52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:

See Addendum 52.212-2

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

(End of provision)

ADDENDUM TO 52.212-2

Award will be made using the lowest price technically acceptable (LPTA) source selection process. Award will be made to the responsible offeror on the basis of the lowest evaluated price of proposals meeting or exceeding the acceptability standards for non-cost factors. Award maybe made without discussions with offerors (except communications conducted for the purpose of minor clarification). Therefore, each initial offer should contain the offeror's best terms from a technical and price standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the contracting officer to be necessary.

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer, conforming to the solicitation is Lowest Price, Technically Acceptable (LPTA). Award will be made on all or nothing basis. The following evaluation factors shall be used to evaluate offers: Technically Acceptability and Price.

EVALUATION PROCESS:

The following evaluation factors shall be used to evaluate offers:

1. Technical Acceptability: Offer will be found technically acceptable if the offer meets the performance requirements and all of the subfactors listed below.

Technical Proposal: The offerors technical proposal satisfactorily explains the firm’s capability, to include any processes currently in place that will ensure the specifications identified in Statement of Work (SOW) are met. The offerors technical proposal includes a narrative which satisfactorily explains the whole body cadavers to be provided (Subfactor 1). The offerors technical proposal includes a narrative which satisfactorily explains the features of the laboratory and classroom facilities (Subfactor 2). The offerors technical proposal includes a narrative which satisfactorily explains the Site Visit to be conducted after contract award and prior to the first training class for familiarizing the government representatives who will be conducting training (Subfactor 3). NOTE - Offeror statements that they understand, can or will comply with all specifications, or statements paraphrasing the specification of parts thereof, or phrases such as “standard procedures will be used” or “well-known techniques will be considered technically unacceptable.

Subfactor 1: Cadavers. The twelve (12) each whole body cadavers are fresh frozen not preserved in formaldehyde.

Cadavers preserved in formaldehyde and which have previously undergone significant surgery or physical alteration are not acceptable. A different twelve cadavers are provided for each March and July training classes; the same twelve cadavers can be used for each two day training class.

Subfactor 2: Laboratory and Classroom facilities. The laboratory facility shall be large enough to allow for up to 50 resident physicians to conduct medical proficiency training. This space must be suitable and ergonomic for the intended training. Contractor performs cadaver laboratory set up and recovery. Resident physicians attending this training will not perform these duties. Contractor provides all required consumables (gloves, masks, etc.) which will be needed by up the resident physicians in training. Contractor provides all required basic laboratory medical instruments and equipment (i.e., scalpels, forceps, clamps, etc.) which will be needed by the resident physicians in training. Contractor provides adjacent classroom space with audio and visual aids with the ability to hold approximately 20 of the 50 resident physicians at a time. The classroom is within a maximum of 2-3 minutes or 200 feet walking distance from the laboratory. Contractor provides ancillary audio visual equipment in the classroom (i.e.

overhead projectors, computers, AV jacks, etc.). This equipment will facilitate the teaching of resident physicians by government instructors who will need to access personal laptops or other devices to better aide in instruction of the resident physicians through instructional multimedia materials. Location to be within 250 miles of Fort Hood, Texas 76544. Location must be within 10 minutes walking distance to food suitable for breakfast or lunch during a break in training each day. Facilities must be climate controlled to preserve the integrity of the fresh frozen cadavers. There must be suitable parking free of charge provided at the site.

Subfactor 3: Site Visit. Contractor performs all necessary arrangements for one initial site visit for 2 – 3 government medical personnel in charge of overseeing this training. This site visit is prior to the first scheduled training class for the purpose of familiarizing these individuals with the laboratory, classroom surroundings, to include showing them how to operate audio classroom audio and visual equipment. Phone arrangements for ensuring the representative of the proposed facility is present is sufficient; the contractor does not have to be physically in attendance at this site visit. This visit is scheduled within 60 days of the first training class.

The subfactors of the technical proposal shall be addressed in sufficient written detail for the government to determine if the offeror possesses sufficient technical capability to adequately perform these services. This factor will be rated as either “acceptable” or “unacceptable. This solicitation is Lowest Price, Technically Acceptable

(LPTA).

Technical Acceptability: Each of the above subfactors must be found technically acceptable in order to be eligible for award.

Acceptable: Documentation provided clearly meets the minimum requirements of the solicitation.

Unacceptable: Documentation provided does not meet the minimum requirements of the solicitation

An “unacceptable” rating on any of these subfactors will make the overall technical rating “unacceptable” which makes the proposal to be ineligible for award.

2. Price: Price will be evaluated using various price analysis techniques and procedures IAW FAR 15.4041(b) including, but not limited to, comparison of proposed price received in response to the solicitation with a comparison to the Independent Government Estimate (IGE). Evaluation of price will include a determination that the price is fair and reasonable.

(b) Options. The Government will evaluate proposals for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that a proposal is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) Given that FAR 52.217-8 provides that the Government may exercise the Option to Extend Services at the rates specified in the contract (i.e., the rates in effect when the Extension of Services option is exercised), for purposes of evaluating the Option to Extend Services, the Contracting Officer will consider the prices submitted for the base year and each option year, since those are the binding prices should the Option to Extend be exercised.

(d) Quotes must be submitted NLT the offer due date/local time CST by e-mailing to:

Shenecqua.n.soares.civ@mail.mil, or faxing to (254) 553-3906 Attn: Shenecqua Soares. No telephonic questions or quotes will be accepted. A signed SF form 1449 with completed pricing data must be submitted. E-mail is the preferred method.

(e) Evaluation Process: All offers will be evaluated IAW FAR 15.305 first: Award will be made using the lowest price, technically-acceptable source selection process. The Government will initially list proposals from lowest to highest price. If a proposal is rated Technically Unacceptable, the Government will not evaluate any other factor.

USING THIS PROCEDURE, THE GOVERNMENT MIGHT NOT EVALUATE ALL PROPOSALS. Proposals receiving a rating of “less than adequate” or “not acceptable” will not be eligible for award.

(f).
