(b) FAR 13.106-1(b)(1)(ii): Only one source can provide a portion of the purchase that is a particular brand-name item; OR

5. Reason for Authority Cited: Currently the Department of Logistics, Medical Maintenance Section at CRDAMC does not have the organic capabilities or current personnel that can maintain and support the government owned ACP®215 units. The government has a continuing need to provide maintenance and service for the Haemonetics® ACP®215 Automated Cell Processor Units located at the Robertson Blood Center. Haemonetics® is the sole manufacturer of this equipment and presently provides the care, maintenance, service and proprietary software that relates to their equipment. Haemonetics® currently does not have any authorized third party maintenance service providers for their products. Haemonetics® maintains all proprietary and technical data rights to their equipment and does not sell any of its parts, original equipment or services to any third party vendor.
6. Actions to Increase Competition: For future actions, the Government will reassess the market for available items, including but not limited to, issuing a Sources Sought Notice to determine market availability for brand name, or equal requirements. When the current equipment reaches the end of its life cycle, becomes obsolete or when equivalent equipment becomes available every effort shall be made to increase competition and therefore an evaluation shall also be made concerning pertinent supplies. CRDAMC in conjunction with MEDCOM will continue to evaluate the capabilities of other vendor's products in order to provide items that are the best value to the Government. The Government will continue to seek new resources that will satisfy these requirements through continued market research, requests for Statements of Capability, and telephonic inquiries.
7. Market Survey: A sources sought was posted on FedBizOps from 7 August 2018 through 15 August 2018 with interest shown by the original equipment manufacturer only. Initial market research revealed that the suggested vendor, a large business, was the only company that could provide the maintenance and services that are being requested for the particular government owned equipment.
Therefore, due to the proprietary nature of the maintenance services being requested no other business can currently provide the requested product. Corporation is the sole authorized provider of the products that are needed for this procurement.
