Control Number: JA-19-E-173 Program(s)/Equipment: Ideal STRIKE research consisted of a review of the U.S. Army Computer Hardware Enterprise Software Solutions (CHESS) website, National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), General Services Administration (GSA) websites and the manufacturer website for a list of authorized resellers. The Procurement and License Tracking System (PLTS) was reviewed for any historical data. CHESS website was reviewed for listing of any Enterprise agreements on 10 November 2018 and RFI #00001 was posted for a response. NASA SEWP, and GSA Advantage websites were reviewed for listing for the software. Other than the Software Publisher, no responses were received from the sources sought.
KeyW does not have authorized distributors of Strike and Strike Products. This requirement is not available from U.S. Army’s CHESS, therefore a Statements of Non-Availability (SONA) # 216739023, 216730024 and 216739025 were obtained on 25 September 2018. The ITAS Waiver, #20181113329645, was provided on 19 November 2018.
9. Interested Sources: A combined/synopsis solicitation will be posted under FedBizOps as required by FAR 5.201. To date, no other sources have written to express interest in the acquisition beyond the vendor(s) list in paragraph 8. Efforts will be made to solicit any company that shows a level of effort to reach the capabilities of the STRIKE software.
10. Other Facts:
a. Procurement History: PD CHARCS ordered the renewal of 400 each STRIKE Kit Annual Service and Support subscription on 09/28/2015 through Contract W56JSR-15-C-0030 to maintain a one-year software subscription renewal to support hardware devices.
b. Acquisition Data Availability: The Government possesses only a commercial purchase description for the software. Technical data for the subscription is proprietary to KEYW Corporation. The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product.

13. Fair and Reasonable Price Determination: I hereby determine that the anticipated price to the Government for this contract action will be fair and reasonable, based on the availability of commercial pricing information and price analysis.
As a part of this basis, certified cost or pricing data is not required because the item and/or services being acquired are considered commercial.
14. Procuring Contracting Officer Certification: I certify that this justification is accurate and complete to the best of my knowledge and belief
APPROVAL
Based on the foregoing justification, I hereby approve the award of a new Firm-Fixed- Priced purchase order for the procurement of STRIKE Kit Annual SSUM subscription in support of CHARCS for a sole-source acquisition, pursuant to the authority 41 U.S.C.
1901 and FAR 13.501(a)(1)(ii), subject to the availability of funds in the amount of and provided that the services and property herein described have otherwise been authorized for acquisition. FY 2019 OMA funds will be used and the anticipated award date is 29 March 2019.
