Section SF 30 - BLOCK 14 CONTINUATION PAGE
INSTRUCTIONS TO OFFERORS
1. All questions shall be in writing. Questions may be e-mailed to Valerie Norris at valerie.l.norris2.civ@mail.mil.
2. All offers shall be in writing. Quotes / offers may be e-mailed to Valerie Norris at valerie.l.norris2.civ@mail.mil.
3. Anywhere in this solicitation where the term “quote” is used, it is hereby changed to read “offer”.
4. Anywhere in this solicitation where the term “quoter” is used, it is hereby changed to read “offeror”.
5. It is the offeror’s responsibility that all offers submitted, regardless of method of submission, are received in this office as stated on SF 1449.
6. The proposal must include the following information:
| a. Technical: Facility Assessment consisting of cleanliness, security, amenities, and conformance with Performance Work Statement requirements, solicitation terms and conditions. |
| b. Past Performance: Relevant past or present performance for a similar requirement. |
| c. Price: pricing for each Line Item. Pricing must be submitted in the proper format. The proper format consists of QUANTITY * UNIT AMOUNT = NET AMT. In the event there is a difference between a unit price and the extended total, the unit price will be held to the intended price. If the Quoter/Offeror shows only the total price but fails to enter a unit price, the total divided by the estimated quantity will be held to be the intended price. |
| d. Third party providers should include the additional information requested in paragraph 8 below. Failure to provide this information with your quote may deem your quote non-responsive. |
| e. Complete blocks 12, 17, and 30 of the SF 1449 as well as any amendments. In doing so, the quoter accedes to the contract term and conditions as written in the Request for Quotes (RFQ). |

7. THIS IN NOT A SOLICITATION FOR EVENT PLANNING SERVICES. FOR A PROPOSAL SUBMITTED BY AN OFFEROR THAT IS NOT A HOTEL, THE OFFER MUST SUBMIT A TECHNICAL PROPOSAL FOR EVALUATION WHICH DESCRIBES THE OFFEROR’S TECHNICAL APPROACH FOR PROVIDING THE REQUESTED SERVICES AS THE PRIME CONTRACTOR. AGAIN THIS NOT A SOLICITATION FOR EVENT PLANNING SERVICES. AN OFFER WHICH REQUIRES THE GOVERNMENT TO EXECUTE A SEPARATE AGREEMENT WITH A THIRD PARTY HOTEL SHALL BE DEEMED TECHNICALLY UNACCEPTABLE.
8. AN ON-SITE REPRESENTATIVE MUST BE PRESENT, AND AVAILABLE DURING THE COURSE OF THIS EVENT. QUOTERS MUST SUBMIT THE NAME, AND CONTACT INFORMATION FOR THE ON-SITE REPRESENTATIVE PRIOR TO CONTRACT AWARD.
9. No smoking rooms required. Personal expenses items, and, or services in guest rooms such as long distance phone charges, internet, movie rentals, laundry, room services, etc… will be paid directly by the guest, and shall not be billed under the resultant purchase order.
10. The area of consideration is within a 15 mile radius from the 96th Military Police Battalion located at 11620 Sorrento Valley Rd., San Diego, C.A. 92121. The distance will be calculated by estimating the distance from 11620 Sorrento Valley Rd., San Diego, C.A. 92121 to the exact address where the event is proposed to take place. The distance will be estimated by utilizing commercial search engines; Google Maps, or MapQuest. Whichever website site that yields the least distance will be utilized.
11. The contractor shall provide all personnel, equipment, tools, materials, supervision, and other items necessary to provide the contracted services.
12. Contractors shall quote on all CLINS. CLIN pricing should be all inclusive of labor, labor burden, other direct cost (material, equipment, fees, licenses, etc.), G&A and profit.
13. Line Item pricing should include all applicable taxes, fees, gratuities, commissions, services charges, etc. The federal government is tax exempt.
14. Room rates and lunch meal rate shall not exceed the government travel per diem rates in accordance with Joint Federal Travel Regulation (JFTR).
15. All representations and certifications to include provision of Dun & Bradstreet number are to be returned with the quote. Dun and Bradstreet information can be found by calling (800)-333-0505. A contractor that is receiving an award resulting from this request for quotation must be registered in the System for Award Management (SAM) prior to contract award. To register, offerors may log onto: www.sam.gov.

