Source Justification and Approval
1. Contracting Activity: Army Contracting Center – Aberdeen Proving Ground

2. Description of Action: This proposed action is for a new Firm-Fixed-Price (FFP) purchase order for the procurement of brand name Commercial-Off-the-Shelf (COTS) Oracle Solaris
Premier Subscription for Non-Oracle Hardware (1-4 socket server) 1-year term software license renewal, in support of the Distributed Common Ground Systems - Army (DCGS-A) program.
The Government projects an award in September 2016 and Fiscal Year 2016 Operations and
Maintenance Army (OMA) funds will be used and are available. The applicable North
American Industry Classification System (NAICS) code for this requirement is 541519 (Other
Computer Services – resellers). The order will be for a 12-month base period subject to the availability of funds. The estimated price for the base performance period is per an Independent Government Cost Estimate (IGCE). An acquisition plan is not required because this procurement does not meet the threshold at Defense Federal Acquisition Regulation
Supplement 207.103(d)(i)(B).
3. Description of Supplies/Services: The procurement of Commercial Off-the-Shelf (COTS)

Oracle Solaris is the UNIX operating system on the supported Single Source (SS) and (Cross
Domain Solution Suite) CDSS systems. Systems cannot function without an operating system
(e.g. the average home user could not run their pc without some form of Windows, or a
Macintosh without a Mac OS). Solaris was originally a product of Sun Microsystems. Oracle acquired Sun Microsystems and began considering Sun hardware to be Oracle hardware, and non-Sun hardware became non-Oracle hardware. Oracle requires annual licensing (right-to-use or term licenses) for end users to be able to run Solaris on non-Oracle hardware. (In contrast, if one has “Oracle hardware”, one instead buys Oracle Premier Support for Operating Systems or
Oracle Premier Support for Systems, depending on the level of support desired.). Oracle Premier
Support for Operating Systems provides solely operating system support, while Oracle Premier
Support for Systems includes a customer data retention component.
The DCGS-A Enabled (DE) Single Source (SS) is linked to the Global Signals Intelligence
(SIGINT) Enterprise. In addition, maintenance provides us with patches, support, and cost-effective upgrades.
The DCGS-A Enabled (DE) Analysis Control Element (ACE) Fusion Subsystem is the Army’s all source fusion system today. It provides fusion, correlation and analysis of intelligence data.
The DE-ACE Fusion Subsystem is also responsible for updating the ground order of battle, ensuring a common enemy picture for all Army Mission Command Users. The DE-ACE Fusion
Subsystem produces a multi-echelon, multi-dimensional, fused, all source and enemy situation picture for the commander as well as for dissemination to the DCGS-A Enterprise.
The DCGS-A Cross Domain Solution Suite (CDSS) is a lightweight, modular, state-of-the-art multifunction cross domain communications system consisting of GOTS and COTS software which provides supported commanders and intelligence originators with the ability to transmit and receive intelligence data across multiple security domains.

5. Reason for Authority Cited: Oracle, located at 500 Oracle Parkway, Redwood Shores, California 94065, is the proposed brand name product source for procuring Oracle Solaris
Premier Subscription for Non-Oracle Hardware. The Government possesses only a commercial purchase description for the software. Technical data for the licenses is proprietary to Oracle.
The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product or to provide support service. This requirement will be competed among authorized resellers of Oracle products.
a) Solaris is part of the DE-SS, DE-ACE, and CDSS fielded baselines running on older non-
Oracle hardware.
In addition, maintenance provides us with patches, support, and cost-effective upgrades.
Systems running the Solaris operating system were originally selected by PM DCGS-A as meeting Warfighter requirements for the DCGS-A family of systems. Generally speaking replacing a major component of a fielded baseline is out of scope of Software Engineering
Center (SEC)’s sustainment mission; only the PM continues to work new, not-yet-transitioned baselines.
b) Alternatives: While another product such as could theoretically replace
Solaris, To replace the operating system to something with a lower license cost would be, at a minimum, 2-year engineering effort and then would require another . Given the expected life of the DE-AA and DE-SS systems, the costs to move to a new operating system outweighs the cost of licensing the current operating system.

