Description of Supplies/Services: The Department of Pathology is requiring a renewal Base Year lease of the Sysmex Hematology Analyzer, (including reagents & supplies) for connection to the existing Roche Diagnostic Equipment currently installed in the Laboratory. The Government entered into a contract (W81K02-16-D-0008) with Roche Diagnostics as part of MAMC Core Laboratory’s transition to total laboratory automation (TLA), which provides the greatest move forward for providing the highest quality patient testing results in the shortest amount of time, thereby improving efficiency.

TLA also helps to reduce the need for the Physicians to have to order STAT tests because all tests are handled quickly and results in the shortest time period possible. This reduces long term staffing requirements, thereby providing a savings to the Government in civilian personnel costs.

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited: Based on research this requirement for equipment lease and reagent supplies, are proprietary, to Sysmex America on the Hematology Analyzer lease & Roche Diagnostics by company signed letter, for sole source connection to their equipment in creating the Core Laboratory.

6. Efforts to Obtain Competition: A general competitive effort is made throughout the requirement review process which considers the applicability of supplies, services & leases available from various sources to determine the one that best meets the needs for the patients. The intended contractor has been identified as the only source capable of meeting these requirements.

7. Actions to Increase Competition: Sysmex America Inc. is the only authorized source vendor authorized by Roche Diagnostics to connect their hematology system and provide the required laboratory testing improving accuracy, timeliness, overall quality as a goal in achieving Total Laboratory Automation (TLA). This effort at the requirement definition level as a Sole Source is not normally publicized on Federal Business Opportunities, except as a “Special Notice with J & A “in accordance with FAR 5.201, but is standard industry practice. This notice will be posted to FBO.

Efforts to obtain competition are not practical because of the sole proprietary rights as of both manufacturers. The contractor as listed is the only source capable of meeting the requirement outlined by the customer without impacting the critical mission of patientcare
