3. Description of Supplies/Services: Adolescent Idiopathic Spinal System specifically indicated for treatment of patients with
Adolescent Idiopathic Scoliosis.
4. Authority Cited:
(a) FAR 13.106-1(b)(1)(i): Only one source reasonably available (e.g., urgency, exclusive licensing agreement, brand name or industrial mobilization); OR
(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR
(c) FAR 8.405-6(a)(1)(i)(A): An urgent and compelling need exists, and following the procedures would result in unacceptable delays; OR
(d) FAR 8.405-6(a)(1)(i)(B): Only one source is capable of providing the supplies or services required at the level of quality required because the supplies or services are unique or highly specialized; OR
(e) FAR 8.405-6(a)(1)(i)(C): In the interest of economy and efficiency, the new work is a logical follow-on to an original
Federal Supply Schedule order not previously issued under sole-source or limited-sources procedures.
5. Reason for Authority Cited: OrthoPediatrics Corp. is the only vendor which can provide the Adolescent Idiopathic Spinal
System. The physician has determined that the features and surgical implementation, unique to this product such as: a set screw design for better fixation and easy insertion; low profile screws designed specifically for pediatric indications, will meet the patient’s critical needs and ensure the best chance for a successful surgical outcome. The patients are scheduled for surgery on 6/15/15, 6/22/15, and 6/29/15. Delay of this medical procedure will be detrimental to the patient’s care.
Market research indicates that the Adolescent Response Spine System is distributed exclusively by OrthoPediatrics and there are no other vendors that supply this item.
6. Actions to Increase Competition: We will continue to conduct on-going research of the industry market place to determine if there are new entrants into this product arena. To date no other vendors have been identified or have marketed themselves to be producers of this product.
7. Market Survey: Market research has shown that this product is commercial in nature. In addition, market research conducted online within 12 months has found that no other vendors have been identified as suppliers of the Adolescent Idiopathic Spinal System.
