Limited Sources Justification or Sole Source Justification for Acquisitions under the Simplified Acquisition Threshold (Simplified Acquisition Threshold is $150K)

1. Contracting Activity: Joint Base Lewis McChord – Healthcare Contracting Cell (JBLM-HCC) 673 Woodland Square Loop, Suite 101, Lacey WA 98503.

J&A Tracking #: 16-RHCO-P-195

2. Description of Action: Munson Army Health Center has a requirement to continue services for Tele-Radiology Services (i.e. off-site radiological interpretations). The Contractor will provide professional diagnostic radiological initial interpretations and communications with the ordering physician, presentation of final reports and shall transcribe the reports onto a secure internet website.

The Government transcriptionist will then access the secure website and transfer the reports into the Composite Healthcare System (CHCS). The Period of Performance is 1 April 2016 – 30 Jun 2017.

This requirement is a twelve month period with a total estimated acquisition cost of $78,000.

Requirement: New Repeat Pricing: Firm-Fixed Price Time & Materials Cost Funds: OMA Other Funds: DHP_ Total Dollar Value: $ 78,000

Name of Intended Contractor: Real Radiology, LLC Street Address: 450 Regency Parkway, Suite 200 City, State, Zip: Omaha, NE 68114

Phone: (402) 932-0235

3. Description of Supplies/Services:

The Contractor will provide professional diagnostic radiological initial interpretations and communications with the ordering physician, presentation of final reports and shall transcribe the reports onto a secure internet website. The Government transcriptionist will then access the secure website and transfer the reports into the Composite Healthcare System (CHCS).

4. Authority Cited:

(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR

(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR

(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR

(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.

5. Reason for Authority Cited:

This is for the follow-on for contract W91YU0-15-P-0068. The purpose of this contract action is for the continuation of services until the MEDCOM competitive contract is awarded by the Health Readiness Contracting Office. MEDCOM Tele-Radiology contract will not be completed on time;

therefore a “bridge” is needed to ensure continued services. There are certain barriers that would make it impossible for another source to perform the Government’s requirement. The requirement calls for multiple Information Technology (IT) and security requirements otherwise known as Department of Defense Information Assurance Certification and Accreditation Process (DICAP) that must be met to access reports in the Composite Health Care System (CHCS) at Munson Army Health Center. Additionally, the Business to Business (B2B) Agreement must be completed; the Virtual Private Network (VPN) must be established and approved. Given the nature of the services and the amount of coordination required to prevent a disconnect in service, a transition of this service from one contract company to another is anticipated to take approximately six (6) to eight (8) months. A lapse in service would have an immediate negative impact, and potential mission failure in providing current health care operations and current health care services to our soldiers, civilians, and beneficiaries who rely on these services. The incumbent contractor Real Radiology, LLC, is able to provide uninterrupted services immediately following this award, which results in no disruption, delay, or harm to the Government, soldiers, civilians, and beneficiaries. Therefore, awarding a sole-source bridge purchase order to Real Radiology, LLC is in the best interest of the Government because they are the current Contractor, and they hold current Business-to-Business (B2B) computer connections in place. The pricing for this purchase order will be at the same rates awarded in the last contract

(W91YU0-15-P-0068).

6. Actions to Increase Competition:

CHCC is establishing a long term command-wide Tele-radiology contract via full and open competition after the exclusion of sources.

This will be posted on ASFI to increase competition.

7. Market Survey:

Market research was not conducted. There are several qualified sources under the now expired MEDCOM Tele-radiology Blanket Purchase Agreements: US Radiology (W81K04-09-A-0004), Heritage Radiology Solutions (W81K04-09-A-0006), On Line Radiology Medical Group, Inc.

(W81K04-09-A-0007), Valor Network, Inc. (W81K04-09-A-0008), and Real Radiology, LLC.

(W81K04-09-A-0009 and W91YU0-15-P-0068).

8. Procurement History:

Previous Contract or Purchase Order Number: or X N/A W91YU0-15-P-0068 Previously competed? N/A No Yes Previous authority for less than Full & Open Competition: FAR 13.106-1(b) Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization).
