2. Description of Action: The Communication Electronics Command (CECOM) Software

Engineering Center (SEC) requests a Firm-Fixed-Price (FFP) contract for Commercial Off-The-

Shelf (COTS) “Orbix 6 Enterprise Edition” software owned and produced by MicroFocus Inc.

This contract will be a base year of 12 months in length for FY16. The Government will purchase a quantity of 12 new software licenses of “Orbix 6 Enterprise Edition”, as well as a quantity of 24 one (1) year support and maintenance for the software. This requirement supports the DSCS

DIMS.

An Army Computer Hardware Enterprise Software Solutions (CHESS) Statements of Non-

Availability (SoNA) [Request No: 216712340] has been provided for this requirement, exempting it from the AFARS 5139 requirement for Army CHESS as the mandatory source for IT hardware and software purchases. Information Technology Approval System (ITAS) waiver number

[20160808251862] has been approved for this requirement. The total estimated cost of this contract is . The government anticipates a September 2016 award using FY2016

Operation and Maintenance Army (OMA) funds, which are currently available. The NAIC code for this acquisition is 511210 Application Software, Computer, and Packaged.

3. Description of Supplies/Services: Orbix 6 Enterprise Edition is a COTS database notification and messaging software product embedded in the Defense Satellite Communications System

(DSCS) Operational Support System (DOSS)/DSCS Automatic Spectrum Analyzer (DASA DSCS

Integrated Management System (DIMS) that communicates with the databases of the Army’s

Wideband Satellite Communications (SATCOM) Operational Management System (WSOMS) planning, command & control, and monitoring systems that manage Army SATCOM.

The Period of performance for the 12 new License and Maintenance Services and

Maintenance only for 24 additional licenses is:

The DIMS, a subsystem of the DOSS/DASA, is the central information management system providing an integration path for systems that make up the Army’s WSOMS. The DIMS manages information among various systems providing data movement, computation, and storage necessary for the DSCS and Wideband Global SATCOM (WGS) satellite constellations.

The original Design and Development phase for DIMS was conducted from 1998-2003 and transitioned to Post Production Software Support in October 2009 by John Hopkins University’s

Applied Physics Laboratory. They evaluated various Common Object Request Broker

Architecture COBRA software options to the Government. ). CORBA is a standard object-oriented programming model that enables communication between software written in different object-oriented programming languages like C or C++. Following evaluation of the available options, Orbix 6 Enterprise Edition software was determined to best meet the Government’s needs.

Communications System (DSCS) Operational Support System (DOSS)/DSCS Automatic

Spectrum Analyzer (DASA) Defense Satellite Communications System (DSCS) Defense

Integrated Management System (DIMS), Global Satellite Communications (SATCOM)

Configuration Control Element (GSCCE), Wideband Remote Monitoring Sensor (WRMS) are specifically configured to use Orbix 6 Enterprise Edition Runtime to communicate with each other.

The software baseline/configuration for these systems is controlled by the Program Manager (PM), and cannot be changed unless the PM initiates a software re-baselining/re-engineering or develops a new Global Satellite Communications (SATCOM) system. Currently, no changes to the software configuration are planned; although a research study is scheduled for FY2017 to assess in-depth the costs and benefits of a re-baseling/re-engineering effort or new SATCOM system. Unless the

PM initiates a software configuration change which would move DIMS back into a Design and

Development phase, the existing SATCOM systems will remain in Sustainment phase. In

Sustainment phase, responsibility for maintaining the operational status of DIMS belongs to the

SEC. The SEC, does not have any authority to change the software configuration of DIMS, and may only maintain the current DIMS configuration.

