FAR 8.405-6 Limited Sources Justification Under the General Services Administration

Federal Supply Schedule Program

1. Contracting Activity: U.S. Army Contracting Command – Aberdeen Proving Ground 6001 Combat Drive, Building 6001 Aberdeen Proving Ground, Maryland 21005

2. Description of Action: The Software Engineering Center (SEC) in support of the Project Manager, Warfighter Information Network-Tactical (PM WIN-T) Program requests a Firm-Fixed-Price (FFP) delivery order be issued against Blanket Purchase Agreement (BPA) N00104-13-A-ZF42 for the procurement of Solarwinds Software license and support renewals. This BPA was entered into in order to streamline the purchase of products and services from Federal Supply Schedule (FSS) contract GS- 35F-4543G.

BPA N00104-13-A-ZF42 – which was created under the Department of Defense Enterprise Software Initiative (DoD ESI) – list DLT Solutions as the only authorized BPA reseller for Solarwinds. DLT Solutions is headquartered at 2411 Dulles Corner Park, Suite 800, Herndon, VA 20171-6168. The contract will be for a period of one (1) year.

The applicable North American Industry Classification Systems (NAICS) code for this requirement is 541519, Other Computer Related Services. The projected award is June 2016 and fiscal year 2016 Operations and Maintenance, Army (OMA) funds will be used.

An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation Supplement 207.103(d)(i)(B).

3. Description of Supplies/Services: PM WIN-T has a requirement to purchase new Solarwinds software licenses and initial maintenance, as well as software maintenance renewals for existing licenses. This action will support the already fielded software baselines to Army units fielded with WIN-T systems. WIN-T provides the communications networks and services that allow the Warfighter to execute the Army Mission. Information is the key element of Combat power that allows Commanders to maximize the effects of maneuver, firepower, and protection.

WIN-T is the transformational Command and Controls system that manages tactical information transport at theater through Company Echelons in support of full spectrum operations. WIN-T continually investigates existing technologies to determine its usage and ability to improve the systems and services fielded to the Warfighter; thereby allowing for better execution of the Army Mission.

WIN-T requires Solarwinds (NCM DL500, NCM DLX, NPM SL250, NTA for NPM SL250, VNQM SLA5, VNQM SLA25, and Engineer’s Edition Toolset) licenses to be used for loading and saving of baseline network device configurations, providing summarized performance data reports and traffic analysis, monitoring VoIP Call Detail Records (CDRs), voice network troubleshooting, and WAN monitoring, and fault and performance monitoring for all Simple Network Management Protocol (SNMP) enabled devices. Solarwinds NCM is utilized to provide the capability to load, save and baseline

Area Network (LAN).

Solarwinds NPM SL250 with NTA for NPM SL250 is utilized to provide summarized performance data reports with traffic analysis down to the application/port and end user level. Solarwinds VNQM is utilized to monitor VoIP Call Detail Records (CDRs) and perform analysis on metrics such as jitter, latency, and packet loss to assist in troubleshooting the voice network, as well as monitor WAN. Solarwinds Engineer’s Edition Toolset is utilized to provide fault and performance monitoring for all SNMP enabled devices, monitor the status of WAN links, and monitor neighboring devices connected via these WAN links up to one hop out.

4. Authority Cited: (41U.S.C. 251( c)(1) FAR 8.405-6(b)(1) and substantiated by the following:

XX FAR 8.405-6(b)(1). Items peculiar to one manufacturer. An item peculiar to one manufacturer can be a particular brand name, product, or a feature of a product, peculiar to one manufacturer. A brand name item, whether available on one or more schedule contracts, is an item peculiar to one manufacturer.

5. Reason for the Authority Cited: Solarwinds, headquartered at 7171 Southwest Parkway, Building 400, Austin, Texas 78735, is the manufacturer of all Solarwinds software products listed for renewals under this procurement. Solarwinds is the exclusive developer and manufacturer of the Solarwinds perpetual products/licenses.

The use of a brand name description in this acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.

Although Solarwinds has numerous resellers that are able to provide Solarwinds perpetual software maintenance, it currently has an official software agreement via the DoD ESI, leaving market research for pricing to be sought directly to the BPA holder of this agreement. In accordance with the Defense FAR Supplement (DFARS) 208.7402, agencies shall fulfill requirements for commercial software and related services, such as software maintenance, in accordance with the DoD ESI BPA. Therefore, the request for quote (RFQ) will only be solicited to, and responses considered from DoD ESI BPA contract holder(s) that provide Solarwinds software products. DLT Solutions, LLC, (Large Business) is currently the only authorized DoD ESI BPA reseller for Solarwinds at this time.

Replacement of Solarwinds products in the WIN-T software baselines would result in extensive development efforts to re-engineer the PM WIN-T software components, followed by production and certification testing efforts.

Failure to renew this software maintenance could result in the inability to obtain patches to mitigate vulnerabilities that are found in Solarwinds products, which could lead to the loss of PM WIN-T Authorizations to Operate Without this maintenance.

In addition, the availability of valuable network management information to the unit S6 will be severely reduced, which could result in serious injury or loss of life to Warfighters.

6. Actions to Increase Competition: Commercial software manufacturers are encouraged to increase the number of authorized resellers. Additionally, upon receipt of the requirement an authorized list of authorized distributors for this software is immediately requested from the original manufacturer. The manufacturer is also encouraged to pursue distribution of their products/services through Small businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses.

However, these products are available on a DOD ESI BPA and will be procured via the ESI BPA unless a waiver is obtained from the DOD ESI SPM.

7. Market Research: Market research was performed by the SEC-CALM Team from May 2016 to June 2016. Searches were performed on the U.S. Army Computer Hardware Enterprise Software & Solutions (CHESS) and the Enterprise Software Initiative (ESI) site. Since a DOD ESI BPA exists for Solarwinds products, CALM did not survey the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), and General Services Administration (GSA) websites. CALM procurement history indicates that Solarwinds software was available through 8(a) vendors. Currently the US Army is restricted to using the mandatory CHESS contract as an ITAS waiver has been denied. As a result of Market Research conducted by SEC CALM, a CHESS Blanket Purchase Agreement (BPA) was identified and pricing information on that BPA revealed that the cost of the software purchased using the BPA would result in an estimated $44,000 saving over the existing delivery order option pricing on IDIQ contract, W56JSR-14-D-0003.

11. Best Value Determination/Fair and Reasonable Cost Determination: I hereby determine that the order represents the best value to the Government in accordance with FAR 8.405-6(b)(1). Additionally, I hereby determine that the anticipated cost or price to the Government for this contract action will be fair and reasonable.

At the time the BPA was award, the price of supplies and fixed-price services, and rates for services offered at hourly rates, were determined to be fair and reasonable for purposes of establishing the schedule contract. However, the contracting officer will use procurement history, the IGCE and a price analysis to determine if the price quoted for this procurement is fair and reasonable.

Based on the foregoing justification, I hereby approve the procurement of the Solarwinds software products and maintenance renewals using an exception to fair opportunity pursuant to the authority of 8.405-6(b)(1). Restricting consideration to an item peculiar to one manufacturer subject to availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition.

If this action is not complete within one hundred eighty (180) days the Limited Source Justification shall be returned to the Competition Advocate for Competition for revalidation. Additionally, if any changes to the requirements, basis for justification, market conditions or increases in the est imated value of the proposed action occur at any time, the Contracting Officer shall document these changes in a memorandum and obtain review/concurrence from the Competition Advocate.
