Section SF 30 - BLOCK 14 CONTINUATION PAGE

INSTRUCTIONS TO OFFERORS

1. The purpose of this solicitation is to procure Grounds Maintenance Services in support of the 99th Readiness Division (RD). Services shall be performed at Bristol County ARC, 245 Honorable Gordon Owen Riverway, Taunton, MA 02780. The project included, but is not limited to the contractor providing all plant, labor equipment, tools, materials, supervision and transportation to accomplish grounds maintenance services identified in the Performance Work Statement.

2. The Government intends to award a single firm-fixed-price contract. The period of performance for this effort shall be a 12-month base period and four, 12-month option periods from the date of contract award.

3. See Federal Acquisition Regulation (FAR) Clause 52.212-1, "Instructions to Offerors -- Commercial Items" FAR 52.212-1, Addendum for additional information.

4. See the Basis for Award for additional information and evaluation criteria.

5. Site visits are not mandatory, however, they are highly recommended. A primary site visit will be held on Monday, February 25, 2019 at 10:00AM EST and an alternate site visit will be held on Wednesday February 27, 2019 at 10:00AM EST. Only one site visit is required on either one of the provided dates. Attendees shall meet at the Bristol County ARC, 245 Honorable Gordon Owen Riverway, Taunton, MA 02780. The site visit shall be coordinated via email with the Regional Facility Operation Specialist (RFOS) Peter Boyle peter.j.boyle1.civ@mail.mil and copy Area Facility Operation Specialist (AFOS), Mr. Laurence Stcyr at laurence.g.stcyr.ctr@mail.mil and Contract Specialist, Deborah Terrell at deborah.e.terrell.civ@mail.mil no later than 21 February 2019, 10:00AM EST for security processing. Visitors must have driver’s license or state issued ID and proof of auto insurance for entry. Failure to respond in a timely manner may result in delay or denial of access to the installation. If problems accessing the facility are encountered or directions to the location are required on the day of the site visit, contact Mr. Laurence Stcyr at (603) 732-2157.

6. Questions regarding this solicitation shall be submitted via email to the Contract Specialist, Deborah Terrell at deborah.e.terrell.civ@mail.mil and the Contracting Officer, Lorraine Carruba at lorraine.m.carruba.civ@mail.mil no later than no later than 1 March 2019.

7. All services shall be performed in accordance with the Performance Work Statement (PWS).

8. Contractors must have an active registration in the System for Award Management (SAM) in order to be eligible to be awarded a Department of Defense (DoD) contract. If you need to register in SAM, please do so using the following link: https://www.sam.gov/sam.

9. Contractor offers shall be submitted via the Federal Business Opportunity (FBO) website at https://www.fbo.gov/ using the document upload option. Instructions are available, if needed, in the FBO Vendor Guide on the FBO website. Offers shall include:

- Price/Admin:

a. Unit and extended pricing for all Contract Line Item Numbers (CLINs) for the base and option periods found in Section B, Supplies or Services and Price/Cost of this solicitation. A total price should also be included. Prices shall not extend past the second decimal point for unit and extended amounts. The proposed price shall include all personnel, supplies, services, management, overhead, other directs costs, G&A, and profit to fulfill the contractual requirements of the Performance Work Statement and any Technical Exhibits/Attachments.

b. CAGE Code, DUNS Number, and business-size standard under the applicable NAICS of 561730.

c. Complete blocks 12, 17 and 30 of the SF1449 as well as signing/acknowledging any amendments. In doing so, the offeror accedes to the contract terms and conditions as written in the Request for Quote.

d. Copy of insurance certificate meeting minimum requirements identified in Federal Acquisition Regulation Subpart 28.307-2.

10. All offers shall remain valid for 120 calendar days. Multiple offers will not be accepted.

12. Funds are not presently available for this acquisition. No contract award will be made until appropriated funds are made available.

BASIS FOR AWARD

Evaluation – Commercial Items

(1) Award shall be made to a single contractor. Offer must include prices for each line item listed so quotes may be properly evaluated. Failure to do so may be cause for rejection of the entire offer. Award shall be made to the responsible offeror with the lowest total evaluated price meeting the solicitation requirements The Government intends to award a single Firm Fixed Price (FFP) contract.

(2) The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.

3. PRICE:

a. Proposals shall include prices for each line item listed and a total price, in order that proposals may be properly evaluated. Offers shall also include the completed SF 1449 and any amendments as well as the Certificate for Insurance.

b. The Government will evaluate offers for award purposes by adding the total price for all Contract Line Item Numbers (CLIN) (base period and option periods) for the total evaluated price. In the event there is a difference between a unit price and the total CLIN amount, the unit price will be held as the intended price multiplied by the number of units. If the offeror shows only the total amount but fails to submit a unit price, the total CLIN amount divided by the quantity will be held as the intended price. Evaluation of options shall not obligate the Government to exercise the option(s).

c. Unbalanced pricing exists when, despite an acceptable total evaluated price, one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

4. The Past Performance Information Retrieval System and Federal Awardee Performance & Integrity Information Systems as well any other Government-sponsored information available may be utilized to help make a responsibility determination in accordance with FAR Subpart 9.104.

5. Failure to provide the requested information may deem the proposal Unacceptable and may not be eligible for award.

(a) Definitions. As used in this provision--

Commercial and Government Entity (CAGE) code means--

(1) An identifier assigned to entities located in the United States or its outlying areas by the Defense Logistics Agency (DLA) Commercial and Government Entity (CAGE) Branch to identify a commercial or government entity; or

(2) An identifier assigned by a member of the North Atlantic Treaty Organization (NATO) or by the NATO Support and Procurement Agency (NSPA) to entities located outside the United States and its outlying areas that the DLA Commercial and Government Entity (CAGE) Branch records and maintains in the CAGE master file. This type of code is known as a NATO CAGE (NCAGE) code.

Predecessor means an entity that is replaced by a successor and includes any predecessors of the predecessor.

52.212-3 OFFEROR REPRESENTATIONS AND CERTIFICATIONS--COMMERCIAL ITEMS (OCT 2018)

The Offeror shall complete only paragraph (b) of this provision if the Offeror has completed the annual representations and certification electronically in the System for Award Management (SAM) accessed through https://www.sam.gov. If the Offeror has not completed the annual representations and certifications electronically, the Offeror shall complete only paragraphs (c) through (u)) of this provision.

(a) Definitions. As used in this provision --

“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.

"Forced or indentured child labor" means all work or service-

(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or

“Place of manufacture” means the place where an end product is assembled out of components, or otherwise made or processed from raw materials into the finished product that is to be provided to the Government. If a product is disassembled and reassembled, the place of reassembly is not the place of manufacture.

“Predecessor” means an entity that is replaced by a successor and includes any predecessors of the predecessor.

“Restricted business operations” means business operations in Sudan that include power production activities, mineral extraction activities, oil-related activities, or the production of military equipment, as those terms are defined in the Sudan Accountability and Divestment Act of 2007 (Pub. L. 110-174). Restricted business operations do not include business operations that the person (as that term is defined in Section 2 of the Sudan Accountability and Divestment Act of 2007) conducting the business can demonstrate--

(1) Are conducted under contract directly and exclusively with the regional government of southern Sudan;

(2) Are conducted pursuant to specific authorization from the Office of Foreign Assets Control in the Department of the Treasury, or are expressly exempted under Federal law from the requirement to be conducted under such authorization;

(3) Consist of providing goods or services to marginalized populations of Sudan;

(4) Consist of providing goods or services to an internationally recognized peacekeeping force or humanitarian organization;

(5) Consist of providing goods or services that are used only to promote health or education; or

(6) Have been voluntarily suspended.

“Sensitive technology”--

(1) Means hardware, software, telecommunications equipment, or any other technology that is to be used specifically--

(i) To restrict the free flow of unbiased information in Iran; or

(ii) To disrupt, monitor, or otherwise restrict speech of the people of Iran; and

(2) Does not include information or informational materials the export of which the President does not have the authority to regulate or prohibit pursuant to section 203(b)(3) of the International Emergency Economic Powers Act (50 U.S.C. 1702(b)(3)).

“Service-disabled veteran-owned small business concern”--

(1) Means a small business concern--

(i) Not less than 51 percent of which is owned by one or more service-disabled veterans or, in the case of any publicly owned business, not less than 51 percent of the stock of which is owned by one or more service-disabled veterans; and

(ii) The management and daily business operations of which are controlled by one or more service-disabled veterans or, in the case of a service-disabled veteran with permanent and severe disability, the spouse or permanent caregiver of such veteran.

(2) Service-disabled veteran means a veteran, as defined in 38 U.S.C. 101(2), with a disability that is service-connected, as defined in 38 U.S.C. 101(16).

“Small business concern” means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR Part 121 and size standards in this solicitation.

“Small disadvantaged business concern”, consistent with 13 CFR 124.1002, means a small business concern under the size standard applicable to the acquisition, that--

(1) Is at least 51 percent unconditionally and directly owned (as defined at 13 CFR 124.105) by--

“Subsidiary” means an entity in which more than 50 percent of the entity is owned--

(1) Directly by a parent corporation; or

(2) Through another subsidiary of a parent corporation.

“Successor” means an entity that has replaced a predecessor by acquiring the assets and carrying out the affairs of the predecessor under a new name (often through acquisition or merger).
