FAR Subpart 13.5 Simplified Procedures for Certain Commercial Items – Sole
Source Justification and Approval
1. Contracting Activity: Army Contracting Command Aberdeen Proving Ground Division E 6001 Combat Drive, Building 6001 Aberdeen Proving Ground, MD 21005
2. Description of Action: Communications Electronics Command (CECOM) Software Engineering Center (SEC) requests a new firm-fixed-price (FFP) contract with Skyline Software Systems, 13873 Park Center Road, Suite 201, Herndon, VA 20171. The requirement will procure Skyline TerraBuilder Gold maintenance service support renewal for a quantity of one hundred eighty-one (181) and Skyline TerraExplorer Professional Command and Control/Mission Planning (C2MP) Gold maintenance support service renewal for a total quantity of two hundred ninety-four (294). This contract will comprise of a base and three (3) one (1) year options. The option years will continue the software support purchased during the base year, as well as renewal the support of fifty (50) additional TerraBuilder licenses that will be entering into Post Production Software Sustainment. The applicable North American Industry Classification System (NAICS) Code for this requirement is 541519. The Government projects award for May 2016.
Fiscal Year 2016 Operations and Maintenance, Army (OMA) funds are available and will be used for the base period of this procurement.

This action is a follow-on to contract W15P7T-13-C-E076, per authority FAR 13.106-1 only one responsible source. Application for Brand Name description and FAR 11.105, the acquisition is essential to the Government’s requirements, thereby precluding consideration of a product manufactured by another company.
3. Description of Supplies/Services: DCGS-A is the system that provides the framework for the military services to develop a common, interoperable family of systems to task, post and process, use, and disseminate intelligence, surveillance, and Intelligence Surveillance and Reconnaissance (ISR) sensor data and products. DCGS-A is responsible for providing the Standard and Sharable Geospatial Foundation (SSGF) per the Net-Enabled Mission Command (NEMC) Initial Capabilities Document (ICD).
DCGS-A is the ISR fusion and processing system of systems for the Army’s future force.
The DCGS-A system consolidates functions of several military intelligence (MI), geospatial and weather systems into a single integrated system.
Skyline TerraBuilder and TerraExplorer Pro are currently included in DCGS-A Geospatial Workstation (GWS) baselines.

5. Reason for Authority Cited:
The developer of TerraBuilder and TerraExplorer proprietary software is Skyline Software Systems, 13873 Park Center Road, Suite 201, Herndon, VA 20171. Skyline products are part of the s. Ongoing maintenance support service is required to receive patches, support, and cost-effective upgrades.
Skyline releases new versions periodically with improvements to functionality and design that are beneficial to the Warfighter and the .
Skyline products were originally selected by Program Manager (PM), DCGS-A as meeting Warfighter requirements for the DCGS-A family of systems. The proprietary systems in question became part of m. Replacing a major component of a fielded baseline is out of scope of the SEC Intelligence, Electronic, Warfare and Sensors (IEW&S) sustainment mission while the continues to work new, not-yet-transitioned baselines. To date no other product provides similar capabilities. If other products were identified and selected, it would impact the entire baselines. Any product replacement would result in significant developmental efforts to re-engineer, followed by production and certification testing efforts, then fielding and training.

6. Efforts to Obtain Competition: Market research was performed by the Software Engineering Center (SEC), Centralized Acquisition and License Management (CALM) Team, details of which are in Paragraph 8. The Contracting Officer shall publish the notices required by FAR 5.201.
7. Actions to Increase Competition: Market research will continue to be conducted to determine if changes occur in the market place that would enable greater competition to future actions. If any information is received it will be forwarded to the Contracting Officer for review. Additionally, the developer is also encouraged to pursue distribution of their products/services through small businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses in addition to increasing the number of authorized resellers.
Acquisition Data Availability: The Government possesses only a commercial purchase description for the software. Technical data for the licenses is proprietary to Skyline.
The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product.
8. Market Research: Market research was performed by the CALM Team during the month of November 2015. Searches were performed on the Army Computer Hardware Enterprise Software Solutions (CHESS), the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), and General Services Administration (GSA) websites. A query was sent to the developer’s website for a list of resellers as well as a general web search. SEC CALM received a quote from Skyline Software Systems, along with a statement that there are no resellers for the TerraBuilder and TerraExplorer support software. A CHESS Statement of Non- Availability (SoNA) Number 216703181 was obtained to support the procurement of this requirement.

Approval
Based on the foregoing justification, I hereby approve the procurement of Skyline TerraBuilder and TerraExplorer Professional Command and Control/Mission Planning Support on a sole source basis pursuant to the authority of the Simplified Procedures for Certain Commercial Items, 41 U.S.C. 1901(a)(2) as implemented by FAR Subparts 13.501(a)(1) and FAR 6.302-1, subject to availability of funds, and provided that the services or supplies herein described have otherwise been authorized for acquisition. If this action is not complete within one hundred eighty (180) days, the J&A shall be returned to the Competition Advocate for revalidation. Additionally, if any changes to the requirements, basis for justification, market conditions or increases in the estimated value of the proposed action occur at any time, the Contracting Officer shall document these changes in a memorandum and obtain review/concurrence from the Special Advocate for Competition.
