INSTRUCTIONS TO OFFERORS
Addendum to FAR 52.212-1, Instructions to Offerors – Commercial Items
1. Requirement Description: The purpose of this solicitation is to procure Grounds Maintenance Services in support of the 99th Regional Support Command (RSC). Services shall be performed at five (5) separate sites (PA-011, PA-
017, PA-020, PA-080 and PA-087). Additional details can be found in Performance Work Statement (PWS) paragraph 1.5.4. and in the attachments to this solicitation (Attachments 0001 through 0005).
2. Acquisition Detail: The Government intends to award a single firm-fixed-price contract. The period of performance for this requirement will begin at the effective date of award for twelve (12) months plus four (4) subsequent option years which will begin on the effective date of award. This shall be procured using FAR Subpart
13.5, Simplified Procedures for Certain Commercial Items, procedures. Additional information can be found in
Basis for Award section of these instructions.
3. All services shall be performed in accordance with the PWS.
4. Contractors must be registered in System for Award Management (SAM) in order to be eligible to be awarded a
Department of Defense (DoD) contract. If you need to register in SAM, please do so using the following link:

5. See Federal Acquisition Regulation (FAR) Clause 52.212-1, "Instructions to Offerors -- Commercial Items" for additional information.
6. Site Visit: The site visit day will tour all four sites. Offerors are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award. Please note delays should be expected at the entry processing center due to increased security measures. Offerors who plan to attend should email a list of attendees to include company name, visitor names, visitor drivers license number and state of issue, and vehicle information (make/model/license number, if known), to the Regional Facilities Operations Specialist (RFOS)
(Randy Baker - randy.a.baker.civ@mail.mil) and Contract Specialist (Michael Bush -michael.a.bush89.civ@mail.mil) for security processing no later than 3:00p.m. EST, 21 June 2017. After coordination with the RFOS, contractors will meet the RFOS at 8:30a.m. EST on 22 June 2017 at Blommen-Russell
USARC, 400 Hillcrest St. Dubois, PA 15801. The RFOS will then take contractors to all of the sites (PA-011, PA-
017, PA-020, PA-080, PA-087). Visitors must have driver’s license or state issued ID and proof of auto insurance for entry. Failure to respond in a timely manner may result in delay or denial of access to the installation.
If problems accessing the base are encountered or directions to the base location are required on the day of the site visit, contact the RFOS at 609-414-1835 – randy.a.baker.civ@mail.mil.

Statement (PWS).
7. Contractor Questions: Questions regarding this solicitation shall be submitted in writing via email no later than

a. Technical:
1. A technical approach which states how you will meet all of the requirements of the PWS, to include availability of labor mix (labor classification/number of hours) and equipment to perform this effort.
Technical approach should be no longer than 10 pages.
2. Provide a list of no more than five (5) past performance references of contracts for similar services occurring within the past three (3) years from the issuance of this solicitation. Past performance references should include: contract numbers, points of contact with telephone numbers/email addresses and other relevant information.
b. Price/Admin
1. Unit prices and extended prices for all Contract Line Items Numbers (CLINS) for the base and option periods found in in Section B, Supplies or Services and Price Cost, of this solicitation.
2. Cage Code, DUNS Number and business-size under NAICS Code 561730.
3. One signed copy of the SF-1449 with blocks 12, 17 and 30 completed as well as signing/acknowledging any amendments. In doing so, the offeror accedes to the contract terms and conditions as written in the
Request for Proposal.
c. Failure to the information requested in Number 9 (above) will deem the offeror’s quote unacceptable.
9. All offers shall remain valid for 120 calendar days.
10. Multiple offers will not be accepted.

Basis for Award:
1. An award for this requirement will be made pursuant to FAR 13.5, Simplified Procedures for Certain Commercial
Items. The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered.
The basis for award of any contract resulting from this solicitation will be the result of the evaluation of the Factors specified utilizing the Lowest Price Technically Acceptable Source Selection methodology. The Government intends to award a single Firm Fixed Price (FFP) contract.
2. The Government intends to award a contract without discussions with respective offerors. The Government, however, reserves the right to conduct discussions if deemed in its best interest.
3. Award shall be made to a single contractor. Award will be made to the lowest priced technically acceptable, responsible offeror that meets the requirements of the PWS and this solicitation.
I. TECHNICAL
a. Ability to perform the requirements of the PWS/solicitation based on the submitted technical approach stating how you will meet the requirements of the PWS/solicitation, to include availability of labor mix (labor classification/number of hours) and equipment to perform this effort
b. Ability to satisfactorily perform the requirements of the PWS/solicitation based on the list submitted of no more than five (5) past performance references of contracts for similar services occurring within the last three (3) years.
The Government may also use other sources to verify or review past performance.
II. PRICE:
a. Proposals shall include prices for each line item listed and a total price, in order that proposals may be properly evaluated.
b. The Government will evaluate offers for award purposes by adding the total price for all Contract Line Item
Numbers (CLIN) (base period and option periods) for the total evaluated price. In the event there is a difference between a unit price and the total CLIN amount, the unit price will be held as the intended price multiplied by the number of units. If the offeror shows only the total amount but fails to submit a unit price, the total CLIN amount divided by the quantity will be held as the intended price. Evaluation of options shall not obligate the Government to exercise the option(s).
c. Unbalanced pricing exists when, despite an acceptable total evaluated price, one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques. A proposal may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.
III. Failure to provide the requested information may deem the proposal Unacceptable and may not be eligible for award.
IV. The Government will begin the evaluation process with a ranking based on the Total Evaluated Price from the lowest to highest price. Following the price ranking, only the lowest priced offeror(s) will be evaluated for technical acceptability under the non-price factor(s) according to the evaluation criteria set forth in paragraph 3 of this section.
If acceptable, the evaluation will stop at that point and award will be made to the lowest priced technically acceptable offeror. If unacceptable, the Government will continue to review proposals in order of price until evaluating one that is technically acceptable and eligible for award. The Government reserves the right to conduct additional technical evaluations as deemed necessary.

