For Official Use Only (See FAR 2.101 and 3.104-4)

(1 October 2015)

Justification and Approval for Other than Full and Open Competition Under FAR 13.501

1. Contracting Activity: Regional Health Contracting Office - Pacific (RHCO-P), U.S. Army Command, Tripler Army Medical Center, Hawaii

2. Description of Action: A Class Justification and Approval is being sought to award 3 bridge purchase orders for the remaining bridge contracts that were issued against 1O Army Direct Contract Medical Services, Generation 1 (ADCMS G1) contracts as well as a Nursing contract that will be ending prior to the award of the ADCMS G2. The Long-Term Nursing contract was used in the creation of the IGE estimates for the ADCMS G2 and therefore cannot be awarded as a separate contract.

The ADCMS G1 contract expired on 08 July 2012. In July 2014, a class justification and approval (14-

072) was sought and approved for the award of 4 bridge purchase orders to replace the remaining ADCMS G1 task orders for no more than one year as a stop gap measure until the award of the ADCMS G2. It is now February 2016 and the ADCMS G2 has not been awarded. Although award is estimated for March 2016, due to the quantity and types of personal service providers required, in conjunction with the 60-90 days it takes to recruit and fill these positions, as well as an additional 30 days to certify the personal service providers, it would take a new contractor up to 120 days to recruit, credential, and staff these critical services after date of award.

The performance period for each of the purchase orders replacing the above purchase orders are for 6 months, plus the Option to Extend Services clause. The services will be priced at the same cost as the last period of performance they are replacing. Funding for these requirements are available and supported by individual RSCAs and funding documents. Therefore, the amount shown in the table in Paragraph 2 is the total value for the base period of all 3 bridge purchase orders. Total value of the possible 12 months each for all 3 purchase orders is Type of Funds: Army DHP

3. Description of Supplies/Services: The estimated value of these 3 bridge purchase orders is

These 3 purchase orders will provide continued support to 1 MTF in the Pacific Region, - Tripler Army Medical Center, with 28.5 full-time equivalent (FTE) contracted health care providers (HCP);

OR Technicians, Anesthesiologists, Certified Registered Nurse Anesthetists and Registered Nurses.

4. Authority Cited: 41 United States Code 1901 as implemented in Federal Acquisition Regulation 13.501(a)(1)(ii), sole source (including brand name) under the authority of the test program for certain commercial items.

5. Reason for Authority Cited: FAR 13.501(a)(1)(ii) is cited because this Class J&A, (1) for administrative convenience, combines the requirements under 3 discrete purchase orders; (2) all of the operative facts and the justification for other than full and open competition are the same for all 3 discrete purchase orders; (3) the estimated value of every individual purchase order does not exceed the $7 million threshold in FAR 13.500; and (4) use of 13.501 authority and procedures in this J&A is not intended to, and does not, subvert 10 USC 2304(c)(1) as implemented by FAR 6.302-1. Awarding these purchase orders on a sole source basis to the current contractors is in the Government's best interest.

The current contractors already have the required personnel available on site; thus ensuring the continuity of critical services. These personnel have already been credentialed and cover a multitude of HCP services needed to support TAMC. The MTF was contacted and affirmed the services listed herein are still required. Also, the contractors affirmed that they are willing and able to continue to provide services under a new bridge contract, for the same prices that were awarded for the current period of performance.

6. Efforts to Obtain Competition: The original ADCMS G1 contracts were awarded on a competitive basis, and the task orders were competed amongst the ADCMS G1 contractors. The ADCMS G2

Approval

Based on the foregoing justification, I hereby approve the procurement of 3 bridge purchase orders;

Anesthesiologist services, OR Technician Services, and Long Term Nursing Services, total value not to exceed in support of Tripler Army Medical Center on an other than full and open competition basis pursuant to the authority of 41 U.S.C. 1901 as implemented by FAR 13.501, subject to availability of funds, and provided that the services and property herein described have otherwise been authorized for acquisition.