MicroFocus Inc. purchased ownership rights of Orbix 6 Enterprise Edition software from Progress

Software Corporation in the period of December 2012 to February 2013. Prior to the exchange of proprietary rights, the Orbix software was developed by Iona Technology and licensed per computer server (One Orbix Enterprise software license per computer server). Following acquisition of ownership rights to Orbix Enterprise, MicroFous Inc. changed the licensing terms for Orbix Enterprise to a per core basis (One Orbix Enterprise software license per core). When the

Army upgraded the SATCOM systems hardware from dual-processor-single-core (two processors/single core per server) to dual processor/hex-core (two processors with six cores per processor) computer servers, there was a requirement to update the Orbix Enterprise software licenses operating on the servers. Under the terms of the updated software licenses (per processor/core, instead of per server), additional software licenses are needed.

5. Reason for Authority Cited: MicroFous Inc., of 700 King Farm Boulevard, Suite 400, Rockville, Maryland 20850-3334 is the owner and developer of the Orbix 6 Enterprise Edition

Runtime software. The use of a brand name description in this acquisition is essential to DIMS requirements, thereby precluding consideration of a product manufactured by another company.

Orbix 6 Enterprise Edition Runtime is the database notification and messaging software product architected into the WSOMS software baseline. Along with the DIMS, the WSOMS planning, command & control, and monitoring systems are specifically built to interact with Orbix 6

Enterprise Edition Runtime. A complete

6. Efforts to Obtain Competition: The Government conducted market research, details of which are in the market research section of this document (paragraph 8). The market research internal to the Government assessed what supplies/services are available to meet the requirement and determined that only a single brand-name product (Orbix 6 Enterprise Edition Runtime) could meet the requirement in a cost and time efficient manner (See Section 5). Market research external to the Government sought to determine the quantity and status of sources capable of providing the

Orbix 6 Enterprise Edition Runtime, and using the obtained information assessed the best means of fulfilling the requirement while meeting Government goals for increasing competition and utilizing small businesses. Information gained through market research supported that two or more Small

Businesses would be available as capable and interested resellers for the Orbix 6 Enterprise

Edition Runtime products. On this basis, the requirement was set aside for competition among

Small Businesses.

With regards to subcontracting, FAR 19.702(b) notes several exceptions under which a subcontracting plan is not required. A primary exception is when the contractor is a small business.

As a Small Business set-aside, this requirement will be awarded to a small business and therefore not required to have a subcontracting plan.

7. Actions to Increase Competition: The Government only possesses the commercially available technical data customarily provided with this COTS product. Technical data for the previously acquired licenses is proprietary to MicroFous Inc. The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product. Market research conducted at the PM level will focus on assessing all potential sources and solutions for meeting the Government’s requirement. This scope of research permits consideration of alternate software solutions which would entail re-baselining the DIMS software configuration. Since the SEC does not have the authority to re-baseline the DIMS configuration

(which specifically calls for Orbix 6 Enterprise Edition Runtime), SEC’s market research (as detailed in J&A section 8 below) focused on assessing potential sources for purchasing Orbix 6

Enterprise Edition Runtime software licenses and maintenance/support.

Commercial software manufacturers, such as MicroFous Inc. for the current requirement, are encouraged to increase the number of authorized resellers. Additionally, upon initial receipt of the requirement, an authorized list of authorized distributors for this software is immediately requested from the original manufacturer. The manufacturer is also encouraged to pursue distribution of their products/services through Small businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses. Market research will be conducted annually on the current baseline to determine if changes occur in the market place that would enable greater competition.

Competition and Market Research will be accomplished when the system utilizing this software is re-baselined.

8. Market Research: Market research for market pricing and sources was performed by the

Government during the August 2016. Searches were performed on the Army CHESS, and National

Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement

(SEWP), and General Services Administration (GSA) websites. In response to the CHESS inquiry, CHESS SoNA [Request No: 216712340] is provided. ITAS number [20160808251862] has been approved for this requirement. A query was sent to the owner/manufacturer of ‘Orbix 6 Enterprise

Edition’ for a list of resellers*. Below is a list of vendors* provided by MicroFous Inc.