19. This project is a 100% small business set aside under NAICS 721110 with business size standard of $32.5 mil.
The Prime contractor must provide Point of Contact (POC) at the facility from commencement to conclusion of the lodging. The name of the POC must be submitted with their quote/offer.

The contractor must demonstrate the financial capabilities to fulfill the proposed event.
The contractor must submit the Federal Emergency Management Agency (FEMA) Certification of the proposed facility for the event with their offer/quote.
The contractor must submit with their offer all subcontracting agreements with their offer/quote.
The third party may only submit one offer, otherwise will not be eligible for contract award.
The above must be submitted with quote in order to be considered for contract award.
BASIS FOR AWARD
(A) Basis of Award: Award will be made to the Lowest Price Technically Acceptable (LPTA) offer.
The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforms to the solicitation and is found to be most advantageous to the Government.
The following factors shall be used to evaluate offers:
1. Technical – Facility Assessment consisting of cleanliness, security, amenities, and conformance with terms and conditions of the PWS including any specified radius requirement.
2. Past Performance - The Government will evaluate the quality and extent of the offeror’s performance deemed relevant to the requirement of this solicitation.
Offeror shall provide a list of no more than five (5), of the most relevant contracts performed for Federal agencies within the last two (2) years. Relevant past or present performance shall be similar to the current requirement.
NOTE: Offeror shall fill out PART 1 of the Performance Assessment Questionnaire. The respondent shall fill out PARTS II & III. When completed, Respondent (only) shall return the completed questionnaire electronically via email to the Contract Specialist.
3. Price - (Refer to the instructions to offerors)
(B) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(C) The contractor’s offer shall remain valid until 30 June 2016.

PERFORMANCE WORK STATEMENT
Lodging for the 96th MP Battalion, HSAT PR# 10855574 (This Performance Work Statement is subject to change)
1.0 OBJECTIVE
1.1. This Performance Work Statement (PWS) defines the efforts required for lodging support services to satisfy the overall operational objectives of the 96th MP Battalion HSAT.
2.0 BACKGROUND
The 96th MP Company is conducting home station annual training from 4-12 June 2016 at 96th MP Battalion, San Diego, CA. The unit will need (16) double rooms for lodging during home station annual training from 4-12 June 2016.
3.0 OBJECTIVEs
3.1. Requirement: The contractor shall provide all personnel, facility, equipment, supervision, and other items necessary to perform the requested tasks as described in this Performance Work Statement (PWS).
3.2. Period of Performance: 4-12 June 2016.
3.3. Place of Performance: The hotel shall be within a 15 miles radius of the 96th Military Police Battalion 11620 Sorrento Valley Rd., San Diego, CA 92121.
3.4. Room roster: A detailed roster will be provided to the contractor by the Government Point of Contact or Contracting Officer’s Representative (COR) prior to event start date.
3.5. ADVANCE NOTIFICATION PERIOD: The Government reserves the right to cancel any or all portions of a reservation one week prior to the start date. The cancellation notice will be issued by the Contracting Officer (KO).
4.0 SCOPE OF WORK
4.1. Lodging for Personnel
The contractor shall provide the following capable rooms: Requirement 1 (16 Double Occupancy Rooms X 8 nights): Check-in: 4 June 2016 Check-out: 12 June 2016 The hotel must be able to provide accommodations for 16 nonsmoking double rooms for 8 nights.
All rooms are to be located at the same facility under the same roof. May not use 2 separate hotels or 2 separate buildings to house Soldiers. Only rooms occupied will be funded.
Double occupancy room shall contain but not limited to adequate net living and sleeping areas. No more than two people shall be assigned to a double occupancy room. ROLL away beds cannot be considered as double occupancy rooms.
Each double room should be shared with the same sex gender.
Rooms shall be constructed and finished to provide good light and sound attenuation.
Sufficient electrical outlets shall be available and in good working condition.
All entrance doors to rooms shall have interior security locks, either deadbolt or double locking locks. Each room occupant shall be provided with a room key. Each door shall have an interior opening as the main door entrance.
The sleeping rooms shall be secured enough for Government’s information, supplies, equipment and other properties. Each parking lot shall be equipped with enough amount of lighting for safety of the Soldiers belongings.
Bathrooms must be in a sanitary condition. Bathrooms must contain a shower and/or tub combination with a wash basin, a properly functioning toilet, and a mirror. Additionally, bathrooms must have adequate lighting and grounded electrical outlets for use of electrical razors, hair dryers etc. The shower or shower/tub combination shall have shower doors or curtains.
Rooms shall have adequate heating and cooling capabilities.
Each room must contain at a minimum; a refrigerator, a microwave, a television with cable access, iron and ironing board, and alarm clock.
Vendor shall have the following on-site facilities: Health and Fitness Center and Business Services Center with free Internet access. Vendor’s location must be a low crime area, free of drugs and prostitution.
All rooms will be nonsmoking, and free of bed bugs, lice, rodents or anything that will make the living conditions unsafe and/or unhealthy.
After each room has been checked out, a hotel representative must go and check to make sure no Soldier has left any item behind within 15 minutes of checkout time due to the Soldier being transported to the airport. If so, they must give the unit’s Lodging Coordinator a call with the names of who stayed in the room, and what was left behind.
Daily custodial services shall include, but is not limited to, room cleaning, bed making, linen change (as required), adequate quantities of soap, bath towels, hand towels, sanitized drinking glasses, facial tissues, and a cloth bath mat.
The hotel shall be a within 15 miles radius of the 96th Military Police Battalion 11620 Sorrento Valley Rd., San Diego, CA 92121.
Billing/Payment: All rooms shall be paid for through the contracting office, unless noted otherwise. Personal expenses in guest rooms, such as movies, laundry, and room service, and parking will be paid for by the guest.
4.2. Others:
The Government requires free Internet services. Preferably, the hotel is required to have on-site amenities including fitness center, washers and dryers, business center and breakfast bar.
All sleeping rooms must be at or below the Government’s per diem rate. The Federal Government is tax exempt. The facility furnished shall be solely on the basis of double occupancy. Double occupancy means two individuals assigned to a room with two beds, the contractor shall charge the government the single occupancy room rate.
5.0 MISCELLANEOUS
5.1. Personal Expenses:
Personal expenses in guest rooms such as long distance phone charges, movie rentals, laundry, room service, food or other incidentals shall not be billed under the resultant contract. Any such charges will require the occupant(s) to provide their personal credit cards to secure payment for obligations.
5.2. Safety/Security:
The Contractor’s facility shall comply with all applicable fire and safety codes and regulations.
The Contractor shall have a security plan to ensure the U.S. Army soldiers are in a safe and crime free environment. The meeting and sleeping rooms shall have adequate security for Government’s information, supplies, equipment and other properties.
The hotel presented to the Government must be Federal Emergency Management Agency (FEMA) approved.
5.3. Invoicing:
Quantities in this requirement are estimates. Award winner shall invoice for actual services/supplies provided only. Actual services/supplies provided/rendered in accordance with the terms and conditions of the established contract will be accepted and paid for by the Government. Invoices shall be submitted via the Wide Area Work Flow (WAWF) system for processing.
5.4. Hard Copy Invoicing:
The Contractor shall also provide a hard copy invoice to support WAWF invoicing.
6.0 DEFINITIONS
6.1. CONTRACTOR: The term as used in this requirement refers to the primary (prime) contractor or vendor.
6.2. CONTRACTING OFFICER: The government official who has authority to enter into contract, administer or terminate contracts. He/she can make related determinations and findings on behalf of the government. The Contracting Officer is the ONLY individual who can legally bind the government.

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definitions. As used in this clause--
Department of Defense Activity Address Code (DoDAAC) is a six position code that uniquely identifies a unit, activity, or organization.
Document type means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
Local processing office (LPO) is the office responsible for payment certification when payment certification is done external to the entitlement system.
(b) Electronic invoicing. The WAWF system is the method to electronically process vendor payment requests and receiving reports, as authorized by DFARS 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.

If employees are required to wear uniforms in the performance of this contract (either by the terms of the Government contract, by the employer, by the state or local law, etc.), the cost of furnishing such uniforms and maintaining (by laundering or dry cleaning) such uniforms is an expense that may not be borne by an employee where such cost reduces the hourly rate below that required by the wage determination. The Department of Labor will accept payment in accordance with the following standards as compliance:
The contractor or subcontractor is required to furnish all employees with an adequate number of uniforms without cost or to reimburse employees for the actual cost of the uniforms. In addition, where uniform cleaning and maintenance is made the responsibility of the employee, all contractors and subcontractors subject to this wage determination shall (in the absence of a bona fide collective bargaining agreement providing for a different amount, or the furnishing of contrary affirmative proof as to the actual cost), reimburse all employees for such cleaning and maintenance at a rate of $3.35 per week (or $.67 cents per day). However, in those instances where the uniforms furnished are made of "wash and wear" materials, may be routinely washed and dried with other personal garments, and do not require any special treatment such as dry cleaning, daily washing, or commercial laundering in order to meet the cleanliness or appearance standards set by the terms of the Government contract, by the contractor, by law, or by the nature of the work, there is no requirement that employees be reimbursed for uniform maintenance costs.

REQUEST FOR AUTHORIZATION OF ADDITIONAL CLASSIFICATION AND WAGE RATE {Standard Form 1444 (SF 1444)}
Conformance Process:
The contracting officer shall require that any class of service employee which is not listed herein and which is to be employed under the contract (i.e., the work to be performed is not performed by any classification listed in the wage determination), be classified by the contractor so as to provide a reasonable relationship (i.e., appropriate level of skill comparison) between such unlisted classifications and the classifications listed in the wage determination. Such conformed classes of employees shall be paid the monetary wages and furnished the fringe benefits as are determined. Such conforming process shall be initiated by the contractor prior to the performance of contract work by such unlisted class(es) of employees. The conformed classification, wage rate, and/or fringe benefits shall be retroactive to the commencement date of the contract.
{See Section 4.6 (C)(vi)} When multiple wage determinations are included in a contract, a separate SF 1444 should be prepared for each wage determination to which a class(es) is to be conformed.
The process for preparing a conformance request is as follows:
1) When preparing the bid, the contractor identifies the need for a conformed occupation(s) and computes a proposed rate(s).
2) After contract award, the contractor prepares a written report listing in order proposed classification title(s), a Federal grade equivalency (FGE) for each proposed classification(s), job description(s), and rationale for proposed wage rate(s), including information regarding the agreement or disagreement of the authorized representative of the employees involved, or where there is no authorized representative, the employees themselves. This report should be submitted to the contracting officer no later than 30 days after such unlisted class(es) of employees performs any contract work.
3) The contracting officer reviews the proposed action and promptly submits a report of the action, together with the agency's recommendations and pertinent information including the position of the contractor and the employees, to the Wage and Hour Division, Employment Standards Administration, U.S. Department of Labor, for review. (See section 4.6(b)(2) of Regulations 29 CFR Part 4).
4) Within 30 days of receipt, the Wage and Hour Division approves, modifies, or disapproves the action via transmittal to the agency contracting officer, or notifies the contracting officer that additional time will be required to process the request.
5) The contracting officer transmits the Wage and Hour decision to the contractor.
6) The contractor informs the affected employees.
Information required by the Regulations must be submitted on SF 1444 or bond paper.
When preparing a conformance request, the "Service Contract Act Directory of Occupations" (the Directory) should be used to compare job definitions to insure that duties requested are not performed by a classification already listed in the wage determination. Remember, it is not the job title, but the required tasks that determine whether a class is included in an established wage determination. Conformances may not be used to artificially split, combine, or subdivide classifications listed in the wage determination.
