Department of the Army

Justification and Approval for Other than Full and Open Competition

1. Contracting Activity: The United States Army Contracting Command -Warren (ACC-WRN) is the procuring activity for this action.

2. Description of the Supplies or Service Purchased: The ACC-WRN proposes to award a firm fixed price contract to 418 Constitution Ave, NE, Washington, DC 20002, , CAGE: 818J8, for the purchase of historical research and writing services to produce a narrative manuscript.

This procurement is for historical research and writing services to produce a narrative manuscript describing the evolution of U.S. Army doctrine during the period from 9/11 through the end of 2016. The resultant contract will be for all necessary research, a prospectus, and the chapters of the manuscript as described in the prospectus.

4. Authority Cited: The statutory authority permitting other than full and open competition is Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements - 10 U.S.C. 2304(c)(1) or 41 U.S.C. 3304(a)(1), as implemented by FAR 6.302-1(2)(i).

5. Reason for Authority Cited: The reason for the authority permitting other than full and open competition is the nature of the requirement and the fact that this author is uniquely qualified to complete this work in a timely and effective manner at the level of quality desired. First, he is just completing a book for a commercial publisher documenting the history of the Army’s development of doctrine in the 1920s and 1930s. Since the first chapter of the work under this contract involves a summary history of Army doctrine development, he is uniquely placed to complete that portion of the work with minimal research. As a result of that commercial book, he has also proven that he is highly qualified to write about the history of the development of Army doctrine. Given the paucity of historical publications in this narrow field, there are no other authors with similar expertise who are readily available to work fulltime on this project. Those few who have written in the field all hold faculty positions and are thus highly unlikely to give up those jobs to work fulltime at CMH (a requirement given the classified nature of the work, which cannot be done offsite.) Second, he served as doctrine officer for a significant portion of his career as an Army officer, and thus is well versed in the Army’s doctrine and its process for developing it. He also served in critical billets closely related to this topic throughout the period covered by this volume. From 2002-2005 he served on the Department of the Army Staff in the G3, Strategic Plans and Policy division. During 2005- 2006 he was on the J5 staff of the Multi-National Security Transition Command-Iraq in Baghdad, which focuses on strategy and long range plans. For the following four years, he worked in the Office of the Secretary of Defense, Office of Net Assessment. During 2011-2012, he served on the J5 staff of the International Security Assistance Force in Afghanistan. His final tour of duty in 2012-2014 was with the headquarters of the Allied Rapid Reaction Corps in North Atlantic Treaty Organization (NATO). Third, during these tours of duty, he worked closely with key figures involved in the Army’s development of doctrine, such as General David Petraeus and Conrad Crane. He is thus well-positioned to obtain oral history interviews with these critical figures. Finally, he is an award-winning author with a very extensive list of publications, including writing and editing four books, contributing to or co-authoring nine more, and writing dozens of published articles and book reviews. He, therefore, has demonstrated his ability to research and write rapidly and at a high level of quality. There are no other authors who have an equal list of credentials, and CMH is currently unaware of anyone with similar credentials in the market capable of undertaking a project of this scope and nature.

6. Competition:

a. Effective Competition: The Government does not intend to solicit additional sources for this effort for the reasons described in Paragraph 5 but will synopsize the requirement on FedBizOps with the intent to go sole source. Any offers received will be considered.

b. Subcontracting Competition: The contractor is a small business concern and as such is exempt from providing a Small Business Subcontracting plan.

7. Market Research: In Aug 2017, the U.S. Army chief historian estimated fair market value for a work of comparable scope using his experience and knowledge of U.S.

military history and similar contracts for like projects executed by other DoD official history programs. A Market Survey was posted on the Federal Business Opportunities website on 30 January – 1 February 18, and no responses of interest were received.

9. Interested Sources: No other sources have expressed an interest in this requirement aside from Mr. Bateman.

10. Actions to Increase Competition: In the future the U.S. Army chief historian will use competitive solicitations for new manuscripts where there is no author available with unique qualifications.

Fair and Reasonable Cost Determination: I hereby determine that the anticipated cost to the Government for this contract action will be fair and reasonable based on the Independent Government Estimate and past procurement history for similar services. In accordance with FAR 15.403-1(b)(3), the contractor will not be required to submit certified cost and pricing data because this action is commercial.
