Limited Sources Justification or Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold (Simplified Acquisition Threshold is $250K)

Joint Base Lewis-McChord Tacoma WA Super CEEP # 1239-19-987 is requesting a Vbeam® Prima Pulse Dye Laser (PDL), as replacement for an older system which has reached its Life- Cycle replacement.

Description of Supplies/Services: Madigan Army Medical Center, Department of Dermatology is requiring a Vbeam® Prima, an advanced 595 nm pulsed dye laser (PDL), with the addition of a 1064 nm wavelength and multiple new features. The Vbeam® Prima Laser will be able to effectively treat a broad range of skin conditions, including: rosacea, port wine stains, acne, facial, leg and spider veins, scars, benign pigmented lesions and wrinkle, warts, stretch marks and photo aging. The Vbeam® Prima represents a step forward in the treatment of vascular and pigmented skin conditions and is a positive move forward in improving the quality in the treatment of patient care.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: Based on research this requirement is Sole Source by the manufacturer, Syneron Candela Corporation by company signed letter, for this is the only laser which combines both the 595 nm and 1064 nm lasers necessary to treat specific vascular and complex skin conditions. Other research indicates these lasers are available separately from other manufacturers, at a much higher cost and storage capacity space. There is an inability to use the two separate lasers if on a different platform during the same patient use due to limited power source access.
6. Efforts to Obtain Competition: A general competitive effort is made throughout the requirement review process which considers the applicability of products & services from various sources to determine the one that best meets the needs for the patients. The intended contractor Syneron Candela Corporation has been identified as the only source capable of meeting the requirements based on the salient characteristics and research.
7. Actions to Increase Competition: Syneron Candela Corporation is the only authorized source available to provide the required equipment. This effort at the requirement definition level is not publicized on Federal Business Opportunities, except as a “Special Notice” in accordance with FAR 5.201, but is standard industry practice. This J & A will be posted to FBO. Efforts to obtain competition are not practical because of the sole proprietary rights as the distributor & manufacturer, and uniqueness of the equipment. Contractor as listed is the only source capable of meeting the requirement outlined by the customer without impacting the critical mission of patient care
8. Market Survey: This is a new Vbeam® Prima Pulse Dye Laser (PDL) (Class 6515). Detail, including key work searches described in the Market Research report which supports this J & A can be found in PCF Cabinet under Market Research. Market Research has been conducted by searching the Dynamic Small Business search using NAICS Code: 334510. Results from the research did not locate any small businesses that could provide the aove products.
