Control # 16-RHCO-C158

For Official Use Only

(See FAR 2.101 and 3.104-4)

Justification and Approval

For Other than Full and Open Competition

1. Contracting Activity: Regional Health Contracting Office – Central, Carl R. Darnall Army Medical Center (CRDAMC), Fort Hood, TX 76544

2. Description of Action: Issue a bridge contract for Non-Personal Tele-Radiology Services. This action will be accomplished through the use of a firm fixed-priced contract funded with DHP Funds.

3. Description of Supplies/Services: Carl R. Darnall Army Medical Center (CRDAMC) has a requirement to continue services for Tele-Radiology Services (i.e. off-site radiological interpretations). This service is provided 24 hours a day, 7 days a week via tele-radiology and transcribes all reports into the Composite Health Care System (CHCS) at Carl R. Darnall Army Medical Center (CRDAMC). Period of Performance 1 April 2016 – 30 September 2017. This requirement is a six-month base period to include on twelve month option period with a total estimated acquisition cost of $726,282.00.

4. Authority Cited: 10 USC 2304(c)(1) as implemented by FAR 6.302-1(a)(2)(iii)(B) -- Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.

5. Reason for Authority Cited: Contract W81K00-11-C-0003 is currently in place for Tele-Radiology Services, which will expire on 31 March 2016; the contract included FAR Clause 52.217-8 – Option to Extend Services, which has already been exercised for the maximum 6-month extension. The purpose of this contract action is for the continuation of services until the MEDCOM competitive contract is awarded by the Health Readiness Contracting Office. In late January 2016, we were informed that the MEDCOM Tele-Radiology contract will not be completed before the current contract expiration date, therefore a “bridge” is needed to ensure continued services. The time of notification that the MEDCOM Tele-Radiology contract was not going to be complete before the expiration date of the current contract does not allow the government time to adequately plan for the acquisition, nor sufficient time to properly execute a competitive procurement, and does not allow for a proper timeframe for transition to a potential new offeror. There are certain barriers that would make it impossible for another source to perform the Government’s requirement. First, the requirement calls for multiple Information Technology (IT) and security requirements otherwise known as Department of Defense Information Assurance Certification and Accreditation Process (DICAP) that must be met to access reports in the Composite Health Care System (CHCS) at Carl R.

Darnall Army Medical Center (CRDAMC). Second, the Business to Business (B2B) Agreement must be completed; the Virtual Private Network (VPN) must be established and approved. Given the nature of the services and the amount of coordination required to prevent a disconnect in service, a transition of this service from one contract

Tele-Radiology Services

Page 2 of 5 (25 February 2016) company to another is anticipated to take approximately six (6) to eight (8) months. A lapse in service would have an immediate negative impact, and potential mission failure in providing current health care operations and current health care services to our soldiers, civilians, and beneficiaries who rely on these services. CRDAMC does not have a sufficient workforce to absorb the negative impact that a lapse in services would effect. The incumbent contractor, US Radiology On-Call, is able to provide uninterrupted services immediately following this award, which results in no disruption, delay, or harm to the Government, soldiers, civilians, and beneficiaries.

6. Efforts to Obtain Competition: The follow on contract will be competed

a) Effective Competition: To ensure offers are solicited from as many potential sources as is practicable the proposed action will be posted to FEDBIZOPS. No other efforts are being made to obtain competition as only one responsible source, U.S. Radiology On-Call, is capable of meeting the minimum requirement prior to the expiration of the current contract.

b. Subcontracting Competition: In accordance with FAR Subpart 19.705-2, the contracting officer has taken actions to determine whether the proposed contractual obligation requires a sub-contracting plan. According to SAM the incumbent contractor is a small business and a sub-contracting plan does not apply.

7. Actions to Increase Competition: It is not possible to compete the proposed acquisition in time for service to commence on 01 April 2016.

8. Market Research: Market Research was conducted on 27 January 2016. Web and telephonic inquiries reveal that there are capable service providers in the market who currently provide these services, however, in this instance, award to any other vendor, rather than the incumbent, would be detrimental to healthcare services at CRDAMC, the DoD, and all beneficiaries, resulting in unacceptable delays and service disruption.

9. Interested Sources: A Sources Sought Notice was place on FedBiZOpps from 4 March 2016 to 9 March 2016 for a total of five (5) days. Four vendors responded to the notice. Professional Medical Imaging Services, Onrad, Inc., A-Team Solutions, and Healtheon. All vendors’ capabilities were reviewed and fully considered. Also, each vendor was contacted via email to see if they were able to meet the IT and Security requirements known as DICAP. Therefore, due to the mandatory DICAP requirement there is not sufficient time for the contractors to perform with a 1 April 2016 start date.

10. Other Facts:
