Justification and Approval for Other than
Full and Open Competition
1. Contracting Activity: United States Army Contracting Command – New Jersey
2. Description of Action: The Combat Capabilities Development Command – Armaments Center (CCDC-AC) requests a new firm fixed price contract with Laser Techniques, Co. 11431 Willows Road NE, Suite 100, Redmond, WA 98052. The Government projects award for September 2019 and fiscal year 2019-2020, funds type Research Development, Testing and Evaluation (RDT&E) funds will be used.
3. Description of Supplies/Services: CCDC-AC has a requirement for a portable laser bore scope inspection system for use with large caliber artillery systems to support calibers larger than 155mm . This system needs to be based on proven existing systems for 105mm, 120mm, and 155mm caliber barrels currently in use at Yuma Proving Grounds, Benet Laboratories, and Aberdeen Proving Grounds. A quantity of two (2) portable laser bore scope inspection systems for cannon tubes are required. These systems will be used for full bore cannon tube erosion and pitting profiling and laser based measurement of smooth bore tubes, full chamber cannon tube erosion profiling and laser-based measurement, and high resolution laser video imaging, material loss and erosion feature detection, and 3D modeling and analysis. The requirement includes a delivery date of sixty (60) days after date of contract award, and, the total estimated value of this effort is .
4. Authority Cited: 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2)(iii)(B), Only one responsible source and no other supplies or services will satisfy agency requirements.
5. Reason for Authority Cited: As described in FAR 6.302-1(a)(2), when supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only a limited number of responsible sources, and no other type of supplies or services will satisfy agency requirements, full and open competition need not be provided for.
Laser Techniques Company, LLC (LTC) was identified during the market research conducted via a Sources Sought Notice as being the only company capable of fulfilling this requirement. LTC has the following unique qualifications for fulfilling this immediate requirement: LTC currently provides laser bore scope inspection equipment for use with 105mm, 120mm, and 155mm smooth bore cannons. Other bore scope inspection systems are on the market, however, they are not viable methods. For example, the current systems on the market for providing bore scope inspection, including video borescope systems, pullover gauges, and STAR gauge for cannon tubes up to 155mm, do not provide the required erosion and material loss data. For example, video borescope inspection allows the user to visually inspect a cannon, but does not provide the erosion and material loss data. So while the user could potentially see the wear damage, the systems do not provide the quantitative data to determine if the barrel is serviceable, needs to be condemned, or presents a risk to future test and evaluation efforts. This information will decrease the risk to Soldiers by decreasing the likelihood of catastrophic failure of cannon barrels.
The new system needs to be portable, allowing the system to be moved to the cannon to be inspected. Inspections and analysis could be conducted at either a remote test site or the manufacturers facility, both of which would require the barrel to be shipped to these locations, which due to the size of the cannon barrels, LTC is uniquely qualified for this immediate requirement. LTC currently produces laser bore inspection systems that are used with the 105mm, 120mm, and 155mm smooth bore cannons, . Further, LTC equipment is currently being used at Benet Laboratories, Yuma Proving Grounds, and Aberdeen Proving Grounds. These systems are all capable of providing the user with erosion and material loss data, a specification that the Government is seeking with the new system. They are field proven and modular in nature, easily adaptable to larger caliber cannons. The new systems being requested for the upcoming contract are for smooth bore cannons which need to have this same capability and be compatible with these existing systems. LTC would be able to easily base the systems off the designs of the currently systems fielded and pre-existing technology, requiring only limited modifications to their existing commercial technology with regards to the focal lengths of the lasers being calibrated to the new caliber of cannon, and adapters. The 155mm system was designed to be adapted to larger caliber cannon barrels, and the system is required to be easily adaptable for future designs that may be larger .
There are major schedule limitations regarding this immediate requirement. The new systems need to be delivered 60 days after date of award or multiple Army systems of record will be impacted. If the Government were to solicit this requirement full and open, potential new vendors would need to design, develop and test the system, , and, this would be unacceptable.
Awarding a sole source contract to LTC reduces the risk of the systems not being delivered on schedule because they are modifying existing commercial technology.
The Government does not currently possess the technical data packages (TDPs) for the equipment used for 105mm, 120mm, and 155mm laser bore scope inspections as the technology is proprietary to LTC so they are not available for use to solicit full and open.
6. Efforts to Obtain Competition:
a. Effective Competition: Because this is a sole source action, effective competition is not applicable. The Contracting Officer shall publish the notices required by FAR
5.201 and any bids or proposals received shall be considered. .
b. Subcontracting Competition: Subcontracting opportunities, if identified, will be achieved by encouraging the prime contractor to maximize subcontracting with the inclusion of FAR Clause 52.244-5.
7. Actions to Increase Competition: Full and Open competition is not practical at this time. The Government will conduct market research prior to any follow-on contract actions, to include, but not limited to, issuing sources sought notices to determine what changes there have been in the industry. This will also include any exchanges between the Government and industry to discuss what capabilities they can provide.
8. Market Research:
Market research was conducted from 23 May to 2 July 2019 using various techniques to include contacting knowledgeable people, in both Government and industry, contacting personnel at Watervliet Arsenal who use a smaller version of the requested system, and issuing a sources sought notice.
In accordance with Defense Federal Acquisition Regulation Supplement (DFARS) 205.205-71, DFARS 206.302-1(d), and DFARS Procedures, Guidance and Information (PGI) 206.302-1(d), a sources sought notice, W15QKN-19-X-06XJ, was posted to Federal Business Opportunities on 18 June 2019 for 15 days and the results were two
(2) responses received from Laser Techniques Company, LLC, and Zistos Corporation.
. Laser Techniques Company, LLC currently provides laser systems used with 105mm, 120mm, and 155mm cannon tubes currently in use at Benet Laboratories, Yuma Proving Grounds, and Aberdeen Proving Grounds.
There are no mandatory sources for the equipment. GSA and CHESS are not able to provide this equipment, and the requirement is for custom inspection equipment.
Based off this research, the Government determined that the best course of action would be to solicit this requirement on a sole source basis to LTC.
9. Interested Sources: Preliminary technical information submitted by Laser Techniques Company, LLC and Zistos Corporation in response to the FedBizOpps (FBO) Source Sought notice has been reviewed by the requiring activity which determined that of the two (2) responses, only Laser Techniques Company, LLC could be capable of providing the requested portable laser bore scope inspection equipment. Zistos Corporation
, . A redacted copy of this justification will be posted on FBO, and any responses received to the posting will be evaluated and if determined to be capable, will be considered for this requirement. The final determination will be made once a response is received to the formal solicitation.
10. Other Facts: This is a new requirement; equipment of this size has not been purchased by the Government before.
