SUBJECT: DataPath Maxview Annual Enterprise Software Maintenance Renewal

The U.S. Army Contracting Command-APG (ACC-APG) is requesting a Firm-Fixed-Price Quotation for Commercial- Off-the-Shelf (COTS) DataPath Maxview Annual Enterprise Software Maintenance Renewal. The services described below are for a one (1) base year starting on or about June 2019. One item is co-termed with a different start date. The NAICS Code applicable to this acquisition is 511210 – Software Publishers. The Size Standard is $38.5 million. This acquisition will be funded with FY2019 Operations and Maintenance Army (OMA) Funds based on availability of funds. The Solicitation number is W56JSR19Q0057. All quotations are due within 03 calendar days of this notification, no later than close of business at 16:00 (EDST) on 24 May 2019.

Product Descriptions – The DataPath Maxview software products description for the purchase of the required software maintenance are as follows: They are sole source to DataPath in accordance with FAR 8.504.

We are looking for interested parties who can provide the same COTS products listed above or alternate commercial products. You must be able to sell the DataPath Maxview Annual SMP Software support and renewal to the Army. Alternate commercial products will be considered once vendor submits pricing and availability and sufficient technical information for the program office to perform an evaluation to determine that the alternate product is technical feasible and priced less than the current COTS products listed above.

Respondent Due Date – Price quotes are due within 03 calendar days of this notification, no later than close of business at 4:00 PM (EDST) on 24 May 2019. If you are unable to furnish a quote, respond with “no bid” and provide a detailed explanation as to why you are unable to.

Respondent Instructions – Reponses should clearly indicate the following:

· All quotes should indicate the part numbers specified under the above Product Description, with itemized pricing for each part number specified. Any deviations from the Part Numbers specified shall be explained in the Offerors response.

· Contractor CAGE Code, DUNS Number and business type / size.

· Published Commercial Price, if applicable.

· Any and all applicable discounts applied to the pricing.

· Quotes should separately identify any applicable costs associated with meeting the delivery instructions.

· PROVIDE A COPY OF END USER LICENSE AGREEMENT(s) OR SOFTWARE MAINTENANCE AGREEMENTS ASSOCIATED WITH THE ITEMS LISTED ABOVE. If no agreement exists clearly state that in the provided quote.

This document is not a purchase order or contract or a promise to issue an award.

The government shall not pay for any submitted information or the cost to submit these items.

The government reserves the right to issue an award in part or in whole for the items described above. The government is not obligated to make an award for all or any portion of the items described.

The contract will be awarded to the lowest responsive responsible bidder. The evaluation will be based upon the base year and any quoted options requested.

The DataPath Maxview Subscription Software and Renewal shall be activated / delivered with inspection and acceptance at destination within 30 days of award to:

52.217-9 Option to Extend the Term of the Contract. (MAR 2000)

(a) The Government may extend the term of this contract by written notice to the Contractor within 30; provided that the Government gives the Contractor a preliminary written notice of its intent to extend at least 30 days before the contract expires. The preliminary notice does not commit the Government to an extension.

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 12 moonths.

52.233-2 SERVICE OF PROTEST (SEP 2006)

(a) Protests, as defined in section 33.101 of the Federal Acquisition Regulation, that are filed directly with an agency, and copies of any protests that are filed with the Government Accountability Office (GAO), shall be served on the Contracting Officer (addressed as follows) by obtaining written and dated acknowledgment of receipt from Larry Carter at 6565 Surveillance Loop, Building 6001 Aberdeen Proving Ground, MD 21005.

(b) The copy of any protest shall be received in the office designated above within one day of filing a protest with the GAO.
