Limited Sources Justification or Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold (Simplified Acquisition Threshold is $250K)

2. Description of Action: Madigan (MAMC) Army Medical Center, WA, is requesting a follow-on award for: Specialty Medical Gases & Bulk Oxygen.

Description of Supplies/Services: Madigan Army Medical Center, is requiring a Base, one-year, contract to provide specialty medical gases, bulk oxygen, cylinder exchange and related medical supplies for MAMC and its outlying MTF Clinics.

4. Authority Cited:

(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited: This requirement is for acquisition of specialty medical gases, and bulk oxygen as described under FAR 13.106-1(b)(1)(i) for Madigan Army Medical Center. The availability replacement of cylinders along with refill of the bulk oxygen system that supplies the entire hospital is mission essential, critical in treatment of patient care, time sensitive in situations of urgency requirement needs and possible emergencies that may arise. This contractor’s past performance has been acceptable without incident maintaining regulatory safety protocols in providing the products, equipment accessories necessary and serves as the best overall value for the Government and the mission to continue.

6. Efforts to Obtain Competition: A general competitive effort is made throughout the requirement review process which considers the applicability of products & services from various sources to determine the one that best meets the needs for the requirement and the patients. The intended contractor has been identified as the only source capable of meeting the requirements prescribed.

7. Actions to Increase Competition: Airgas LLC is the only local area source available to provide the required specialty medical Gases, & bulk oxygen, with deliveries available within an hour and in cases of emergencies. This effort at the requirement definition level is not publicized on Federal Business Opportunities, except as a “Special Notice”, but is standard industry practice. This Special Notice with the J & A will be posted to FBO. Efforts to obtain competition are not practical because of the sole proprietary owned equipment OEM installed at Madigan, as part of the contractors delivering of cylinders and bulk oxygen. Contractor as listed is the only source capable of meeting the requirement outlined by the customer without impacting the critical mission of patient care.

8. Market Survey: This is FSC (Class 6830). Detail, including key work searches described in the Market Research report which supports this J & A can be found in PCF Market Research. Market Research has been conducted by searching the Dynamic Small Business search using NAICS Code:

325120. Results from the research did not locate any small businesses that could provide the above products.
