Limited Sources Justification or Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold (Simplified Acquisition Threshold is $150K)
1. Contracting Activity: Regional Health Contracting Office-Pacific, Health Contracting Cell, Joint Base Lewis-McChord (JBLM), 673 Woodland Square Loop SE, Lacey, WA 98503.
2. Description of Action: Madigan Army Medical Center, Tacoma WA is requiring a follow-on Lease; with Base year & 2 One-year Options.

3. Description of Supplies/Services: This requirement is for the follow-on of W91YU0-15-P- 0649, BD Bactec FX lease which will expire on 30 September 2018, for continued use in the Department of Pathology / MAMC. BD is the only known source that offers a blood culture system that has the capability to run DHA Standardized BD Aerobic and Anaerobic testing using their glass and plastic culture bottles currently a standard in all Madigan areas of care.
The BD Bactec FX System will only use the MFG’s supplies, as this system is currently under lease by the Government with the standardization protocols established by Madigan, to include all MTF Clinics.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): Fair In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: This requirement is for a follow-on lease, using BD Bactec FX Blood Culture System with specialized blood culture bottles currently as part of the DHA Standardization of care in use at Madigan, and all outlying medical clinics, described under FAR 8.405-6(a)(1) (ii), equipment is located at Madigan Army Medical Center, Tacoma, WA. Becton Dickinson is the sole vendor with proprietary rights to lease its equipment as the manufacturer & distributor of their blood culture products for this system.
6. Efforts to Obtain Competition: A general competitive effort is made throughout the requirement review process which considers the applicability of other services, if available from other sources to determine if compatibility in providing the same services are available. Otherwise, at present the intended contractor is the only source capable of meeting this requirement in maintaining the best intent and interest of the Government.
7. Actions to Increase Competition: Becton Dickinson & Company, the only authorized source available to provide the required lease and supplies on the existing equipment. This effort at the requirement definition level is not publicized on Federal Business Opportunities, except as a “Special Notice” in accordance with FAR 5.201, but is standard industry practice. Efforts to obtain competition are not practical because of the sole proprietary rights as the manufacturer, in providing service, parts and products on the leased equipment; therefore the intended contractor as listed is the only source capable of meeting Salient Characteristics outlined by the customer without impacting the critical mission of patient care
8. Market Survey: This requirement is for a follow-on lease of the BD Bactec FX Blood Culture System (FSC Class W065). Details, including key work searches described in the Market Research report which supports this J & A can be found in PCF A.01.01_Market Research. Market Research has been conducted by searching the Dynamic Small Business search using NAICS Code: 532490.
Results from the research did not locate any small businesses that could provide the above lease with the required parameters..