The functionality requirements were determined by the systems’ stakeholders (e.g., Program
Manager DSCG-A) based on their mission requirements. Those defined requirements were the standards used to verify which product(s) can best meet them. This resulted in the selection of
Oracle Premium Solaris software licenses and support maintenance. In addition, as referenced in the previous paragraph, the cost and time to re-engineer and field new baselines to replace the
Oracle Premium Solaris software licenses and support maintenance with other potential products would be cost prohibited and impact meeting the mission requirements in a timely matter.
6. Efforts to Obtain Competition: In an effort to obtain competition, the Software Engineering
Center (SEC) Centralized Acquisition and License Management (CALM) Team conducted market research for this procurement in December 2015 through August 2016. The details of which are in the market research section of this document, paragraph 8. In accordance with FAR
5.202(a)(10) this action will not be synopsized.
a. Effective Competition: Each time the requirement is submitted for acquisition, the SEC
CALM team surveys the market place to determine if any changes have taken place that would affect competition.
b. Subcontracting Competition: There are no subcontracting opportunities for this requirement. Oracle purchased the original software developer Sun Microsystems and is now the owner of this proprietary software. All work on the software application is performed in house and sold through authorized distributors.
7. Actions to Increase Competition: Commercial software manufacturers are encouraged to increase the number of authorized resellers. Additionally, upon receipt of the requirement an authorized list of authorized distributors for this software is immediately requested from the original manufacturer. The manufacturer is also encouraged to pursue distribution of their products/services through Small businesses, HUBZONE, Service Disabled Veteran Owned, and
Woman Owned Small businesses. At this time there are no plans to replace major components of the program but in the future competitive strategies will be considered if a replacement in the
Governments best interest.
8. Market Research: Market research was performed by the SEC CALM Team in the month of December 2015 through August 2016. This research consisted of a review of the U.S. Army
Computer Hardware Enterprise Software and Solutions (CHESS), Enterprise Software Initiative
(ESI) website, National Aeronautic and Space Administration Solutions for Enterprise Wide
Procurement (NASA SEWP), and General Services Administration (GSA) Advantage websites and the manufacturer website for a list of resellers as well as a general web search.
This requirement is not an Army’s Commuter Hardware, Enterprise Software Solutions
(CHESS); non-availability statement #216702790 was obtained on 17 November 2015. The
Goal 1 Waiver #20151125038094 was approved on 21 April 2016. The manufacturer submitted a list of authorized resellers - Dynamic Systems was identified as the only reseller who has an agreement to sell Oracle Solaris Premier Subscription for Non-Oracle Hardware; otherwise the purchase should be bought as a direct buy from the Oracle.

The Acquisition Specialist and Contracting Officer reviewed the Army ESI IDIQ contract and contacted the CHESS helpline to verify the Dynamic Systems could sell Oracle licenses and software support using their Army ESI contract. The CHESS helpdesk verified that Dynamics
Systems was not authorized to sell Oracle software only. After additional research, it was discovered that the Oracle Premium Solaris was not under any CHESS contract and therefore was open market. Several phone calls to various Oracle representatives resulted in acquiring an additional Oracle resellers beyond the 6 vendors that had CHESS Blanket Purchasing Orders
(BPAs) or Army Enterprise Software Incenses (ESIs) IDIQs. Each of the vendors listed beyond were forwarded an email to determine if they were capable and interested in providing a quotation. Seven vendors responded immediately with three providing commercial pricing and four declining to bid.

Market research determined that this requirement can be met via competition to Oracle Resellers.
9. Interested Sources: The Government Point of Entry (GPE) notice required by FAR 5.201 for the proposed action will be synopsized on the Federal Business Opportunities (FedBizOps) via the Army Single Face to Industry (ASFI). Any proposals received will be evaluated.

A program on a brand name, other than full and open competition basis, pursuant to the authority
41 U.S.C. 1901(a)(2) as implemented by FAR Subpart 13.501(a)(2), subject to the availability of funds in the amount of and provided that the services and property herein described have otherwise been authorized for acquisition.
If the proposed contract action is not completed within 180 days from the date below or if there is a change to the substance of thins Sole Source Justification that does not meet the AFARS
5106.303-1-90 conditions for the amended Justification and Approval, the Contracting Officer shall document these changes in a memorandum for file and obtain revalidation from the approval authority below.
