acceptable past performance. If any one (1) technical subfactor is rated Unacceptable after the initial evaluation, the technical factor will be rated Unacceptable and the quote will no longer be considered for award. If all quotations submitted result in an unacceptable technical evaluation, then exchanges may be necessary. In that event, the Government evaluation team will evaluate the quoter's response to the Government exchanges with each quoter.
Factor 1 - Technical: The vendor shall submit a written quote which explains how to comply with the requirements in the RFQ:
Evaluation Criteria Standard Standard
InnoVet Versa DR System-9MP Acceptable Unacceptable
Subfactor 1: Contractor shall meet all salient characteristics.
Subfactor 2: Reserved.
Subfactor 3: Reserved.
Subfactor 4: The equipment offered shall be 380-400V / 50Hz, Three Phase
Subfactor 5: The support equipment, i.e., Workstation, Monitor, CPU, Mini UPS, etc., shall be 220V, 50Hz, Single Phase
Subfactor 6: The X-Ray generator shall be Minimum 40kW
Subfactor 7: The equipment offered shall be DICOM compliant
Subfactor 8: The equipment offered shall be Windows 7 compliant.
Subfactor 9: The equipment offered shall have minimum 1TB storage capacity
EVALUATION STANDARDS. The quoter’s technical quote will be evaluated using the following standards for a final rating:
ACCEPTABLE: A quote that meets the Government’s technical requirements identified in the Request for Quotation.
UNACCEPTABLE: A quote that fails to meet the Government’s technical requirements identified in the Request for Quotation.
Factor 2-Past Performance: The Government will evaluate each quoter’s past/present performance based on the information taken from all sources, including but not limited to Defense Past Performance Information Retrieval System (PPIRS).
The Government will use the following standards to evaluate Past Performance:
(1) Acceptable - Based on the quoter’s performance record, the Government has a reasonable expectation that the Quoter will successfully perform the required effort, or the quoter’s performance record is unknown.
(2) Unacceptable – Based on the quoter’s performance record, the Government has no reasonable expectation that the Quoter will be able to successfully perform the required effort.
NOTE: In the case of a quoter without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the quoter may not be evaluated favorably or unfavorably on past performance. Therefore, the quoter shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
Factor 3 - Price: The Government will select the quote that is based upon the lowest evaluated price, technically acceptable quote. All Contract Line Item Numbers (CLINS) must be priced by the quoter. If the quoter failed to price all CLINs, the quote will not be considered for award.
(b) A quotation is not an offer and, consequently, cannot be accepted by the Government to form a binding contract. Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
(c) The word "quoter" shall be substituted for the word "offeror" wherever it appears in FAR 52.212-3, Alternate I and DFARS 252.212-7000.