“Arbitral award or decision” means an arbitrator or arbitral panel determination that a labor law violation occurred, or that enjoined or restrained a violation of labor law. It includes an award or decision that is not final or is subject to being confirmed, modified, or vacated by a court, and includes an award or decision resulting from private or confidential proceedings. To determine whether a particular award or decision is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“Civil judgment” means—
(1) In paragraph (h) of this provision: A judgment or finding of a civil offense by any court of competent jurisdiction.
(2) In paragraph (s) of this provision: Any judgment or order entered by any Federal or State court in which the court determined that a labor law violation occurred, or enjoined or restrained a violation of labor law. It includes a judgment or order that is not final or is subject to appeal. To determine whether a particular judgment or order is covered by this definition, it is necessary to consult section II.B. in the DOL Guidance.
“DOL Guidance” means the Department of Labor (DOL) Guidance entitled: ``Guidance for Executive Order 13673, `Fair Pay and Safe Workplaces' ''. The DOL Guidance, dated August 25, 2016, can be obtained from www.dol.gov/fairpayandsafeworkplaces.
“Economically disadvantaged women-owned small business (EDWOSB) Concern” means a small business concern that is at least 51 percent directly and unconditionally owned by, and the management and daily business operations of which are controlled by, one or more women who are citizens of the United States and who are economically disadvantaged in accordance with 13 CFR part 127. It automatically qualifies as a women-owned small business eligible under the WOSB Program.
“Enforcement agency” means any agency granted authority to enforce the Federal labor laws. It includes the enforcement components of DOL (Wage and Hour Division, Office of Federal Contract Compliance
Programs, and Occupational Safety and Health Administration), the Equal Employment Opportunity Commission, the Occupational Safety and Health Review Commission, and the National Labor Relations Board. It also means a
State agency designated to administer an OSHA-approved State Plan, but only to the extent that the State agency is acting in its capacity as administrator of such plan. It does not include other Federal agencies which, in their capacity as contracting agencies, conduct investigations of potential labor law violations. (i) The Fair Labor Standards Act;
(ii) The Migrant and Seasonal Agricultural Worker Protection Act;
(iii) 40 U.S.C. chapter 31, subchapter IV, formerly known as the Davis-Bacon Act;
(iv) 41 U.S.C. chapter 67, formerly known as the Service Contract Act;
(v) The Family and Medical Leave Act; and
(vi) E.O. 13658 of February 12, 2014 (Establishing a Minimum Wage for Contractors);
(2) Department of Labor Occupational Safety and Health Administration (OSHA) for--
(i) The Occupational Safety and Health Act of 1970; and
(ii) OSHA-approved State Plans;
(3) Department of Labor Office of Federal Contract Compliance Programs (OFCCP) for--
(i) Section 503 of the Rehabilitation Act of 1973;
(ii) The Vietnam Era Veterans' Readjustment Assistance Act of 1972 and the Vietnam Era Veterans' Readjustment
Assistance Act of 1974; and
(iii) E.O. 11246 of September 24, 1965 (Equal Employment Opportunity);
(4) National Labor Relations Board (NLRB) for the National Labor Relations Act; and
(5) Equal Employment Opportunity Commission (EEOC) for--
(i) Title VII of the Civil Rights Act of 1964;
(ii) The Americans with Disabilities Act of 1990;
(iii) The Age Discrimination in Employment Act of 1967; and
(iv) Section 6(d) of the Fair Labor Standards Act (Equal Pay Act).
"Forced or indentured child labor" means all work or service-
(1) Exacted from any person under the age of 18 under the menace of any penalty for its nonperformance and for which the worker does not offer himself voluntarily; or
(2) Performed by any person under the age of 18 pursuant to a contract the enforcement of which can be accomplished by process or penalties.
