Sole Source Justification and Approval

1. Contracting Activity: Army Contracting Command Aberdeen Proving

Ground Building 6001 Combat Drive Aberdeen Proving Ground, MD 21005

2. Description of Action: This action is a follow-on to contract W909MY-11-P-0065. That contract was not competed under authority FAR Subsection 6.302-1 Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Need. “XyEnterprise is the only supplier that provides maintenance to the SDL content product suite”. Paragraph, “Actions to Increase Competition” of the previous justification, stated: “Market research will continue to be conducted to determine if changes occur in the market place that would enable competition to future actions. The Government is continuing to do market research; however, XyEnterprise continues to be the sole provider of this proprietary maintenance support service.

3. Description of Supplies/Services: The Software Engineering Center’s Fire Support Engineering Division (FSED) is currently responsible for providing Interactive Electronic Training Publications (IETP) for the ANTPQ36, ANTPQ37, Forward Observer Systems (FOS), Centaur and Gun Direction Unit - Replacement (GDU-R) Systems. The SDL S1000D solution suite of tools is being used to produce technical publications in an Interactive Electronic Training Publication (IETP) and Portable Document Format (.pdf) format. ETPs are technical publications that are prepared in digital form and designed for interactive display to the maintenance technicians or system operator end users by means of a computer controlled viewer. It is the interactive presentation of data modules that are displayed on a screen and are not page formatted. The .pdf technical publications are a presentation of data modules in a printed page-format. The IETP and .pdf version of a technical publication is developed in accordance with (IAW) MIL-STD- 3031A Department of Defense Standard Practice Army Business Rules for S1000D: International Specification for Technical Publications Utilizing a Common Source Data Base, date 25 March 2011. The MIL_STD establishes the business rules (requirements) for technical content, style, format and functionality requirements for technical publications prepared using S1000D Issue 4.0.1 for major weapon systems, and their related systems, subsystems, equipment, weapons replacement assemblies and shop replacement assemblies. These requirements are being used to develop all technical publications. PM RADARs has also required that the operator technical manuals for the ANTPQ36 and ANTPQ37 be prepared in the IETP and .pdf format.

5. Reason for the Authority Cited:

The proposed source for this proprietary software is SDL, 125 Park Avenue, New York, New York 10017. Contenta is maintained by XyEnterpise, a subsidiary of SDL. XyEnterprise is the sole provider of this proprietary maintenance support service. Contenta S1000D is a Commercial-Off-The-Shelf (COTS) Common Source Database (CSDB) that provides out-of-the-box XML schema support for the S1000D specification together with a preconfigured content authoring, management and delivery solution to meet our technical publication needs for producing S1000D and MIL-STD-3031A compliant technical publications. If maintenance is not purchase, development of S1000D and MIL-STD3031A compliant IETPs will be jeopardized. As program progresses, updates would not be made available and future updates may be required at a considerable increase in cost. That is, if maintenance is refused or unavailable we could continue to use the current product until it can no longer be supported or until it becomes necessary to consider an alternate system of tools. To do so, would require examining both the past and present products produced by the SDL and other support tools. Transitioning to another tool would require labor and tools just to make this transition. XML tools, graphic tools and databases licenses are also needed in conjunction with the SDL and would most likely require that all the associated tool sets be examined. We can safely estimate that the 16 contractor personnel and three government personnel who are engaged with the production of Electronic manuals would need training, and schedules would be impacted or put at risk of completion if a new tool would be mandated. These manual are delivered with the system to the Warfighter and provide the needed references to use the software being delivered. But prior to selecting a new tool, time would be needed to review the various publishers of tools for this purpose. The last effort took over two years to determine that SDL provided a good fit.

We had considered 5 other choices prior to making this selection. Selections were based on technical requirements, training availability, ease of making transition of then current product to the new system and cost. It took approximately $60,000 in on-site training and $30,000 in technical support to install and initialize the tools. In the development world it is a serious issue to change tool sets. The impacts are not localized and can have ramification over several years.

6. Efforts to Obtain Competition: In order locate additional suppliers, market research was performed by the Software Engineering Center (SEC), Centralized Acquisition and License Management (CALM) Team, details of which are in Paragraph 8. The Contracting Officer shall publish the notices required by FAR 5.201.

7. Actions to Increase Competition: Commercial software developers are encouraged to increase the number of authorized resellers. Additionally, upon receipt of the requirement an authorized list of authorized distributors for this software is immediately requested from the original manufacturer. The manufacturer is also encouraged to pursue distribution of their products/services through Small businesses, HUBZONE, Service Disabled Veteran Owned, and Woman Owned Small businesses.

8. Market Research: Market research was performed by the CALM Team during the month of October 2015. Searches were performed on the Army Computer Hardware Enterprise Software Solutions, the National Aeronautics and Space Administration (NASA) Solutions for Enterprise Wide Procurement (SEWP), and General Services Administration (GSA) websites. A query was sent to the manufacturer website for a list of resellers as well as a general web search. CALM received a quote from XyEnterprise, a subsidiary of SDL, along with a statement that there are no resellers for the Contenta software. A CHESS Statement of Non-Availability (SoNA) Number 216702400 was received for this requirement.

9. Interested Sources: The Government Point of Entry (GPE) notice required by FAR

5.201 will be published on the Federal Business Opportunities Page. Any proposals that are received shall be considered. To date, no other sources have written to express interest in the acquisition.

b. Acquisition Data Availability: The Government possesses only a commercial purchase description for the software. Technical data for the licenses is proprietary to SDL. The commercial purchase description does not provide enough technical information to allow other vendors to create the functionality of this product.

11. Subcontracting Competition: Although there are no FAR subcontracting provisions that require competition among potential subcontractors for commercial contracts, the Government will seek to maximize subcontracting competition with a focus on subcontracting to small and small disadvantaged businesses.
